Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 23/2004/NĐ-CP dated January 13, 2004 of the Government on the service life of trucks and passenger cars, and Directive No. 46/CT-TTg dated December 19, 2004 of the Prime Minister on the management of agricultural and cargo vehicles participating in road traffic. Government Decree dated January 13, 2004 stipulating the service life of cargo trucks and passenger cars, and Directive number 46/CT-TTg dated December 19, 2004 of the Prime Minister on the management of agricultural and construction vehicles participating in road traffic.

Considering the proposal of the Minister of Finance (report No. 83/TTr-BTC dated October 19, 2007)),

DECISION:

Article 1. To implement support for replacing outdated agricultural and cargo vehicles in Northern mountainous provinces and Central Highlands with the following contents:

1. Recipients of support policy:

a) Households that are owners of agricultural vehicles prohibited from circulation according to Directive No. 46/CT-TTg dated December 19, 2004 of the Prime Minister on the management of agricultural and cargo vehicles participating in road traffic and Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on urgent measures to control traffic accidents and traffic congestion; owners of trucks exceeding their service life as stipulated in Decree No. 23/2004/NĐ-CP dated January 13, 2004 of the Government on the service life of trucks and passenger cars;

b) Households with the need to purchase new vehicles for production and business purposes.

2. Pilot implementing unit:

TMT Auto Joint Stock Company under Vietnam Automobile Industry Corporation is the pilot unit to carry out vehicle replacement as provided in this Decision.

3. Implementation area:

Initially, from now until the end of 2010, pilot implementation will be carried out in provinces in the Central Highlands and Northern mountainous regions, followed by a summary evaluation report submitted to the Prime Minister for further deployment.

4. Support policy:

a) Households falling within the scope defined in Clause 1 of Article 1 of this Decision shall be supported by the State with VND 9 million per household to purchase one new vehicle from TMT Auto Joint Stock Company;

b) Regarding the method of support:

- Assign TMT Auto Joint Stock Company to provide advance payment to households as specified in Subpoint a of Clause 4 of Article 1 of this Decision after households have purchased the vehicle and completed registration procedures in accordance with the law.

- The State will reimburse TMT Auto Joint Stock Company for the amount it has advanced to support households.

Article 2. Implementation organization:

1. The Ministry of Transport shall take the lead and coordinate with relevant ministries and sectors to guide localities in effectively implementing Directive No. 46/CT-TTg dated December 19, 2004 of the Prime Minister on the management of agricultural and cargo vehicles participating in road traffic and Decree No. 23/2004/NĐ-CP dated January 13, 2004 of the Government on the service life of trucks and passenger cars; at the same time, coordinate with relevant ministries and sectors to instruct TMT Auto Joint Stock Company under Vietnam Automobile Industry Corporation to ensure sufficient supply of trucks meeting safety technical standards, quality criteria, and environmental protection requirements as stipulated to replace outdated agricultural and cargo vehicles.

2. The Ministry of Finance shall guide the documentation and procedures related to support for households and implement the reimbursement of the amount advanced by TMT Auto Joint Stock Company to households as specified in Clause 4 of Article 1 of this Decision.

3. The State Bank of Vietnam shall direct commercial banks and Central Credit Cooperatives to facilitate loans for households wishing to purchase vehicles in accordance with current commercial credit regulations.

4. People's Committees of Northern mountainous provinces and Central Highlands: guide and instruct People's Committees of communes and wards to confirm the legal residence of households wishing to purchase new vehicles for production and business purposes or to replace outdated agricultural and cargo vehicles; instruct competent agencies to supervise the implementation in accordance with this Decision.

Article 3. This Decision takes effect from the date of signature and replaces Decision No. 973/QĐ-TTg dated July 31, 2007 of the Prime Minister on interest rate support for replacing outdated agricultural and cargo vehicles in Northern mountainous provinces and Central Highlands.

Article 4. Ministers of Finance, Transport, Industry and Trade, Science and Technology; Governor of the State Bank of Vietnam, General Directors of commercial banks, Chairmen of People's Committees of relevant provinces are responsible for enforcing this Decision./.
