Decree No. 145/2024/NĐ-CP amends Clause 2 of Article 12 of Decree No. 03/2017/NĐ-CP dated January 16, 2017 of the Government on casino business.

DECREE

Amending Clause 2 of Article 12 of Decree No. 03/2017/NĐ-CP dated January 16, 2017 of the Government on casino business

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Investment Law dated June 17, 2020;

Pursuant to the Law on Enterprises dated June 17, 2020;

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2022;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Public Investment, the Law on Public-Private Partnership Investment, the Law on Investment, the Law on Housing, the Law on Bidding, the Law on Electricity, the Law on Enterprises, the Law on Special Consumption Tax, and the Law on Civil Enforcement dated January 11, 2022;

At the proposal of the Minister of Finance;

The Government promulgates this Decree amending Clause 2 of Article 12 of Decree No. 03/2017/NĐ-CP dated January 16, 2017 of the Government on casino business.

Article 1. Amending Clause 2 of Article 12 of Decree No. 03/2017/NĐ-CP dated January 16, 2017 of the Government on casino business

"2. Duration of pilot implementation

a) For the first enterprise engaged in casino business permitted by the competent authority to allow Vietnamese citizens to play at casinos, the duration of the pilot implementation shall end on December 31, 2024. For other enterprises engaged in casino business permitted by the competent authority to allow Vietnamese citizens to play at casinos (if any), the duration of the pilot implementation shall be three years from the date of issuance of the Certificate of Eligibility for Casino Business.

b) Upon completion of the pilot period specified in point a of this clause, the enterprise conducting the pilot for Vietnamese citizens to play at casinos shall continue to operate until the Government issues a Decree regarding the termination or permission for Vietnamese citizens to play at casinos as stipulated in point d of this clause.

c) The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security, the Ministry of Planning and Investment, the Ministry of Culture, Sports and Tourism, the State Bank of Vietnam, and the People's Committee of the province or city where the enterprise permitted to conduct the pilot for Vietnamese citizens to play at casinos is located to conduct a summary, evaluation, and report to the Government for submission to the competent authority for consideration and decision on terminating or continuing to permit Vietnamese citizens to play at casinos as follows:

Before November 30, 2024, for the enterprise engaged in casino business that was permitted by the competent authority to conduct the pilot for Vietnamese citizens to play at the casino location.

Sixty days prior to the end of the pilot period for other enterprises engaged in casino business permitted by the competent authority (if any).

d) Based on the decision of the competent authority, the Government shall issue a Decree regarding the termination or continuation of permission for Vietnamese citizens to play at casinos for the enterprises conducting the pilot."

Article 2. Implementation clause

1. This Decree takes effect from November 4, 2024.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and municipal People's Committees directly under the central government, and related organizations and individuals are responsible for implementing this Decree.
