DECREE
Regarding the organization of basic education levels
PRESIDENT OF THE VIETNAM DEMOCRATIC REPUBLICIC GOVERNMENT
Pursuant to the Decree No. 119 dated July 9, 1946 organizing the Ministry of National Education;
Pursuant to the Decree No. 44 dated October 10, 1945 establishing the Advisory Council for Education;
Pursuant to the Decree No. 146 dated August 10, 1946 organizing educational levels nationwide;
Pursuant to the proposal of the Minister of National Education;
After presenting to the Standing Committee of the National Assembly and the Government Council reached an agreement,
ISSUES THE DECREE:
Article 1
The basic education level aims to provide a minimum education and basic education for all children aged seven and above.
Article 2
Basic education will be free of tuition fees and starting from 1950, it will become compulsory. The enforcement of this compulsion will gradually be implemented over several periods according to the economic and social conditions within the country, following procedures stipulated by the Minister of National Education's decree to be issued later.
Article 3
Basic education will be conducted in government schools, private schools, or those established by organizations. Public schools are funded by communal, provincial, or district budgets. Each commune or group of communes must have at least one basic school with all necessary classes.
Article 4
Private or organizational schools must comply with regulations set by the Ministry of National Education and be under government supervision.
Article 5
The duration of basic education is four years. Each year constitutes one class. The classes are named: first grade, second grade, third grade, fourth grade. Students may not repeat a class for two consecutive years. Special classes will accommodate students with delayed intellectual development.
Article 6
Subjects taught in the basic education curriculum are divided into two parts: one part for instruction and another for nurturing. The instructional part teaches children essential common knowledge to acquire a minimum education, including reading, writing, language learning, grammar, spelling, composition, Vietnamese history, geography, particularly Vietnamese geography, arithmetic and measurement, general science and its application to hygiene, agriculture, and technology, and an overview of vocational subjects (for higher grades).
The nurturing part trains children in good habits and develops their mental and physical talents, aiming to provide them with a comprehensive education. This part includes moral education, civic education, drawing, handicrafts, physical education, singing, games, and guided youth activities. In girls' basic schools, domestic skills (household management and childcare) are also taught. All subjects are taught in Vietnamese.
ARTICLE 7
The detailed curriculum for basic education and the distribution of teaching hours for each subject in each class will be determined by the Minister of National Education's decree.
Article 8
Students applying for admission to basic classes must meet the age limits specified below:
Fourth grade: from 7 to 10 years old Age calculated up to December 31 of the year of application.
Third grade: from 8 to 11 years old
Second grade: from 9 to 12 years old
First grade: from 10 to 13 years old
During the transitional period, the age limit may be extended further as stipulated by the Minister of National Education's decree.
Article 9
Upon completion of the four basic classes, students will take the basic education graduation examination, which will be determined by the Ministry of National Education.
Article 10
Boys' basic classes will be led by male teachers, while girls' basic classes will be supervised by female teachers, except in special cases where female teachers can be employed in preparatory and elementary classes in boys' schools.
Article 11
Male and female teachers in basic schools must be over 18 years old. The principal of a basic school must be at least 21 years old, in addition to meeting the professional requirements set by the Ministry of National Education.
Article 12
The Minister of National Education hereby promulgates this Decree.
