NO. 147/SL OF DECEMBER 26, 1949
ISSUED BY THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
THE PRESIDENT
OF THE DEMOCRATIC REPUBLIC OF VIETNAM
Pursuant to Decree-Law No. 71 dated May 22, 1946 and No. 33 dated March 22, 1946 establishing the rules for the National Army of Vietnam;
Pursuant to Decree-Law No. 254/SL dated November 19, 1948 organizing people's administration during the resistance period;
Pursuant to Decree-Law No. 255/SL dated November 19, 1948 organizing people's administration in areas temporarily occupied or controlled by the enemy;
Considering the current situation;
In accordance with the resolution of the Council of Ministers after consultation with the Standing Committee of the National Assembly;
ISSUES THE FOLLOWING DECREE-LAW
Article 1
During the resistance period, in areas where combat operations are taking place, military commanders at all levels have the authority to issue directives on military matters to resistance administrative bodies and personnel responsible for specialized agencies as follows:
1. Commanders of Divisions or Fronts may issue directives to resistance administrative committees from the provincial level down and to personnel responsible for specialized agencies from the inter-provincial level down.
2. Battalion commanders may issue directives to resistance administrative committees at the district and commune levels, and to personnel responsible for specialized agencies from the provincial level down.
Article 2
Military commanders at battalion level and above have the authority to decide which areas are combat zones.
Article 3
A circular of the Supreme National Defense Council will specify the details for implementing this decree-law.
Article 4
Ministers shall enforce this decree-law accordingly.
