OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS

GUIDANCE TO SUPPLEMENT CIRCULAR NO. 16/LDTBXH-TT
OF SEPTEMBER 5, 1996 ON THE RECRUITMENT OF LABOR

 

Pursuant to Decree No. 72/CP dated October 31, 1995 of the Government detailing and guiding the implementation of certain Articles of the Labor Code concerning employment, after exchanging opinions with relevant Ministries and the Vietnam General Confederation of Labor, the Ministry of Labor, War Invalids and Social Affairs supplements the recruitment of labor as follows:

1. Supplement Clause 5 to Section II of Circular No. 16/LDTBXH-TT dated September 5, 1996 of the Ministry of Labor, War Invalids and Social Affairs as follows:

"5. The receipt and return of job application files:

a. When receiving job application files from workers, employers must record in a tracking book and issue a receipt to the worker; the receipt must clearly state the date of receipt, the contents of the file, and the recruitment deadline. If the recruitment process has not been organized or the worker has not been selected within the recruitment deadline, the employer must return the job application file to the worker upon request and retrieve the receipt.

b. Job Service Centers, when receiving job application files from workers, must record in a tracking book and issue a receipt to the worker; the receipt must clearly state the date of receipt and the contents of the file. If the Job Service Center has not introduced a job for the worker and the worker requests the return of the job application file, the Job Service Center must return the job application file to the worker and retrieve the receipt."

2. This Circular shall take effect fifteen days from the date of signature.

In the course of implementation, if there are any difficulties, please report them to the Ministry of Labor, War Invalids and Social Affairs for study and resolution.
