CIRCULAR
Guidelines for conducting export trade of coal to China via small-scale channels.

Implementing the directive of the Prime Minister as stated in Circular No. 2490/VPCP-KTTH dated June 20, 2000, issued by the Government Office;

After reaching consensus with the Ministry of Industry, the General Department of Customs, the State Bank of Vietnam, and the People's Committee of Quang Ninh Province;

The Ministry of Trade provides guidelines for conducting the export trade of coal to China via small-scale channels as follows:

1. Enterprises that are members of the Vietnam Coal Corporation and certain enterprises under the jurisdiction of Quang Ninh Province, holding business licenses for coal, are permitted to export coal to China via small-scale channels, specifically coal types number 10 and below (based on quality certificates provided by the producer). The export price of coal is determined by the enterprise itself, which bears full responsibility for the business outcomes.

The list of enterprises in Quang Ninh Province authorized to export coal is selected and announced by the People's Committee of Quang Ninh Province and communicated to the Ministry of Trade and the General Department of Customs (as per Appendix No. 01 attached).

2. Export ports for coal include sea ports officially recognized as cargo handling ports for import and export goods by competent authorities, as well as other sea ports designated by the People's Committee of Quang Ninh Province within the Mong Cai area, consistent with the pilot policy at the Mong Cai border gate as stipulated in Decision No. 675/QĐ-TTg dated September 18, 1996, Decision No. 103/QĐ-TTg dated June 4, 1998, and Circular No. 545/CP-ĐP1 dated June 2, 2000, issued by the Prime Minister (as per Appendix No. 02 attached).

3. Exported coal may be settled through the following methods:

- Settlement in convertible foreign currency through banks according to international practice.

- Settlement in Vietnamese Dong or Renminbi through banks using payment methods applied by commercial banks.

- Settlement in freely convertible foreign currency in cash if approved by the State Bank.

- Barter settlement (for imported goods subject to conditions, prior approval from the Ministry of Trade must be obtained before signing the barter contract).

4. The People's Committee of Quang Ninh Province is responsible for coordinating and directing enterprises participating in the export of small-scale coal to China in efforts to prevent indiscriminate coal mining, protect the environment, maintain border order and security, as well as other issues related to coal exports as prescribed in this Circular.

5. This Circular shall take effect fifteen days from the date of issuance./.
