DECISION
Regarding the functions, tasks, powers, and organizational structure of the Social Insurance Department.

THE MINISTER OF LABOR, INVALIDS AND SOCIAL AFFAIRS
Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to the Decree No. 186/2007/ND-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Upon the proposal of the Director of the Cadre and Civil Servant Organization Department,
DECIDES:
Article 1. The Social Insurance Department is a unit under the Ministry of Labor, Invalids and Social Affairs responsible for assisting the Minister in performing state management functions over social insurance (including mandatory social insurance and voluntary social insurance) throughout the country in accordance with the provisions of the law.
Article 2. The Social Insurance Department has the following tasks:
1. Researching and drafting for the Ministry:
a) Strategies, programs, plans, annual projects, and proposals on social insurance;
b) Draft laws, ordinances, and regulatory legal documents on social insurance;
c) Mechanisms, policies, and laws on:
- Mandatory social insurance including sickness, maternity, work injury, occupational disease, retirement, and survivor benefits;
- Voluntary social insurance including retirement and survivor benefits.
d) Regulations on information and reporting on social insurance.
2. Directing, guiding, and inspecting the implementation of national regulations and those of the Ministry regarding social insurance.
3. Implementing international cooperation as assigned by the Ministry.
4. Conducting scientific research; participating in training and capacity building for civil servants on social insurance as assigned by the Ministry.
5. Summarizing, concluding, and periodically and ad hoc reporting on social insurance.
6. Managing personnel, assets, financial resources, and property in accordance with the law and the delegation of the Ministry.
7. Performing other tasks assigned by the Ministry.
Article 3. The Social Insurance Department shall have a Director and Deputy Directors to assist.
The Director of the Social Insurance Department is responsible for establishing and implementing the working regulations and work relationships within the department; assigning specific tasks to staff based on the allocated establishment to ensure the completion of assigned tasks.
Article 4. This Decision takes effect from the date of signature. Previous regulations of the Ministry that conflict with this Decision are abolished.
Article 5. The Head of the Ministry's General Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Planning and Finance Department, the Director of the Social Insurance Department, and the Heads of related units are responsible for enforcing this Decision./.
