Guidelines for the functions, tasks, authorities, and organizational structure of Provincial and Central City Standard Measurement Quality Control Agencies

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government stipulating the tasks, powers, and organizational structure of the Ministry of Science, Technology and Environment;

The Ministry of Science, Technology and Environment, Civil Service and Staff Affairs Board of the Government guides the functions, tasks, powers, and organizational structure of the science, technology and environment management agency at provincial level and centrally-administered city as follows:

I. The science, technology and environment management agency at provincial level and centrally-administered city shall be reorganized on the basis of the Science and Technology Commission (now called Department of Science, Technology and Environment).

II. Functions of the Department of Science, Technology and Environment:

The Department of Science, Technology and Environment (KH&CN & MT) is an agency of the People's Committee (PC) of the province and centrally-administered city (hereinafter referred to as province) responsible before the PC of the province for performing state management functions regarding science, technology, and environmental protection in the province in accordance with state laws.

The Department of Science, Technology and Environment is subject to the guidance, supervision, and inspection of the Ministry of Science, Technology and Environment in terms of professional and business matters.

III. Tasks and Powers of the Department of Science, Technology and Environment:

1. Study and propose to the Chairman of the Provincial People's Committee specific implementation of systems, policies... concerning science, technology, and the environment in accordance with the characteristics and conditions of the locality. Specific implementation must not contravene national regulations or those of the sectoral management ministry.

2. Develop and propose to the Chairman of the Provincial People's Committee decisions on tasks and programs for the development of science, technology, and environmental protection in the locality in line with the orientation for economic and social development of the locality, and report to the Minister of Science, Technology and Environment.

3. Guide and direct scientific organizations in planning research and applying technological progress to production and daily life, consolidate and propose to the Provincial People's Committee for decision-making, and monitor and inspect the implementation of programs and projects funded by the state budget.

4. Manage technology transfer activities, participate in state technical appraisal for important investment projects in the province. Monitor and guide the assessment of technological levels in economic organizations within the province.

5. Plan and implement measures to protect the environment in the locality according to legal provisions. Monitor and coordinate the implementation of inter-sectoral environmental protection measures in the province. Chair the review or comment on environmental impact assessments and investment projects under the province's jurisdiction. Inspect and monitor environmental changes in the locality according to guidelines from the Ministry of Science, Technology and Environment.

6. Manage standardization, measurement, and product quality control activities in accordance with legal provisions.

7. Manage activities related to innovation and industrial property rights in accordance with the Ordinance on Protection of Industrial Property Rights and other government and ministry legal regulations.

8. Conduct state inspections on organizations and individuals of all economic sectors in their compliance with policies and laws on science, technology, and environmental protection.

9. Examine and issue registration permits for organizations engaged in scientific research and technology development activities in all economic sectors within the province according to Circular No. 195/LB dated November 13, 1992 jointly issued by the Ministry of Science, Technology and Environment and the Civil Service and Staff Affairs Board of the Government, and inspect the implementation thereof.

10. The Department of Science, Technology and Environment serves as the permanent body of the Provincial Science Council.

11. Manage state-affiliated organizations under the Department (if any) in accordance with the provisions of Article 12 of Decree No. 15/CP of the Government dated March 2, 1993 and the delegation of authority by the Minister of Science, Technology and Environment to the Chairman of the Provincial People's Committee.

12. Manage the organization, staff, finance, and assets of the Department in accordance with the division of labor and delegation of authority by the Provincial People's Committee and state regulations.

IV. Organization and Structure

1. The organizational structure and staffing of the Department of Science, Technology and Environment shall be decided by the Chairman of the Provincial People's Committee based on the specific needs and workload of each locality within the total number of state management staff allocated by the Government to the province. Staffing must comply with the standards and positions of civil servants.

2. The Department of Science, Technology and Environment shall be managed by the Director of the Department. The appointment, dismissal, and removal of the Director of the Department shall be carried out in accordance with the provisions of Article 8 of Decree No. 15/CP dated March 2, 1993 of the Government.

3. The Director of the Department of Science, Technology and Environment shall be responsible to the Chairman of the Provincial People's Committee for all activities of the Department and to the Minister of Science, Technology and Environment for professional and business matters in the field of science, technology, and environment in the province in accordance with legal provisions.

The Director of the Department shall have an Assistant Director (in Hanoi, Ho Chi Minh City, and Hai Phong, there are two Assistant Directors).

Based on this Circular, the civil service boards need to cooperate with the Departments of Science, Technology and Environment to design an organizational structure plan based on actual requirements and characteristics of the province, aiming for efficiency and simplicity, especially avoiding the formation of new state-funded public institutions. Propose to the Chairman of the Provincial People's Committee for decision and report back to the joint ministry. During implementation, if there are difficulties, reports should be sent to the joint ministry for study and resolution.
