DECISION:
Article 1. Approving the National Action Plan to accelerate the implementation of commitments under the Agreement on the Sanitary and Phytosanitary Measures (SPS Agreement) to fulfill obligations as a member of the World Trade Organization (WTO) with the following contents:
I. OBJECTIVES
Creating fundamental changes in improving the capacity of state management agencies towards the goals:
1. Fully implementing the SPS Agreement as committed upon joining the World Trade Organization;
2. Minimizing negative impacts and maximizing advantages for Vietnam's agricultural, forestry, fisheries, and food processing industries as a member of the WTO;
3. Ensuring food safety for consumers both domestically and internationally through providing high-quality agricultural and food products that are not contaminated by chemicals and harmful microorganisms;
4. Further promoting trade in agricultural, forestry, and fishery products, processed foods, enhancing competitiveness and market penetration for Vietnamese products in international markets;
5. Protecting domestic agricultural, forestry, and fishery production from invasive pests and diseases through imported products, protecting the ecological environment, and the diversity of animal and plant resources in Vietnam.
II. CONTENT AND SOLUTIONS
1. Content of Implementing Commitments Under the WTO/SPS Agreement
a) Strengthening Institutions
- Improving the system of regulatory legal documents in accordance with international regulations and practices: amending, developing, and promulgating guiding documents;
- Developing technical regulations on good agricultural practices, good livestock practices, and good aquaculture practices according to regional and international standards to ensure safety in the food chain;
- Developing technical regulations on fertilizers, pesticides, and animal feed (including aquatic animal feed) according to international standards and recommendations to ensure hygiene and safety in agricultural, forestry, and fishery production;
- Developing legal regulatory documents and technical regulations on biological safety in food production, processing, and storage, in agriculture, and livestock farming;
- Establishing coordination mechanisms among levels and sectors in disease investigation, notification, and cooperation in pest and disease control based on proactive monitoring principles; - Socializing veterinary work and food safety supervision;
- Improving organization and regulations regarding inspection, testing, and certification of food safety for agricultural, forestry, and fishery products, fresh and processed food items.
b) Enhancing Capacity for SPS Personnel
- Developing a human resource development plan with scientific knowledge and skills to meet international integration requirements in food safety inspection, supervision, and quarantine;
- Enhancing the capacity of personnel at the National SPS Inquiry Office and technical support points within ministries and sectors to meet transparency information disclosure requirements under SPS obligations;
- Training specialized staff with language proficiency in each field of food safety, veterinary science, and plant protection skills in resolving SPS issues related to trade;
- Enhancing the capacity of personnel in food safety risk analysis, animal and plant disease diagnosis, testing, and surveillance, antibiotic residue detection, and pest control.
c) Promoting Information and Awareness Campaigns
- Disseminating the content of the SPS Agreement and the importance of complying with its provisions in trade to all levels, sectors, and relevant organizations, particularly to associations, businesses, and production units;
- Raising awareness among food processing enterprises about the negative health impacts on consumers, reputation in domestic and export markets when violating SPS regulations;
- Building a database on SPS for Vietnam and trading partner countries, updating information on the SPS Vietnam Electronic Portal, printing guidance materials;
- Disseminating and training to enhance the capacity of technicians and model farmers applying good agricultural practices (GAPs), good livestock practices (GAHPs), good aquaculture practices (GFPs), good manufacturing practices (GMPs), and hazard analysis and critical control point (HACCP) systems, skills in identifying pests and primary measures in veterinary, fishery, and plant protection pest control (training, demonstration model building, technical material editing and printing, establishing online information dissemination systems, creating CD databases on survey methods, identification, basic biological and ecological characteristics of pests, and control methods);
- Providing producers, processors, and traders with knowledge on post-harvest processing and preservation technologies for agricultural, forestry, and fishery products to ensure food safety; - Establishing, applying, and utilizing information dissemination networks for community education on food safety and pest control.
d) Expanding Markets for Agricultural, Forestry, and Fishery Products
- Studying foreign markets and technical regulations to increase the processing rate and value of agricultural, forestry, and fishery products, fresh and processed food exports;
- Developing trade promotion programs in compliance with WTO regulations (Agreement on Agriculture - AoA);
- Raising awareness among businesses on implementing SPS Agreement commitments, complying with SPS regulations of trading partner countries, and resolving trade issues related to SPS.
- Establish an integrated supply chain model for certain export agricultural products in accordance with internationally recognized technical procedures (GLOBAL GAP, Fair Trade, and other internationally recognized certification standards).
2. Measures to fulfill obligations under the WTO/SPS Agreement
a) Ensuring scientific rigor
- Develop food safety risk monitoring systems and foodborne disease surveillance systems. Forecast and predict contamination risks for major food groups at different stages throughout the year. Strengthen information dissemination and reporting systems on food poisoning and foodborne diseases;
- Establish a national rapid food safety alert system and connect it with the ASEAN and EU rapid food safety alert systems;
- Build a network and implement a national program to forecast and control pests and diseases affecting plants and animals based on ecological and geographical conditions, prioritizing key crops and livestock;
- Implement a program to prevent the entry of viruses causing white spot syndrome (WSSV), yellow head virus (YHV), and hepatopancreatic parvovirus (HPV) in shrimp, and eliminate completely the white spot syndrome virus (WSSV), yellow head virus (YHV) in shrimp and red spot disease in catfish;
- Conduct risk analysis and assessment of pests and diseases on imported agricultural products and livestock, as well as contamination risks for raw materials used in food processing and animal feed, and develop appropriate SPS measures accordingly;
- Train staff to enhance their capacity in diagnosing, inspecting, and testing food safety, analyzing and diagnosing plant and animal diseases, and strengthen equipment and personnel capabilities at regional animal quarantine stations, seaports, airports, and border gates;
- Study post-harvest handling solutions for vegetables and fruits before exportation in compliance with SPS Agreement provisions;
b) Building and harmonizing Vietnam's food safety and animal and plant quarantine standards with those of CODEX, OIE, and IPPC;
- Review, amend, and promulgate food standards in line with CODEX guidelines and recommendations. Identify resources to actively participate in CODEX Commission activities;
- Review, amend, and promulgate standards and technical regulations on animal quarantine (land and aquatic) in accordance with CODEX and OIE guidelines and recommendations. Identify resources to actively participate in CODEX and OIE activities;
- Review, develop, and promulgate standards and technical regulations on plant quarantine in line with IPPC guidelines and recommendations. Identify resources to actively participate in IPPC activities;
- Develop a "One Standard" project for exported and domestically consumed products;
Article 2. Implementation
1. On the basis of the main contents of the Action Plan and in accordance with their respective functions and tasks, the Ministers of relevant ministries directly direct and assign competent units under their specific management to concretize activities and allocate annual budgets for implementation. For activities not carried out according to projects or programs, immediate organization for implementation shall be organized to meet actual needs and ensure efficiency in fulfilling commitments.
2. The Ministers of the Ministries of Agriculture and Rural Development, Health, Industry and Trade, Science and Technology, based on the functions and tasks assigned to them, shall monitor and urge the implementation of the Action Plan and regularly report to the Prime Minister to ensure that the contents and solutions of the Action Plan are implemented in a coordinated and effective manner.
Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 4. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
