||| Guidelines for functions, tasks, authorities, and organizational structure of science, technology, and environmental management agencies at provincial and centrally governed city levels

 ||| Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government stipulating the tasks, authorities, and responsibilities for state management by ministries and ministerial-level agencies;

||| Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government stipulating the tasks, authorities, and organizational structure of the Ministry of Science, Technology, and Environment;

||| The Ministry of Science, Technology, and Environment, and the Government's Organizational and Cadre Affairs Board issue guidelines for the functions, tasks, authorities, and organizational structure of science, technology, and environmental management agencies at provincial and centrally governed city levels as follows:

||| Chapter I. Science, Technology, and Environmental Management Agencies at Provincial and Centrally Governed City Levels shall be reorganized based on the Science and Technology Committee (now called the Department of Science, Technology, and Environment).

||| Chapter II. Functions of the Department of Science, Technology, and Environment:

||| The Department of Science, Technology, and Environment (KHCN & MT) is an agency under the People's Committee (PC) of the province or centrally governed city (hereinafter referred to as the province), responsible before the PC of the province for performing state management functions regarding science, technology, and environmental protection according to national laws.

||| The Department of Science, Technology, and Environment is subject to guidance, inspection, and supervision in specialized fields and operations by the Ministry of Science, Technology, and Environment.

||| Chapter III. Tasks and Authorities of the Department of Science, Technology, and Environment:

||| 1. Research and propose to the Chairman of the People's Committee of the province specific implementation of systems, policies... concerning science, technology, and the environment in accordance with local characteristics and conditions. Specific implementation must not contravene national regulations or those of the sectoral management ministry.

||| 2. Develop and propose to the Chairman of the People's Committee of the province decisions on tasks and programs for science, technology development, and environmental protection in the locality, consistent with the direction of economic and social development of the locality, and report to the Minister of Science, Technology, and Environment.

||| 3. Guide and direct scientific organizations in planning research and applying technological progress to production and daily life, consolidate and propose to the People's Committee of the province for decision-making, and monitor and inspect the implementation of programs and projects funded by the state budget.

||| 4. Manage technology transfer activities, participate in state technical appraisal for important investment projects in the province. Monitor and guide the assessment of technological levels in provincial economic organizations.

||| 5. Plan and implement measures to protect the environment in the locality according to legal provisions. Coordinate and oversee the implementation of inter-sectoral environmental protection measures in the province. Chair or comment on environmental impact assessments and investment project reports within the province's jurisdiction. Inspect and monitor environmental changes in the locality according to the Ministry of Science, Technology, and Environment's guidelines.

||| 6. Manage standardization, measurement, and product quality control activities according to legal provisions.

||| 7. Manage innovation and industrial property activities according to the Ordinance on Protection of Industrial Property Rights and other government and ministry legal documents.

||| 8. Conduct state inspections on organizations and individuals from all economic sectors in compliance with policies and laws on science, technology, and environmental protection.

||| 9. Examine and issue registration permits for organizations engaged in scientific research and technological development activities in the province according to Circular No. 195/LB issued by the Ministry of Science, Technology, and Environment and the Government's Organizational and Cadre Affairs Board on November 13, 1992, and supervise their implementation.

||| 10. The Department of Science, Technology, and Environment serves as the permanent body of the Provincial Science Council.

||| 11. Manage state-affiliated public institutions under the Department (if any) according to the provisions of Article 12 of Decree No. 15/CP of the Government dated March 2, 1993, and the delegation of authority by the Minister of Science, Technology, and Environment to the Chairman of the People's Committee of the province.

||| 12. Manage the organization, personnel, finance, and assets of the Department according to the division of labor and delegation of authority by the People's Committee of the province and national regulations.

||| Chapter IV. Organization and Structure

||| 1. The organizational structure and staffing of the Department of Science, Technology, and Environment are decided by the Chairman of the People's Committee of the province based on the specific needs and workload of each locality within the total number of state management staff allocated by the Government to the province. Staffing must comply with established standards and civil service positions.

||| 2. The Department of Science, Technology, and Environment is managed by the Director of the Department. Appointment, dismissal, and removal of the Director of the Department are carried out according to the provisions of Article 8 of Decree No. 15/CP dated March 2, 1993, of the Government.

||| 3. The Director of the Department of Science, Technology, and Environment is accountable to the Chairman of the People's Committee of the province for all activities of the Department and to the Minister of Science, Technology, and Environment for professional and operational matters in the field of science, technology, and environment in the province according to legal provisions.

||| Assist the Director of the Department, there is one Deputy Director (in Hanoi, Ho Chi Minh City, and Hai Phong, there are two Deputy Directors).

||| Based on this Circular, organizational bodies need to coordinate with the Departments of Science, Technology, and Environment to design an organizational structure plan based on actual requirements and local characteristics, ensuring efficiency and simplicity, particularly avoiding the formation of additional public institutions funded by the state budget, and submit it to the Chairman of the People's Committee of the province for decision and report back to the relevant ministries.
