DECISION NO. 146/2000/QĐ-TC OF SEPTEMBER 18, 2000 ISSUED BY THE MINISTER OF FINANCE ON THE ADOPTION OF THE AMOUNT OF FEES FOR ISSUING CRIMINAL RECORD CERTIFICATES

THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
After receiving the opinion of the Ministry of Justice (document number 1233/TP-LLTP dated July 21, 2000) and upon the proposal of the Director General of the State Revenue Administration,

Article 1.- Vietnamese citizens and foreigners who submit applications and are issued criminal record certificates by competent state management authorities in accordance with Circular Joint No. 07/1999/TTLT-BTP-BCA dated February 8, 1999 of the Ministry of Justice and the Ministry of Public Security must pay the fee for issuing criminal record certificates at the rates specified below:

1. Vietnamese citizens within the country: 100,000 Vietnamese Dong per person per application.

2. Foreigners and Vietnamese citizens residing abroad: 200,000 Vietnamese Dong per person per application.

The fee rates specified herein include the costs of application forms for requesting a criminal record certificate.

Article 2.- The fee collection agency shall retain 20% of the total amount of fees collected to cover expenses related to organizing the collection process as follows:

- Purchasing (or printing) various forms, criminal record certificates, accounting books.

- Providing allowances for conducting criminal record verification in complex cases.

- Allocating a bonus fund for staff involved in collecting and paying fees. The average annual bonus amount for each individual shall not exceed three months' salary.

- Other expenses directly related to the collection of fees.

The remaining 80% must be deposited into the state budget. The amount of fees retained according to the above ratio (20%) must be balanced against the annual budget and used in accordance with prescribed regulations. At the end of the year, any unspent funds must be deposited into the state budget. The collection agency has the responsibility to organize the collection, payment, and management of fees in accordance with Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding implementation.

Article 3.- This Decision takes effect 15 days from the date of signature. Any provisions regarding the collection of fees for issuing criminal record certificates that conflict with this Decision are hereby abolished.

Article 4.- Organizations and individuals subject to payment of fees, and related agencies are responsible for implementing this Decision.
