CIRCULAR
Guidelines for financial management in implementing the reward system in the Justice Sector

Pursuant to Decree No. 56/1998/NĐ-CP dated July 30, 1998 of the Government stipulating forms, subjects, and criteria for rewards issued by the Government, Ministries, agencies at the level of ministries, government agencies, People's Committees at all levels, detailing the criteria for rewarding Labor Medals; implementing Circular No. 24/1999/BTC-TT dated March 4, 1999 of the Ministry of Finance guiding financial management in implementing the reward system for outstanding achievements in economic and social tasks and national defense;
After consultation with the Ministry of Finance, the Ministry of Justice guides the amount of cash rewards, sources of reward funds, and the use of reward funds, as well as the issuance and settlement of reward expenses in the Justice Sector annually as follows:
I. AMOUNT OF CASH REWARDS
Individuals and groups recognized for achievements in one year or over several consecutive years may only receive one cash reward corresponding to the highest form of recognition.
1. Amount of cash rewards for individuals:
1.1- Excellent worker: 50,000 VND.
1.2- Outstanding soldier at the grassroots level: 100,000 VND.
1.3- Outstanding soldier in the Justice Sector: 200,000 VND.
1.4- Outstanding soldier nationwide: 300,000 VND.
1.5- Certificate of Merit from the Director of the Department of Justice, President of the Provincial People's Court, Rector of Hanoi Law University, Director of the Training Institute for Judicial Positions, Editor-in-Chief of the Legal Newspaper: 50,000 VND.
1.6- Commendation from the Minister of Justice: 100,000 VND.
1.7- Commendation from the Prime Minister: 200,000 VND.
1.8- Third-class Labor Medal: 400,000 VND.
1.9- Second-class Labor Medal: 800,000 VND.
1.10- First-class Labor Medal: 1,000,000 VND.
1.11- Labor Hero: 1,500,000 VND.
2 - Amounts of monetary rewards for groups:
2.1- Excellent working group: 100,000 VND.
2.2- Outstanding working group: 300,000 VND.
2.3- Certificate of Merit from the Director of the Department of Justice, President of the Provincial People's Court, Rector of Hanoi Law University, Director of the Training Institute for Judicial Positions, Editor-in-Chief of the Legal Newspaper: 100,000 VND.
2.4- Commendation from the Minister of Justice: 200,000 VND.
2.5- Commendation from the Prime Minister: 400,000 VND.
2.6- Flag of Excellence of the Justice Sector: 1,500,000 VND.
2.7- Flag of Excellence of the Government: 3,000,000 VND.
2.8- Third-class Labor Medal: 800,000 VND.
2.9- Second-class Labor Medal: 1,600,000 VND.
2.10- First-class Labor Medal: 2,000,000 VND.
2.11- Group recognized as Labor Hero: 3,000,000 VND.
II. SOURCES OF REWARD FUNDS AND USE OF CASH REWARDS
1. Sources of reward funds:
Annually within the budget allocated to the Justice Sector by the Government, the Ministry of Justice will retain 8% of the total salary fund based on the rank and grade of the number of officers and civil servants approved throughout the year (excluding allowances calculated based on salary). The amount set aside for the reward fund of the Justice Sector will be directly managed and settled annually with the Ministry of Finance according to current regulations.
2. Use of cash rewards:
2.1- Cash rewards based on the decision to award honors by the President of the State, the Prime Minister for groups and individuals with outstanding achievements in the Justice Sector.
2.2- Cash rewards based on the decision to award honors by the Minister of Justice.
2.3- Cash rewards based on the decision to award honors by the head of the grassroots unit.
2.4- Regional commendation meetings.
2.5- Costs for printing Certificates of Merit, Commendations, and certificates of honorific titles.
2.6- Costs for purchasing frames for Certificates of Merit and Commendations; purchasing and embroidering flags of excellence for the Justice Sector; making badges for outstanding soldiers in the Justice Sector.
2.7- Costs for writing Commendations, Certificates of Merit, and certificates of honorific titles.
2.8- Other expenses serving the work of commendation and awards...
III. ISSUANCE AND SETTLEMENT OF REWARD EXPENSES
1- Issuance of reward funds:
1.1- Based on the decision to award honors by the President of the State, the Prime Minister, the decision to award honors by the Minister of Justice, and the decision to award honors by the head of the grassroots unit approved by the Minister of Justice, the Ministry of Justice will issue reward funds into Account 104 (cash rewards) according to the limit of funds for grassroots units, specifically as follows:
- Issued into the account of the Provincial People's Court: Rewards for the Provincial People's Court, small groups, and individuals of the Provincial People's Court and Provincial People's Court judges; costs for frames for Certificates of Merit and Commendations; costs for writing Certificates of Merit and certificates of honorific titles according to the decision to award honors by the head of the grassroots unit; costs for regional commendation meetings (if applicable).
- Issued into the account of the Enforcement Office: Rewards for groups and individuals of the Enforcement Office, Enforcement Teams, District People's Courts, and District People's Court judges; other groups and individuals in local judicial organs, auxiliary judicial organs, etc., who have made outstanding contributions in various fields of justice; costs for frames for Certificates of Merit and Commendations; costs for writing Certificates of Merit and certificates of honorific titles according to the decision to award honors by the head of the grassroots unit: costs for regional commendation meetings (if applicable).
- Issued into the account of Hanoi Law University, the Training Institute for Judicial Positions, and the Legal Newspaper: Rewards for small groups and individuals in these units; costs for frames for Certificates of Merit and Commendations; costs for writing Certificates of Merit and certificates of honorific titles according to the decision to award honors by the head of the grassroots unit.
- Issued into the account of the Ministry of Justice Office: Rewards and costs for frames for Commendations for Departments, Bureaus, Institutes, Journals, Inspectors General, and Offices under the Ministry; costs for writing Commendations and certificates of honorific titles according to the decision to award honors by the Minister of Justice; costs for printing Certificates of Merit, Commendations, and certificates of honorific titles; costs for purchasing and embroidering flags of excellence for the Justice Sector, making badges for outstanding soldiers in the Justice Sector, and other expenses serving the work of commendation and awards.
1.2- Units authorized by the Ministry of Justice to organize regional competitive meetings must prepare a conference budget in accordance with Circular No. 03/1998/TT-BTP dated January 11, 1999, issued by the Minister of Justice on the conference expenditure regulations within the Justice sector, and submit it to the Ministry of Justice (Department of Planning and Finance) for review before submitting to the Minister of Justice for approval and advance payment. After the conference, the organizing unit must prepare a final account report along with valid expense vouchers and send them to the Department of Planning and Finance, Ministry of Justice for settlement.
1.3- The Ministry of Justice provides awards in kind: Certificates of Merit, Commendation Awards, Certificates of Honorific Titles, Competition Flags of the Justice Sector, Medals of Outstanding Competitors in the Justice Sector.
2. Settlement and finalization of reward funding sources:
Reward expenditure funds are settled annually like other expenditure items according to the State Budget Law and guiding documents; units must reflect them accurately under the appropriate sections and sub-sections of the current State Budget Manual. If there is any unspent amount during implementation, the Minister of Justice will decide to reallocate it to other expenditure items for units within the Justice Sector.
This Circular takes effect fifteen days from the date of signature. Previous documents issued by the Ministry of Justice that conflict with this Circular are hereby abolished. In case of difficulties during implementation, units are requested to report to the Ministry of Justice for research and resolution./.
