Regarding the issuance of the "Provisional Regulations on the Selection of Organizations and Individuals to Lead State-Level Science and Technology Projects for the Period 2001-2005"

Pursuant to the Law on Science and Technology;

Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government stipulating the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

Pursuant to Decision No. 82/2001/QD-TTg dated May 24, 2001 of the Prime Minister approving the orientation, goals, main tasks of science and technology, and the list of key national science and technology programs for the five-year period 2001-2005;

Upon consideration of the proposals of the Director of the Department of Industrial Science and Technology Management, the Director of the Department of Agricultural Science and Technology Management, the Director of the Department of Social Science and Natural Science Management, and the Director of the Planning Department;

DECISION:

Article 1. Issuing the "Provisional Regulations on the Selection of Organizations and Individuals to Lead State-Level Science and Technology Projects for the Period 2001-2005".

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 3. The Directors of the Planning Department, the Department of Industrial Science and Technology Management, the Department of Agricultural Science and Technology Management, the Department of Social Science and Natural Science Management, the Head of the Ministry's Office, Heads of units under the Ministry, and Heads of related agencies are responsible for implementing this Decision.

4. The organizations and individuals proposed for selection are those with the highest ranked application files, but the average score must reach at least 70 out of 100 points, including a minimum average score of 50 out of 70 points for scientific and practical value.

PART I

GENERAL PROVISIONS

The selection of organizations and individuals to lead science and technology projects (hereinafter referred to as the selection of organizations and individuals leading projects) is a process of reviewing and evaluating applications to select organizations and individuals to lead projects according to the requirements set forth in these Regulations.

These Regulations apply to the selection of organizations and individuals leading projects. Science and technology projects include scientific research projects, scientific research and technological development projects within science and technology programs, social science and humanities programs at the state level (collectively referred to as science and technology programs), independent state-level projects, and other state-level science and technology tasks.

The Ministry of Science, Technology, and Environment will announce the selection of organizations and individuals leading projects on the VTV1 program of Vietnam Television, Voice of Vietnam Radio, and the People's Newspaper. Detailed announcements will be published fully in the Science and Development Newspaper, the Vietnam Science and Technology Information Network, the National Science and Technology Information Center (http://www.vista.gov.vn/), and the MOST-NET (http://www.moste.gov.vn/) of the Ministry of Science, Technology, and Environment.

Each individual may not simultaneously lead more than two state-level projects.

Each organization or agency (hereinafter referred to as the organization) may simultaneously lead multiple state-level science and technology projects.

Chapter II

Article 1. CONDITIONS FOR PARTICIPATION IN SELECTION

1\. Organizations with legal personality and functions appropriate to the field of science and technology of the research topic have the right to participate in selecting the leading organization for the topic.

2\. Individuals registering to participate in selecting the leading organization for the topic (to be the head of the topic) must have expertise in the same field of science and technology as the selected research topic.

3. Organizations and individuals shall not participate in the selection if they have not completed the final settlement or repayment of funds recovered from experimental production projects or implementation trial projects within the specified time limit.

Chapter III

Article 2. REGISTRATION FOR SELECTION

The registration dossier for selection (hereinafter referred to as the Dossier) includes the following documents:

1. Application form for leading state-level science and technology projects according to the prescribed format (Form B1-1-ĐONTC);

2. Description of the scientific research and technological development project according to the prescribed format (Form B1-2-TMĐT);

3. Summary of the scientific and technological activities of the organization applying to lead the project (Form B1-3-LLTC);

4. Scientific curriculum vitae of the individual applying to lead the project (Form B1-4-LLCN);

Organizations and individuals participating in the selection must submit a complete application package (one original and fifteen copies) to the Ministry of Science, Technology, and Environment at 39 Tran Hung Dao Street, Hanoi (through the Post Office or directly) within the specified deadline. The application package must be sealed and clearly marked with the following information on the outside:

2\. Full name of the individual applying to be the head of the topic and list of participants in implementing the topic;

2. Name of the individual applying to lead the project and the list of participants in the project;

4\. Name and code of the Science and Technology Program (if it belongs to a program).

4. Name and code of the science and technology program (if applicable);

The Ministry of Science and Technology will take the lead in opening the Dossier. Representatives of the Advisory Council for Selection, relevant agencies, and representatives of organizations and individuals applying for selection will be invited to attend.

Applications must be submitted on time. The date of receipt of the application is considered to be the postmark of the Hanoi Post Office (in case of submission through the Post Office) or the stamp of the Ministry of Science, Technology, and Environment's Reception Office (in case of direct submission).

Before the application deadline, organizations and individuals applying to participate in the selection may withdraw their applications to submit new ones, supplement, or amend their submitted applications. Any supplements or amendments must be submitted within the specified time frame and become part of the application package.

Chapter IV

Article 3. EVALUATION OF DOSSIER

The Ministry of Science, Technology, and Environment will oversee the opening of the application packages. Representatives of the advisory scientific and technological council, relevant agencies, and representatives of organizations and individuals applying to participate in the selection will be invited to attend.

The process of opening the application packages will be recorded in a protocol signed and stamped by the Ministry of Science, Technology, and Environment, the representative of the advisory scientific and technological council, and the representative of the organizations and individuals applying to participate in the selection (if present).

Application packages that meet the conditions stipulated in Articles 5, 6, 7, and 8 of these Regulations will be subject to review and evaluation.

1. The evaluation of applications for participation in the selection will be conducted by a scientific and technological council.

2. The selection evaluation will be based solely on the submitted applications.

4\. The evaluation of dossiers must follow the unified criteria stipulated in Article 11 of this Regulation.

Evaluation of dossiers will be conducted using a scoring method based on the following three groups of criteria:

I\. Scientific value and practical value of the research content, implementation plan, and expected results

(maximum score of 70 points) (maximum score of 60 points)

1. Evaluation of the overall situation of domestic and international research and development trends: demonstrating the necessary understanding of the organization or individual applying to lead the project about the research field (having information about related research works, the latest research results in the research field, clearly stating the author's view on the urgency of the project,...)

2. Determining the research content and methods:

Research content to solve the raised problem (reasonable; new, creative)

Research methods and techniques to be used - compared with similar solution methods (appropriate; new, creative)

Potential for applying research results

3. Potential for applying research results

Feasibility of the transfer plan for research results

Having a feasible plan to link research with training and developing scientific and technological personnel

Having a feasible plan to integrate research with the training and development of scientific and technological personnel

maximum score of 25 points (maximum score of 30 points)

2\. Notable achievements in the research field of the individual applying to be the head of the topic:

Number of works published in specialized journals; number of works granted industrial property rights certificates; other related scientific and technological awards

Number of publications in specialized journals; number of industrial property certificates obtained; related science and technology awards

Number of applied or transferred technologies, scale of application,...

2\. Potential (related to the topic of selecting the organization and individual to lead) of the scientific and technological organization applying to implement the topic

2. Potential (related to the selection of organizations and individuals leading projects) of the scientific and technological organization applying to lead the project

The existing material infrastructure (equipment, workshops, etc.) ensures the implementation of the research topic

Conditions ensuring human resources, workforce, and the structure of staff, professional qualifications, experience, and research achievements of those participating in implementing the project, ...

Existing capacity for international cooperation.

III. Reasonableness of the proposed budget (to be evaluated up to a maximum of ten points)

1. The reasonableness, practicality, and sufficient grounds of the proposed budget, level of detail of the estimate.

2. The ability to mobilize other sources of capital for the implementation of the research topic.

The Ministry of Science, Technology and Environment establishes a State-level Scientific and Technological Council according to specialty (hereinafter referred to as the Council) to advise on the evaluation and selection of organizations and individuals leading the research topic.

The Council consists of nine to fifteen members, including representatives of scientists, reputable technology experts familiar with the research field of the topic, representatives of institutions registering to apply research results, and economists and managers.

The Council is responsible for its advisory work.

The Council assigns two experts deeply knowledgeable about the research field of the topic to provide critical reviews and evaluations of all application files for selecting the organization or individual to lead the implementation of one (01) research topic. In case of necessity, the Council may recommend the Ministry of Science, Technology and Environment to invite experts outside the Council who are deeply knowledgeable about the research field of the topic to provide critical reviews and evaluations of the application files.

The reviewer has the responsibility to study, analyze, and compare all application files for selecting the organization or individual to lead the implementation of one (01) research topic, conduct reviews and evaluations of each file according to the criteria set forth in Article 11 of this Regulation, write a review and evaluation report for each file.

The Council organizes meetings to discuss and evaluate by voting scores.

In case only one (01) application form participates in the selection process for primarily implementing one (01) project, the Council still organizes evaluations according to the standards and procedures stipulated in this Regulation.

The organization or individual recommended for selection is the one whose application file ranks highest, but must have an average score of at least sixty out of one hundred points, of which the score for scientific value and practicality must be at least forty out of sixty points.

The Council ranks the priority order of application files with an average score of sixty out of one hundred points or higher, of which the score for scientific value and practicality must be at least forty out of sixty points, according to the following principles:

Average scores in descending order;

Prioritizing the score for scientific and practical value for application forms with the same average score;

Prioritizing the Chairman's score for application forms with the same average score and the same score for scientific and practical value;

For application files with the same average score, score for scientific value and practicality, and score from the Chairman of the Council, the Council recommends the Ministry of Science, Technology and Environment to consider and decide.

In the case where none of the application files for a research topic reach an average score of sixty out of one hundred points or higher, that topic will not be implemented in the planned year.

The Council discusses and recommends additional or necessary amendments to the contents stated in the research topic description and recommendations regarding the budget for implementing the research topic, or highlights points to note during the completion process of the application files of selected organizations and individuals.

The Council records the evaluation of the applications registered for selection and recommends the winning organizations and individuals.

The working method of the Scientific and Technological Council for selecting organizations and individuals leading State-level research topics from 2001 to 2005 is specified in a separate document.

Chapter V

APPROVAL OF SELECTION RESULTS

Based on the Council's work results, the Ministry of Science, Technology and Environment decides on the selected organizations and individuals.

An individual participating in the selection who is recommended by the Council to win two research topics has the right to request to choose one (01) topic to lead. The request must be submitted in writing to the Ministry of Science, Technology and Environment for consideration and decision.

In the event that the selected individual refuses the chosen topic, the organization or individual with the next highest total average score will replace them, but still must meet the requirement of having at least sixty out of one hundred points, of which the score for scientific value and practicality must be at least forty out of sixty points.

The Ministry of Science, Technology and Environment notifies the selection results to the selected organizations and individuals, to the management ministries of the selected organizations, to the direct management agencies of the selected individuals, and announces on the Science and Development Newspaper, the Vietnam Science and Technology Information Network, the National Science and Technology Information Center (http://www.vista.gov.vn/), and the MOSTE Science and Technology Information Network (http://www.moste.gov.vn/) of the Ministry of Science, Technology and Environment.

After receiving the notification of the selection results, the selected organizations and individuals are responsible for completing the research topic application files according to the Council's recommendations and submitting them to the Ministry of Science, Technology and Environment.

The Ministry of Science, Technology and Environment examines and organizes the assessment of the content and budget for implementing the research topic and decides to approve the leading organization, the topic leader, and the total budget for the entire duration of the research topic.

The approval decision of the Ministry of Science, Technology and Environment serves as the legal basis for signing contracts with the selected organizations and individuals and providing funding for the implementation of the research topic.

Relevant organizations and Council members must adhere to the selection discipline, maintain confidentiality regarding information related to the evaluation process for selecting organizations and individuals to lead projects.

The retention of Application Forms and related documents during the evaluation process is carried out in accordance with current regulations.

Ministries/departments, provinces/cities directly under the Central Government may apply this Regulation to study, build, and promulgate regulations on the selection of organizations and individuals leading research topics within their jurisdiction./.
