DECISION OF THE MINISTER OF FINANCE

Regarding the issuance of the fee rate for issuing criminal record certificates

 

THE MINISTER OF FINANCE

Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, authorities, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government onthe duties, powers, and organizational structure of the Ministry of Finance;

Pursuant to the Government Decree No. 04/1999/NĐ-CP dated January 30, 1999 on fees and charges under the State budget;

After receiving the opinion of the Ministry of Justice (Letter No. 1233/TP-LLTP dated July 21, 2000) and upon the proposal of the Director General of the Tax General Department,

DECISION:

Article 1.-Vietnamese citizens and foreigners who submit applications and are granted criminal record certificates by competent state authorities according to Circular Joint No. 07/1999/TTLT-BTP-BCA dated February 8, 1999 of the Ministry of Justice and the Ministry of Public Security must pay the fee for issuing criminal record certificates at the rates specified below:

1.Vietnamese citizens residing within Vietnam shall pay VND 100,000 per application per person.

2.Foreigners and Vietnamese citizens residing abroad shall pay VND 200,000 per application per person.

The collection rate prescribed in this Article includes all costs associated with the application for criminal record certificates.

Article 2.-The fee collection agency is entitled to retain 20% of the total collected fees to cover expenses related to organizing the collection process as follows:

-Purchasing (or printing) various forms, criminal record certificates, accounting books.

-Compensating for work involved in verifying criminal records in complex cases.

-Allocating a reward fund for staff involved in collecting and remitting fees. The average annual reward per person shall not exceed three months' salary.

The remaining amount (80%) must be deposited into the state budget. The portion retained (20%) must be balanced against the annual budget and used strictly in accordance with the prescribed regulations. At the end of the year, any unspent funds must be deposited into the state budget. The collection agency is responsible for organizing the collection, depositing, and managing the fees in accordance with the provisions of the Government Decree No. 04/1999/NĐ-CP dated January 30, 1999 on fees and charges under the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding implementation.

This Decision takes effect fifteen days from the date of signature. All provisions concerning the collection of fees for issuing criminal record certificates that conflict with this Decision are hereby abolished.

Organizations and individuals subject to payment of fees, and relevant agencies are responsible for implementing this Decision./.

Article 3.-This Decision shall take effect fifteen days from the date of signature. Abolish regulations on the collection of fees for issuing criminal record certificates that are contrary to this Decision.

Article 4.-Organizations and individuals subject to payment of fees, and relevant agencies shall be responsible for implementing this Decision./.
