On National Defense Education

Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Education Law on December 11, 1998;
To enhance knowledge about national defense, to strengthen and consolidate the people's all-round national defense, meeting the requirements and tasks in the new situation;
At the proposal of the Minister of National Defense,
DECREE:
Chapter I
GENERAL PROVISIONS
Article 1Scope of Application
This Decree stipulates the basic contents of national defense education for high school students, vocational students, and college and university students in public, semi-public, private, and private schools; cadres and leading officials at all levels in administrative agencies, political organizations, and socio-political organizations (referred to as political, administrative, and mass organizations schools); and determines the responsibilities of relevant agencies and organizations; organizational structure and policies for national defense education work.
Article 2. Position and Nature of National Defense Education Work

2. National defense education is a compulsory subject in universities, colleges, vocational high schools, vocational training schools, general secondary schools within the national education system; political schools, administrative schools, and mass organizations.
Article 3. Objectives of National Defense Education
National defense education aims to contribute to the comprehensive development of individuals, fostering moral character, health, and necessary national defense knowledge and military skills for participation in the construction and consolidation of the people's national defense cause.
Article 4. Requirements for National Defense Education
1. National defense education must be reasonable, synchronized, and unified through various forms and contents suitable for each target group.
2. National defense education must be implemented according to the curriculum, textbooks, and teaching plans, ensuring fundamental, comprehensive, practical, and systematic nature, consistent with the educational objectives of each level of education.
Article 5. Principles of National Defense Education
The principles of education by the Party and State must be thoroughly understood and strictly followed; education must have a popular nature, traditional characteristics of the nation, modern military science and technology, combining theoretical education with practical training.
Chapter II
OBJECTS, CONTENTS, TIMES,
METHODS OF NATIONAL DEFENSE EDUCATION
Article 6. Objects and Contents of National Defense Education
1. Secondary school students, vocational high school students, vocational training students, college and university students in public, semi-public, private, and private institutions; the content of national defense education includes basic and necessary knowledge about: military engineering, tactics, civil defense; some understanding of the People's Army and armed forces, military service obligations; the Law on Officers of the Vietnam People's Army; the viewpoints and policies of the Party and State on national defense; the impact of modern scientific and technological achievements in military activities; Vietnamese military art; countering the "peaceful evolution" strategy and violent overthrow plots of hostile forces against the Vietnamese revolution. Specific program contents for each target group shall be issued by the Ministry of National Defense in coordination with the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs.
2. Trainees in political, administrative, and mass organization schools at all levels and part-time training classes organized by ministries, localities. The content of national defense education includes basic knowledge about the Party and State's policies and views on national defense; state management of national defense; the formation and development of Vietnamese military art; security and defense strategies of some countries related to Vietnam's security and defense; countering the "peaceful evolution" strategy and violent overthrow plots of hostile forces against the Vietnamese revolution; military advisory work in ministries, sectors, and localities. Specific contents and programs for each target group shall be regulated uniformly by the Ministry of National Defense in coordination with central political academies, administrative schools, and mass organizations.
3. Leading cadres and civil servants at all levels of the Party and State.
Cadres and civil servants holding key positions at all levels of the Party and State shall be provided with national defense knowledge training at the National Defense Academy or military schools under the military regions or provincial military schools according to the classification for each target group. Specific contents, time, and programs shall be jointly regulated by the Ministry of National Defense and relevant functional agencies of the Party and State to suit the development of political, economic, cultural-social, and national defense-security situations of the country during each period.
4. National defense education for subjects not covered in Article 6, Paragraphs 1, 2, and 3.
a) Junior high school students: National defense education is conducted extracurricularly, integrated into other subjects closely related to national defense activities such as physical education, civic education, history; organizing visits to historical sites, the Military Museum, organizing competitions, sports events...
b) Young people if they meet the conditions of academic level, health, and voluntary participation, can receive vocational national defense education through national defense vocational sports clubs and military technical clubs.
c) For the masses of the people, regular propaganda and national defense education shall be carried out through mass media and organizational activities at the grassroots level.
, Clause 1, Clause 2 Article 7a of this Regulation.. Methods of National Defense Education and Assessment of Learning Outcomes
Implementing the common requirements for methods of national defense education stipulated in Articles 24, 30, 36, and 41 of the Education Law No. 11/1998/QH10 and the specific provisions below:
1. Secondary school students, vocational high school students, and vocational training students shall study the national defense education subject at their schools. The method of implementing the national defense education subject shall be prescribed by the Minister of Education and Training and the Minister of Labor, Invalids, and Social Affairs, in accordance with the specific conditions of the industry and each locality. Students who complete the national defense education content and program as prescribed will be eligible to take the subject examination. Examination results will be recorded in the student transcript and counted towards the average score when graduating.
2. Students of colleges and universities study National Defense Education courses at their institutions or at National Defense Education Centers. The allocation of students to study National Defense Education at these centers shall be regulated by the Minister of Education and Training. Students who complete the curriculum and program of National Defense Education, meet the required examination scores according to regulations, will be issued a certificate of National Defense Education by the training institution.
3. Trainees in political, administrative, and mass organization schools at all levels and part-time training classes organized by ministries, sectors, and localities shall study the national defense education subject at their schools; those who complete the national defense education content and program as prescribed will be eligible to take the subject examination. Examination results will be recorded in the student transcript and counted towards the average score when graduating.
4. Leading cadres and civil servants at all levels of the Party and State as specified in Article 6, Paragraph 3, who complete the national defense education content and program and pass the required examinations will be issued a certificate of completion of the national defense education course by the training institution.
Article 8. Subjects Exempted from Studying the National Defense Education Subject
1. Students with congenital disabilities that limit movement, with certification from district-level hospitals and equivalent facilities, are exempt from practical training sessions.
2. Students who have served in the military as officers are exempt from studying the national defense education subject.
3. Students undergoing training or further education at political, administrative, and mass organizations schools who have previously served in the military as officers with a minimum rank of mid-level and holding a basic training graduation certificate from military academies are exempted from the National Defense Education course.
4. Individuals currently studying but whose health does not meet requirements may be temporarily exempted from the National Defense Education course. When their health returns to normal, they shall continue to study the prescribed curriculum content.
Chapter III
ORGANIZATION AND IMPLEMENTATION OF NATIONAL DEFENSE EDUCATION WORK
Article 9Responsibilities of the Ministry of National Defense
1. Assist the Government in chairing and coordinating with relevant ministries and sectors to submit to the Government for issuance or issue within its authority consolidated documents governing National Defense Education.
2. Chair and coordinate with relevant agencies and organizations to define the content, curriculum, compile textbooks, and materials for National Defense Education suitable for each target group and educational level, meeting the country's development needs and defense work requirements during each period.
3. Direct military regions, academies, schools, agencies, and units under the military to cooperate with educational management and training agencies, political, administrative, and mass organizations' schools at all levels to organize and implement National Defense Education work.
4. Dispatch officers on secondment to the Ministry of Education and Training, some ministries and sectors, provincial Departments of Education and Training in key provinces and cities directly under the Central Government, some central and local political, administrative, and mass organizations' schools to provide advisory support in managing defense work of ministries and sectors and managing and teaching the National Defense Education course.
5. Organize, manage, and direct the establishment of national defense vocational education and military technical sports clubs in accordance with defense mission requirements.
6. Organize the implementation of inspections, reviews, and summaries of the execution of National Defense Education work in ministries, sectors, and localities.
Article 10. Responsibilities of the Ministry of Education and Training
1. Directly lead, manage, and organize the implementation of National Defense Education work at institutions under its jurisdiction.
2. Issue curricula, publish textbooks, teaching materials for National Defense Education upon the request of the Ministry of National Defense; stipulate regulations for the National Defense Education course for subjects within the national education system; manage and issue certificates for the National Defense Education course in educational and training institutions under its management; ensure funding and material infrastructure for the National Defense Education course in such institutions.
3. Chair and coordinate with relevant ministries and agencies to define job titles, staffing for teachers, develop plans for training, utilization, and policies for personnel managing and teaching National Defense Education at ministry agencies, provincial Departments of Education and Training, and schools under its management.
4. Coordinate with the Ministry of National Defense to manage the team of military officers on secondment engaged in National Defense Education work at units under the ministry.
5. Chair and coordinate with the Ministry of National Defense and related sectors to organize the construction of National Defense Education centers for students nationwide.
6. Chair and coordinate with the Ministry of National Defense and relevant agencies to organize training and further education for personnel managing and teaching National Defense Education.
7. Chair or coordinate with the Ministry of National Defense to organize inspections and reviews of National Defense Education work in schools within the national education system.
Article 11Responsibilities of Other Agencies and Organizations
1. The Government’s Organization and Cadre Department guides and builds organizational systems; staffs cadres managing defense work and National Defense Education teachers at ministries, sectors, and localities; guides the implementation of National Defense Education programs for schools under its management.
2. The Ministry of Labor, Invalids, and Social Affairs issues curricula, publishes textbooks, teaching materials for National Defense Education upon the request of the Ministry of National Defense; stipulates course regulations, arranges National Defense Education teachers, and guides the implementation of policies for personnel and teachers of National Defense Education in vocational schools.
3. The Ho Chi Minh National Political Academy and the National Administrative Academy issue curricula, publish textbooks, teaching materials for National Defense Education upon the request of the Ministry of National Defense; implement and guide affiliated schools under its management and provincial political schools to carry out the content, curriculum, and course regulations of National Defense Education in regular training programs.
4. The Ministry of Planning and Investment coordinates with the Ministry of Education and Training and the Ministry of National Defense in planning investment for building National Defense Education Centers; guides ministries, sectors, and localities to establish investment projects for National Defense Education work according to current regulations on investment and construction management.
5. The Ministry of Finance shall guide, ensure, and inspect the implementation of the state budget plan concerning national defense education work at ministries, sectors, localities, and the National Political Academy, the National Administration Academy.
6. The Vietnam Fatherland Front, the Vietnam Veterans Association, the Vietnam Farmers' Association, the Central Committee of the Ho Chi Minh Communist Youth Union, the Vietnam Women's Union, the Vietnam General Confederation of Labor, and other organizations shall coordinate to direct national defense education for subjects under their management authority.
7. Provincial People's Committees and municipal people's committees directly under the central government shall be responsible for directing and organizing the implementation of national defense education work for subjects under their local management.
Article 12. National Defense Education Council
1. The National Defense Education Council is a cross-sectoral coordinating organization established at the central level, serving as an advisory body assisting the Prime Minister in examining and deciding on directions, programs, plans of activities, and important tasks related to national defense education.
2. The functions, tasks, powers, and organizational structure of the Central National Defense Education Council shall be stipulated by the Prime Minister.
3. The operational regulations of the Central National Defense Education Council shall be issued by the Chairman of the Central National Defense Education Council.
Article 13. Management Organization of National Defense Education Work
1. The Ministry of National Defense shall organize a specialized permanent agency to oversee, manage, and direct national defense education work. Military regions, provincial military command departments, and municipal military command departments directly under the central government shall allocate specialized staff to implement national defense education work.
2. Ministries, ministerial-level agencies, governmental agencies, and localities shall allocate cadres based on the needs of the work and the actual situation of the agencies and localities to undertake national defense education work.
Article 14. Cadres and Teachers of National Defense Education
1. Public secondary schools, vocational schools, and technical schools shall allocate teachers of national defense education within their staffing quota to implement the national defense education program.
2. Lecturers and teachers of national defense education at some universities, colleges, central political schools, administrative schools, mass organizations, and local political schools shall be undertaken by officers seconded from the military combined with lecturers in the official staffing of these schools.
3. Departments of Education and Training shall arrange specialized or concurrently assigned staff within their staffing quota to manage national defense and national defense education work in their sector; some key provinces and cities directly under the central government shall have officers seconded from the military to the Department of Education and Training to handle national defense and national defense education work.
Chapter IV
ENSURING NATIONAL DEFENSE EDUCATION
Article 15. Ensuring Funding for National Defense Education
1. State budget funds allocated for national defense education work shall be included in the annual budget estimates of ministries, ministerial-level agencies, governmental agencies, and central-level mass organizations and localities.
2. Expenditures for national defense education work in educational institutions and departments of education and training, educational and training establishments, ministries, ministerial-level agencies, governmental agencies, and provincial, district, and commune-level localities shall be included in the annual budget estimates for educational and training expenditures.
3. Investment costs for the construction of basic infrastructure for national defense education centers shall be arranged according to approved projects by competent authorities.
4. Costs for enhancing national defense knowledge for leading cadres and civil servants studying at the National Defense Academy and military academies of military regions shall be included in the annual budget estimates of the Ministry of National Defense; costs for enhancing national defense knowledge for leading cadres and civil servants studying at provincial and municipal military academies shall be included in the local budget estimates for national defense affairs.
5. The preparation, execution, and settlement of the state budget for national defense education work shall be carried out in accordance with the provisions of the State Budget Law and guiding documents.
Article 16. Ensuring Material Support for National Defense Education
1. The Ministry of National Defense shall ensure weapons, technical equipment, and specialized military teaching aids for teaching and learning the national defense education subject.
2. The Ministry of Education and Training shall ensure working tools and research materials for national defense education cadres and teachers at establishments under its management.
Article 17Ensuring Benefits and Rights of Lecturers, Teachers, and National Defense Education Managers
Lecturers, teachers, and managers of national defense education as stipulated in Article 14 of this Decree shall enjoy benefits and rights like other subject teachers according to current state regulations; they shall also enjoy preferential treatment according to the special nature of their work. Officers seconded from the military shall enjoy benefits according to the current regulations of the Officer Law of the Vietnam People's Army. Specific benefits shall be guided by the Ministry of Education and Training in coordination with the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Finance, and the Ministry of National Defense.
Chapter V
REWARD AND VIOLATION HANDLING
Article 18. Awards
Organizations and individuals who achieve outstanding results in national defense education work shall be rewarded according to state regulations.
Article 19. Handling Violations
Organizations and individuals who violate national defense education work, depending on the degree and nature of the violation, shall be disciplined, administratively handled, or criminally prosecuted according to the law.
Chapter VI
IMPLEMENTING PROVISIONS
Article 20Effectiveness of the Decree
This Decree shall take effect fifteen days after the date of signature, replacing Government Decree No. 71/CP dated July 13, 1994, on national defense education in political, administrative, and mass organizations' systems. Previous regulations on national defense education that conflict with this Decree are abolished.
Article 21Responsibility for Guiding Implementation of the Decree
The Minister of National Defense shall lead and coordinate with the Minister of Education and Training, the Head of the Government Organizational and Cadre Affairs Board, the Minister of Labor, Invalids, and Social Affairs, and the Minister of Finance to guide the implementation of this Decree.
Article 22. Responsibility for Implementing the Decree
Ministers, heads of ministerial-level agencies, heads of governmental agencies, Chairmen of provincial and municipal people's committees directly under the central government, and relevant agencies shall be responsible for implementing this Decree./.
