REGARDING THE TRANSFORMATION OF OPERATIONAL MODES OF PUBLICLY-FINANCED UNIVERSITIES AND COLLEGES

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Education Law dated June 14, 2005;
Considering the proposal of the Minister of Education and Training.
DECISION:
Article 1. Permitting the transformation of operational modes of publicly-financed universities and colleges to the following types:
1. The Publicly-Financed University of Marketing, the Publicly-Financed Ton Duc Thang University, the Publicly-Financed College of Technology and Business Management, and the Publicly-Financed Hoa Sen College shall be transformed into private universities and colleges.
2. The Publicly-Financed Open University of Ho Chi Minh City shall be transformed into a public university to fulfill distance education tasks.
3. The universities and colleges mentioned in Clauses 1 and 2 of this Article may decide whether to include the phrase identifying the type of institution in their names.
Article 2. Entrusting the Ministry of Education and Training to take the lead, coordinate with the Ministry of Finance, the Ministry of Home Affairs, the Ministry of Natural Resources and Environment, and relevant ministries and sectors to issue regulations and guidelines for the transformation of operational modes of universities and colleges as stipulated in Article 1 of this Decision.
The transformation of operational modes of institutions must ensure strict legality, clarity, transparency, and compliance with financial and asset regulations; protect legitimate rights and interests of staff, workers, and students; and be consistent with the Charter of Private Universities issued by the Prime Minister and the Regulations on Organization and Operation of Private Colleges issued by the Minister of Education and Training.
The handling of existing capital, assets, and land of the schools shall be carried out in accordance with current laws.
Deadline for transformation: completion before June 30, 2007.
Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette.
Ministers of the Ministries of Education and Training, Finance, Planning and Investment, Home Affairs, Natural Resources and Environment; Heads of related agencies; Chairman of the People's Committee of Ho Chi Minh City; and Principals of the institutions mentioned in Article 1 are responsible for implementing this Decision./.
