PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates certain contents in fire prevention and firefighting work, including: management files, safety rules, evacuation diagrams, prohibition signs, warning signs, guidance signs regarding fire prevention and firefighting; high-risk residential areas for fires and explosions; classification of fire prevention and firefighting management; safety inspections for fire prevention and firefighting; approval and practice of firefighting plans; fire prevention and firefighting database management system and emergency communication; establishment of specialized firefighting teams; content and duration of fire prevention and firefighting knowledge training; fire protection equipment inspection seals.
Article 2. Applicability
This Circular applies to agencies, organizations, households, and individuals operating or residing within the territory of the Socialist Republic of Vietnam.
Article 3. ANNEX
Attached to this Circular is the Appendix containing forms used in fire prevention and firefighting work:
1. Tactical firefighting form (Form No. 01).
2. Certificate of fire prevention and firefighting knowledge training (Form No. 02).
3. Inspection seal for fire protection equipment (Form No. 03).
Chapter II
SPECIFIC PROVISIONS
Article 4Management files, monitoring fire prevention and firefighting activities
1. Management files, monitoring fire prevention and firefighting activities of facilities listed in Appendix III issued together with Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures for implementing the Law on Fire Prevention and Combating and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Combating (hereinafter referred to as Decree No. 136/2020/NĐ-CP), established and kept by the head of the facility, include:
a) Safety rules, guiding documents on fire prevention and firefighting; decisions assigning responsibilities and tasks in fire prevention and firefighting activities of the facility (if applicable);
b) Certificates of design review, design review documents (if applicable); approval documents for fire prevention and firefighting acceptance results for projects listed in Appendix V issued together with Decree No. 136/2020/NĐ-CP;
c) Copy of the floor plan showing traffic routes, water sources for firefighting, functional layout of components, and production lines within the facility that have been approved by competent authorities (if applicable);
d) Decisions establishing fire prevention and firefighting teams at the facility, specialized fire prevention and firefighting teams (if applicable);
đ) Decisions granting certificates of fire prevention and firefighting vocational training or copies of such certificates issued by competent public security authorities;
e) Firefighting plans of the facility approved by competent authorities; plans, reports on organizing firefighting plan drills;;
g) Inspection records on fire prevention and firefighting safety of the competent authority as stipulated in Clause 3 Article 16 of Decree No. 136/2020/NĐ-CP; documents recording self-inspection results on fire prevention and firefighting safety of the facility; semi-annual fire prevention and firefighting safety inspection result reports of the facility head as stipulated in Point b Clause 3 Article 16 of Decree No. 136/2020/NĐ-CP; reports on changes in fire prevention and firefighting safety conditions (if applicable); proposals on fire prevention and firefighting work, violation notices, administrative penalty decisions on fire prevention and firefighting, temporary suspension, cessation, and resumption of operations decisions of competent authorities (if applicable);
h) Fire and explosion incident reports (if applicable); notifications of fire cause investigation conclusions by competent authorities (if applicable);
i) Documents recording results of grounding resistance tests against lightning, pressure testing of systems, equipment, and pipelines as required (if applicable);
k) Certificates confirming eligibility to operate fire protection and firefighting services (if applicable);
l) Compulsory fire and explosion insurance certificates for facilities listed in Appendix II issued together with Decree No. 136/2020/NĐ-CP.
2. Management files, monitoring fire prevention and firefighting activities of facilities listed in Appendix IV issued together with Decree No. 136/2020/NĐ-CP include the contents specified in Points a, đ, e, g, h, and k of Clause 1 of this Article.
3. The head of the facility is responsible for organizing updates and supplements to the management files, monitoring fire prevention and firefighting activities.
Article 5Safety rules, evacuation diagrams, prohibition signs, warning signs, guidance signs regarding fire prevention and firefighting
1. Safety rules on fire prevention and firefighting must be appropriate to the nature and characteristics of the facility's activities and include the following basic contents: regulations on managing and using electricity, sources of fire, heat sources, flammable and explosive materials, equipment and tools capable of generating fire and heat; regulations on managing and using fire prevention and firefighting equipment; prohibited acts according to laws on fire prevention and firefighting; actions to take when a fire or explosion occurs.
2. Evacuation diagrams on fire prevention and firefighting must show escape routes, locations of firefighting equipment. Depending on the specific nature and characteristics of the facility's activities, evacuation diagrams on fire prevention and firefighting may be divided into separate diagrams showing one or more of the above contents.
3. Prohibition signs, warning signs, guidance signs regarding fire prevention and firefighting, include:
a) Prohibition signs for fire, smoking, matches, lighters, mobile phones, radio wave transmitting devices, equipment, items, substances that can generate heat, sparks, or fire at places producing, storing, using explosives, gasoline, diesel fuel, liquefied petroleum gas, flammable and explosive chemicals;
b) Warning signs for areas with fire and explosion hazards;
c) Guidance signs for fire prevention and firefighting, including direction signs for escape routes, emergency exits; signs indicating the location of water hydrants, water tanks, water supply points for firefighting.
4. The specifications and models of prohibition signs, warning signs, and guidance signs for fire prevention and firefighting shall be implemented according to the provisions of the Vietnamese Standard TCVN 4879:1989 Fire Prevention - Safety Signs. In cases where it is necessary to clearly define the validity of prohibition signs, warning signs, and guidance signs, supplementary signs must be attached.
5. Safety regulations, guidance diagrams, prohibition signs, warning signs, and guidance signs for fire prevention and firefighting must be disseminated and posted in visible locations so that everyone is aware and comply with them.
Article 6. High-risk residential area for fire and explosion
A high-risk residential area for fire and explosion is a residential area as defined in Clause 1, Article 6 of Decree No. 136/2020/NĐ-CP when it meets one of the following criteria:
1. It has a village industry producing or trading flammable and explosive goods.
2. At least 20% of households live and operate production or trade of flammable and explosive goods and chemicals on the total number of family houses.
3. It has facilities processing, producing, storing crude oil and petroleum products, natural gas, dangerous chemicals regarding fire and explosion; crude oil and petroleum product warehouses, natural gas and dangerous chemical warehouses; retail outlets selling gasoline and diesel fuel.
Article 7. Hierarchical Management of Fire Prevention and Firefighting within the People's Public Security Force
The Director of the Provincial Public Security Department bases on the organizational structure, staffing, territory, and quantity of facilities listed in Appendix III issued together with Decree No. 136/2020/NĐ-CP to decide on hierarchical management of fire prevention and firefighting for the Provincial Public Security Fire Prevention, Firefighting, and Rescue Department to manage special safety requirements for fire prevention and firefighting of motorized vehicles of agencies, organizations with headquarters in the territory and the following types of facilities: provincial-level administrative agency offices and above; technical infrastructure related to fire prevention and firefighting of cities, economic zones, industrial parks, export processing zones, high-tech zones, industrial clusters located across two or more district administrative territories and facilities with fire and explosion risks consistent with fire safety requirements. The management of fire prevention and firefighting of other facilities listed in Appendix III issued together with Decree No. 136/2020/NĐ-CP is carried out by the Public Security Department at the district level.
Article 8. Fire Prevention and Firefighting Safety Inspection
1. The heads of facilities, owners of motorized vehicles with special safety requirements for fire prevention and firefighting, household heads, forest owners as stipulated in Points a and b, Clause 3, Article 16 of Decree No. 136/2020/NĐ-CP based on conditions, actual operations, and fire safety requirements are responsible for organizing regular inspections on fire prevention and firefighting safety within their management scope. The inspection contents are carried out according to the provisions of Clause 2, Article 16 of Decree No. 136/2020/NĐ-CP corresponding to each type of facility.
2. The inspection results must reflect the following basic contents:
a) The scope inspected for fire prevention and firefighting safety;
b) Recording and evaluating conditions not ensuring safety leading to fire and explosion risks (if any), proposing measures to address fire and explosion risks and violations;
c) Other relevant contents (if any).
3. The report on fire prevention and firefighting safety inspection results from the heads of facilities as stipulated in Point b, Clause 3, Article 16 of Decree No. 136/2020/NĐ-CP sent to the directly managing public security agency includes the following basic contents:
a) Results of self-inspection to maintain fire prevention and firefighting safety conditions;
b) Results of implementing requirements and recommendations of competent authorities;
c) Other contents (if any).
Article 9. Authority to Approve Firefighting Plans
1. Authority to Approve Firefighting Plans
a) The Minister of Public Security approves firefighting plans of public security agencies mobilizing forces and equipment from multiple central city provinces;
b) The Chairman of the Provincial People's Committee approves firefighting plans of public security agencies mobilizing forces and equipment from agencies and organizations under their management;
c) The Director of the Provincial Public Security Department approves firefighting plans of public security agencies mobilizing forces and equipment from various public security forces within their management territory;
d) The Chairman of the District People's Committee approves firefighting plans of public security agencies mobilizing forces and equipment from agencies and organizations under their management;
đ) The Head of the Provincial Public Security Fire Prevention, Firefighting, and Rescue Department approves firefighting plans of facilities and firefighting plans of public security agencies for facilities under hierarchical management;
e) The Head of the District Public Security Department approves firefighting plans of facilities and firefighting plans of public security agencies for facilities under hierarchical management;
g) The Chairman of the Commune People's Committee approves firefighting plans for residential areas under their management; heads of facilities listed in Appendix IV issued together with Decree No. 136/2020/NĐ-CP approve firefighting plans for facilities under their management; owners of motorized vehicles with special safety requirements for fire prevention and firefighting approve firefighting plans for facilities under their management.
Within seven working days from the date of receiving complete valid files as stipulated in Clause 4, Article 19 of Decree No. 136/2020/NĐ-CP, those authorized as specified in Points đ, e, and the Chairman of the Commune People's Committee as specified in Point g, Clause 1 of this provision are responsible for reviewing, approving, and retaining one copy of the approved firefighting plan of the facility; if not approved, they must provide a written response stating the reasons.
2. After the fire fighting plan of the Public Security agency has been approved according to regulations, the unit directly responsible for developing the plan shall be responsible for drafting the Fire Fighting Tactical Form according to Model No. 01 prescribed in the Appendix issued together with this Circular and sending copies to the Public Security agencies participating in the plan with forces and equipment.
Article 10. Time limit for practicing fire fighting plans
1. The fire fighting plan of the facility as stipulated in point a, Clause 3, Article 19 of Decree No. 136/2020/NĐ-CP must be organized for practice at least once a year and practiced on an ad hoc basis when there is a requirement to ensure fire safety for special political, economic, cultural, and social events held locally. Each time a fire fighting plan is practiced, it may involve one or more different scenarios, but all scenarios in the plan must be organized for practice sequentially.
2. The fire fighting plan of the Public Security agency as stipulated in points b and c, Clause 3, Article 19 of Decree No. 136/2020/NĐ-CP shall be organized for practice upon the request of the authority approving the fire fighting plan. Before organizing the practice of the fire fighting plan, the Public Security agency responsible for organizing the practice must notify in writing the Chairman of the People's Committee of the commune, the head of the facility where the practice will take place at least five working days before the practice date and send requests to mobilize forces and equipment to the relevant agencies, organizations, households, and individuals who are required to participate in the practice at least five working days before the practice date.
Article 11. Fire Prevention, Fire Fighting Database Management System and Incident Reporting Information Transmission System
1. The fire prevention, fire fighting database management system and incident reporting information transmission system includes: Fire prevention and fire fighting database; information infrastructure.
2. The fire prevention and fire fighting database includes: Incident reporting information (fire, accidents; system and fire alarm device malfunction reports), operational status of fire prevention and fire fighting systems and related technical systems at the facility; characteristics of the facility related to fire prevention, fire fighting, and rescue operations; forces, equipment, transportation systems, water sources serving fire prevention, fire fighting, and rescue operations at the facility; inspection and violation handling activities related to fire prevention, fire fighting, and rescue operations; implementation of fire prevention and fire fighting regulations in construction investment; fire fighting plans, rescue plans; fire, explosion, incident, and accident situations at the facility; changes in the facility related to fire prevention, fire fighting, and rescue operations; other information related to fire prevention, fire fighting, and rescue operations at the facility.
3. Information infrastructure includes: Equipment (servers, hardware devices, connection systems) installed at central, provincial, and district-level Public Security agencies; incident reporting information transmission equipment installed at the facility; software for storing and processing fire prevention and fire fighting database information from facilities to Public Security agencies and between Public Security agencies at various levels.
4. Data and Information Transmission: Facility incident reporting information is transmitted through incident reporting information transmission equipment and connection services provided by incident reporting information service providers in accordance with legal provisions. The fire prevention and fire fighting database and incident reporting information must be synchronized with the Public Security agency's management software; security, safety, and confidentiality requirements must be ensured in accordance with regulations.
Article 12. Investment, management, operation of the system for managing fire prevention, firefighting, and emergency notification databases
1. The information infrastructure of the system for managing fire prevention, firefighting, and emergency notification databases shall be invested in accordance with the provisions of the law, ensuring the principles of providing goods and public services, ensuring the rights of individuals and organizations to access and use the infrastructure in compliance with the provisions of the law.
2. Responsibilities of entities required to provide fire prevention, firefighting databases and install emergency notification equipment:
a) Assign personnel responsible for updating all information on fire prevention, firefighting, and rescue operations at the entity according to the requirements of the police authority; in case of changes from initial information, immediately update the changed information; bear responsibility for the accuracy and timeliness of the information;
b) Select appropriate emergency notification equipment to meet the requirements stipulated in Clause 2, Article 11 of this Circular. Install a minimum of two direct phone numbers to receive messages and calls warning about fires, incidents, and accidents from the system for managing fire prevention, firefighting, and emergency notification databases;
c) Bear responsibility for managing emergency notification equipment in accordance with the information provided to the police authority. Operate, maintain, and service the equipment in accordance with technical procedures and instructions from the service provider and the police authority.
3. Conditions and responsibilities of units providing information infrastructure and emergency notification services within their scope of service provision:
a) Have solutions, technological systems, and equipment serving the management of fire prevention, firefighting databases and emergency notification equipment that meet the requirements specified in technical standards and regulations or the provisions of the Ministry of Public Security;
b) Maintain, develop, and support the management and operation of the system according to the requirements of the police authority throughout the operational period;
c) Have a 24/24-hour online technical support center; have repair, warranty, and replacement forces for equipment;
d) Implement cybersecurity requirements, system and database security for fire prevention, firefighting in accordance with the provisions of the law.
4. The Fire Prevention, Firefighting, and Rescue Police Department organizes the management, exploitation, and operation of the system for managing fire prevention, firefighting, and emergency notification databases; provides detailed guidance on the content, measures, procedures for implementation, and management permissions for the system for managing fire prevention, firefighting, and emergency notification databases to serve national security, public order, and fire prevention, firefighting, and rescue operations; inspect, evaluate, and publicly announce entities providing information infrastructure for the system for managing fire prevention, firefighting, and emergency notification databases that meet the conditions set out in Clause 3 of this Article.
5. Provincial and centrally-administered city police departments organize the implementation and exploitation of the system for managing fire prevention, firefighting, and emergency notification databases in accordance with the provisions and guidance of the Fire Prevention, Firefighting, and Rescue Police Department.
Article 13. Establishment of specialized fire prevention and firefighting teams
The facilities specified in points a, b, c, d, and point đ Clause 3 Article 44 of the Law on Fire Prevention and Fighting, amended and supplemented in Clause 25 Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting, and the following facilities: National-level reserve warehouses; oil storage tanks with a total capacity of 15,000 cubic meters or more; hydropower plants with a capacity of 300 MW or more; thermal power plants with a capacity of 200 MW or more; paper production facilities with an annual capacity of 35,000 tons or more; textile production facilities with an annual capacity of 20 million square meters or more; nitrogen fertilizer production facilities with an annual capacity of 180,000 tons or more; industrial parks, export processing zones, high-tech parks, and industrial clusters with an area of 50 hectares or more must establish specialized fire prevention and firefighting teams.3 or more; hydropower plants with a capacity of 300 MW or more, thermal power plants with a capacity of 200 MW or more; paper production facilities with a capacity of 35,000 tons/year or more; textile production facilities with a capacity of 20 million square meters/year or more; fertilizer production facilities with a capacity of 180,000 tons/year or more; industrial parks, export processing zones, high-tech parks, and industrial clusters with an area of 50 hectares or more must establish specialized fire prevention and firefighting teams.2or more; industrial parks, export processing zones, high-tech parks, and industrial clusters with an area of 50 hectares or more must establish specialized fire prevention and firefighting teams.
Article 14. Content and duration of fire prevention and firefighting knowledge training
1. The content and duration of fire prevention and firefighting knowledge training include:
a) Laws on fire prevention and firefighting; basic knowledge on fire prevention and firefighting; fire prevention and firefighting systems, equipment, and devices. Training duration is 90 hours (equivalent to 12 days);
b) Basic knowledge on design standards and regulations for fire prevention and firefighting; knowledge on fire prevention in construction investment. Training duration is 75 hours (equivalent to 10 days);
c) Technical standards and their application in fire prevention and firefighting work; basic knowledge on inspection procedures and equipment for fire prevention and firefighting devices. Training duration is 30 hours (equivalent to 4 days);
d) In-depth knowledge on the principles, structure, and technical requirements of fire prevention and firefighting systems and equipment. Training duration is 75 hours (equivalent to 10 days);
đ) Knowledge on ensuring fire safety during construction; construction methods and installation of fire prevention and firefighting systems and equipment. Training duration is 45 hours (equivalent to 6 days).
2. The heads and legal representatives of fire prevention and firefighting service business establishments and individuals specified in Clause 6 and Clause 8 Article 41 of Decree No. 136/2020/NĐ-CP shall be trained according to the provisions of point a Clause 1 of this Article.
3. Individuals engaged in fire prevention and firefighting design consulting, review consulting, and supervision consulting shall be trained according to the provisions of points a, b, and point d Clause 1 of this Article.
4. Individuals engaged in fire prevention and firefighting technical inspection and certification consulting shall be trained according to the provisions of points a and point c Clause 1 of this Article.
5. Individuals engaged in fire prevention and firefighting construction command shall be trained according to the provisions of points a and point đ Clause 1 of this Article.
6. Educational institutions specified in point a Clause 3 Article 43 of Decree No. 136/2020/NĐ-CP have the responsibility to develop training program contents suitable for each target group; publicly disclose certificate information on the educational institution's website. Publicly disclosed content includes: Name, date of birth of the individual receiving the certificate, training content, certificate number, date of issuance of the certificate.
7. The content, form, and format of the Fire Prevention and Fighting Knowledge Training Certificate according to Model No. 02 stipulated in the Appendix attached to this Circular.
Article 15Stamp for inspecting fire prevention and firefighting equipment
1. The stamp is affixed to fire prevention and firefighting equipment specified in Appendix VII issued together with Decree No. 136/2020/NĐ-CP that has been inspected and issued a Certificate of Inspection for Fire Prevention and Firefighting Equipment:
a) Stamp model A is used to affix to the following types of equipment: Fire trucks; rescue and evacuation vehicles; aerial ladder fire trucks; pump trucks; fire extinguishing gas supply trucks; fire extinguishing air tank transport and refill trucks; smoke extraction trucks; firefighting boats, ships, and motorboats; fire pumps; containers (tanks, drums, bottles, cans) containing firefighting agents listed in Item 4 of Appendix VII issued together with Decree No. 136/2020/NĐ-CP;
c) Label type C shall be affixed to the following types of equipment: Central alarm panels, various types of smoke detectors, fire alarms, emergency lights, push buttons for alarms; control cabinets for automatic fire suppression systems using gases; horns, sirens, warning lights for releasing fire-extinguishing agents, push buttons for releasing fire-extinguishing agents; evacuation direction signs, emergency lighting;
c) Stamp model C is used to affix to the following types of equipment: Central alarm cabinets, various types of fire detectors, fire alarm bells, fire alarm lights, fire alarm push buttons; automatic fire suppression system control cabinets; warning bells, horns, lights indicating fire suppression agent release, fire suppression agent release push buttons; escape route indicator lights, emergency lighting;
d) Stamp model D is used to affix to the following types of equipment: Alarm valves, overflow valves, zone selection valves, pressure switches, flow switches of fire suppression systems; non-metallic pipes used in fire suppression water supply systems, flexible hoses used for fire nozzles;
e) Label type G shall be affixed to various types of fire-extinguishing agent spray heads.
2. Management, printing, and distribution of inspection labels for fire prevention and firefighting equipment
2. The stamp for inspecting fire prevention and firefighting equipment according to Model No. 03 stipulated in the Appendix attached to this Circular.
3. The Fire Prevention and Firefighting and Rescue Service Department organizes the printing, distribution, and management of stamps for inspecting fire prevention and firefighting equipment.
Chapter III
IMPLEMENTATION
Article 16. Effective date
1. This Circular takes effect from February 20, 2021, and replaces Circulars: Circular No. 66/2014/TT-BCA dated December 16, 2014, issued by the Minister of Public Security detailing certain provisions of Decree No. 79/2014/NĐ-CP dated July 31, 2014, of the Government detailing certain provisions of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting; Circular No. 36/2018/TT-BCA dated December 5, 2018, issued by the Minister of Public Security amending and supplementing certain provisions of Circular No. 66/2014/TT-BCA dated December 16, 2014, issued by the Minister of Public Security detailing certain provisions of Decree No. 79/2014/NĐ-CP dated July 31, 2014, of the Government detailing certain provisions of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting.
2. Within twenty-four months from the date this Circular takes effect, facilities listed in Appendix III issued together with Decree No. 136/2020/NĐ-CP that pose fire and explosion hazards must complete updating the online database on fire prevention and fighting and connecting to transmit emergency information in accordance with the provisions of this Circular. Within thirty-six months from the date this Circular takes effect, the remaining facilities listed in Appendix III (which require automatic fire alarm and extinguishing systems or equipment according to technical standards and regulations) issued together with Decree No. 136/2020/NĐ-CP must complete updating the fire prevention and fighting database and connecting to transmit emergency information in accordance with the provisions of this Circular.
3. The fire prevention and fighting knowledge enhancement certificate of individuals issued by educational institutions with the function of training fire prevention and fighting skills in accordance with point a, Clause 3, Article 47 of Decree No. 79/2014/NĐ-CP dated July 31, 2014 of the Government detailing certain provisions of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting shall still be valid for requesting issuance of the Fire Prevention and Fighting Consulting Practice Certificate and the Certificate of Eligibility for Operating Fire Prevention and Fighting Services in accordance with Decree No. 136/2020/NĐ-CP.
4. The fire prevention and fighting consulting practice certificate of individuals already issued in accordance with Decree No. 79/2014/NĐ-CP dated July 31, 2014 of the Government detailing certain provisions of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting shall be renewed after the expiration period (if any) in accordance with the provisions.
Article 17Responsibility for Implementation
1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall be responsible for directing, inspecting, and urging the implementation of this Circular.
2. Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Chief of Municipal Police under central cities, and related organizations and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, local police units, agencies, organizations, and individuals shall report to the Ministry of Public Security (through the Fire Prevention and Fighting and Rescue Police Bureau) for timely guidance./.
