DECISION OF THE MINISTER OF FINANCE

Regulations on the functions, tasks, powers, and organizational structure of Department I

THE MINISTER OF FINANCE

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Considering the proposal of the Director of Department I and the Director of the Cadre and Civil Servant Organization Department.

DECISION:

Article 1.

Department I is a unit within the state management machinery of the Ministry of Finance, assisting the Minister of Finance in managing finance and budget related to national defense and security; party budgets and certain special units and programs (hereinafter referred to as the managed objects) in accordance with the law and the assignment of the Minister of Finance.

Article 2. Department I has the following tasks:

1. Taking the lead and coordinating with other units to submit draft regulatory legal documents, policies, systems, and standards for revenue and expenditure of financial and budgetary matters concerning the managed objects to the Ministry.

2. Submitting proposals to the Ministry for decisions on applying systems and policies suitable for the specific characteristics of special budget-receiving units.

3. Guiding the managed objects in building annual budget estimates, implementing financial and budgetary management systems and policies.

4. Participating and coordinating in developing national financial strategies and policies; participating in issues related to salaries and policies concerning the managed objects.

5. Taking the lead and coordinating with units under the Ministry to work with the managed objects on the construction and consolidation of annual budget estimates; coordinating with the Investment Department to participate with relevant agencies in reviewing financial plans, total investment amounts, total budgets, and investment policies for Group A projects and programs decided by the Prime Minister that fall under the managed objects; taking the lead and coordinating with units to consolidate the budget expenditures of the Ministry of National Defense and the Ministry of Public Security, and the situation of budget management for national defense and security activities annually of central ministries, agencies, and localities.

6. Participating and coordinating with units under the Ministry to guide central ministries, agencies, and localities in implementing financial expenditures for national defense and security work.

7. Taking the lead and coordinating with units under the Ministry to manage the budget funds of special units and programs according to the division of labor by the Ministry.

8. Managing the implementation of approved budget estimates of the managed objects; taking the lead and coordinating with relevant units to submit proposals to the Ministry for handling urgent expenditure needs of the managed objects.

9. Auditing final accounts of first-level budget units belonging to the managed objects.

10. Inspecting the management of finances and budgets of the managed objects.

11. Statistics, analysis, and evaluation of the effectiveness of budget fund usage in the assigned management area.

12. Requesting relevant units and the managed objects to provide necessary materials and data to serve the management tasks of the Department.

13. Submitting proposals to the Ministry for decisions on handling violations of financial and budgetary management systems by the managed objects.

Article 3. The Director of Department I has the authority:

- To sign notifications approving budget estimates for the managed objects within the scope approved by the Minister;

- To sign notifications and comments on the final accounts of annual state budgets of first-level budget units belonging to the managed objects;

- To sign documents explaining financial and budgetary procedures as assigned by the Ministry;

- To sign documents responding to agencies, organizations, or individuals authorized by the Ministry;

- To receive information and materials from agencies, units, and localities to serve the management work of the Department.

Article 4.

Department I has a Director and several Deputy Directors; the Director is responsible for comprehensive management of the staff of the Department; organizing training and enhancing the competence of staff; being accountable to the Minister for all activities of the Department.

Deputy Directors are accountable to the Director for the tasks assigned to them.

Department I operates under a specialist system. The Director is responsible for organizing work, arranging, scheduling, and assigning tasks to staff in accordance with their professional capabilities to complete assigned tasks.

The staffing of Department I is determined by the Minister of Finance.

Article 5. This Decision takes effect from the date of signing. Decree No. 985 TC/QĐ/TCCB dated September 6, 1995 of the Minister of Finance on the establishment of the Charter of organization and operation of the Department of Financial Affairs for National Defense and Security is hereby repealed.

The Director of Department I, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry's Office, heads of relevant units and organizations are responsible for implementing this Decision./.
