Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Pursuant to Decision No. 65/2007/QĐ-TTg dated May 11, 2007 of the Prime Minister on the issuance of the Operation Regulation of An Giang Border Economic Zone;

Considering the proposal of the Chairman of the People's Committee of An Giang Province at Report No. 37/TTr-UBND dated August 9, 2007 and Report No. 41/TTr-UBND dated September 10, 2007; of the Minister of Home Affairs at Report No. 2542/TTr-BNV dated September 4, 2007; of the Minister of Planning and Investment at Circular No. 7401/BKH-TM&DV dated October 10, 2007,

DECISION:

Article 1. On establishment and position, functions of the Management Board of An Giang Border Economic Zone

1. To establish the Management Board of An Giang Border Economic Zone (hereinafter referred to as the Management Board).

2. The Management Board is a state management agency under the People's Committee of An Giang Province; it has the function of managing investment, construction, and development of An Giang Border Economic Zone according to the Operation Regulation, planning, plan, and progress approved by competent state agencies.

3. The Management Board has legal personality, bank accounts, office premises, and a seal with the National Emblem; it is the focal point for the provincial budget of An Giang. Operating funds of the Management Board and operating funds for public services are provided from the state budget in accordance with the law.

Article 2. Tasks and powers of the Management Board

The Management Board shall perform tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

Article 3. Organizational structure and staffing of the Management Board

1. Organizational Structure:

a) The Management Board shall have a Director appointed and relieved of duty by the Chairman of the People's Committee of An Giang Province; some Deputy Directors and some members appointed and relieved of duty by the Chairman of the People's Committee of An Giang Province upon the recommendation of the Director of the Management Board;

b) The Management Board shall have an administrative support staff including: office, specialized departments;

c) Subordinate units providing public services.

Based on the requirements and tasks of developing An Giang Border Economic Zone in each specific phase, the Director of the Management Board shall submit to the Chairman of the People's Committee of An Giang Province for decision within the scope of authority regarding the organizational structure of the Management Board.

2. Staffing:

a) Staffing of the Management Board includes: Director, specialized Deputy Directors, and staffing of the office, specialized departments;

b) Staffing of the Management Board shall be decided by the Chairman of the People's Committee of An Giang Province in accordance with the law on decentralization in administrative and public service staffing management and the staffing mechanism for public service units of the State.

3. The Director of the Management Board shall submit to the People's Committee of An Giang Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board in accordance with the law.

Article 4. Effective date

This Decision takes effect from the date of issuance.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairman of the People's Committee of An Giang Province, Director of the Management Board of An Giang Border Economic Zone, Heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Decision./.
