CIRCULAR
Amending and supplementing certain provisions of Circular No. 57/2015/TT-BCA dated October 26, 2015 of the Minister of Public Security guiding the provision of fire prevention and firefighting equipment for road motor vehicles
Pursuant to the Law on Fire Prevention and Fighting dated June 29, 2001; the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting dated November 22, 2013;
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 42/2020/NĐ-CP dated April 8, 2020 stipulating the List of Hazardous Goods and the transport of hazardous goods by road motor vehicles and inland waterway transport;
Pursuant to Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing certain articles of the Law on Fire Prevention and Fighting;

The Minister of Public Security issues this Circular amending and supplementing certain provisions of Circular No. 57/2015/TT-BCA dated October 26, 2015 of the Minister of Public Security guiding the provision of fire prevention and firefighting equipment for road motor vehicles.
Article 1. Amending and supplementing certain provisions of Circular No. 57/2015/TT-BCA dated October 26, 2015 of the Minister of Public Security guiding the provision of fire prevention and firefighting equipment for road motor vehicles (hereinafter referred to as Circular No. 57/2015/TT-BCA)
1. Replacing the phrase "automobiles with four seats or more" in Clause 1, Article 1 and Clause 1, Article 4 with the phrase "automobiles with more than nine seats".
2. Replacing the phrase "Decree No. 104/2009/NĐ-CP" in Clause 2, Article 4 with the phrase "Decree No. 42/2020/NĐ-CP".
3. Replacing Appendix I - List and quota of fire prevention and firefighting equipment for road motor vehicles prescribed in Clause 1, Article 6 of Circular No. 57/2015/TT-BCA with Appendix I - List and quota of fire prevention and firefighting equipment for road motor vehicles issued together with this Circular.
4. Replacing Appendix II - List and quota of fire prevention and firefighting equipment for road motor vehicles transporting flammable and explosive dangerous goods prescribed in Clause 2, Article 6 of Circular No. 57/2015/TT-BCA with Appendix II - List and quota of fire prevention and firefighting equipment for road motor vehicles transporting dangerous goods about fire and explosion issued together with this Circular.
5. Amending and supplementing Article 7 as follows:
"Article 7. Inspection of fire prevention and firefighting equipmentFire prevention and firefighting equipment provided for road motor vehicles shall be inspected according to the provisions of Article 38 of Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing some articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing certain articles of the Law on Fire Prevention and Fighting."
Article 2. Effectiveness and responsibility for implementation
1. This Circular takes effect from February 20, 2021.
2. Responsibilities for implementation:
a) The Director of the Fire Prevention and Fighting Traffic Police has the responsibility to guide, inspect, and urge the implementation of this Circular;
b) Traffic police forces within their functions, tasks, powers, and authority have the responsibility to direct, inspect, and handle violations regarding the provision of fire prevention and firefighting equipment for road motor vehicles according to the law;
c) Provincial Police Departments and Municipal Police Departments directly under the Central Government have the responsibility:
To guide, inspect, and report annually at the end of November to the Ministry of Public Security (through the Fire Prevention and Fighting Traffic Police) on the implementation of guidance on the provision of fire prevention and firefighting equipment for road motor vehicles within their management scope;
To compile proposals and recommendations for amending and supplementing the list and quota of fire prevention and firefighting equipment for road motor vehicles within their management scope and report to the Ministry of Public Security (through the Fire Prevention and Fighting Traffic Police);
d) Heads of units under the Ministry, Directors of Provincial Police Departments and Municipal Police Departments directly under the Central Government, and related organizations and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, local police units, agencies, organizations, and individuals related to it should report to the Ministry of Public Security (through the Fire Prevention and Fighting Traffic Police) for timely guidance./.
