Pursuant to Decree No. 54/2003/ND-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/ND-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/ND-CP;
Considering the proposals of the Directors of the Institute of Applied Technology and the Director of the Department of Personnel and Organization;
DECISION:
Article 1. This Decision promulgates the Charter on Organization and Operation of the Institute of Applied Technology under the Ministry of Science and Technology.
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decision No. 38/2001/QD-BKHCNMT dated July 3, 2001 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on Organization and Operation of the Institute of Applied Technology.
Article 3. The Heads of the Office, the Director of the Department of Personnel and Organization, the Director of the Institute of Applied Technology, and the Heads of units concerned are responsible for implementing this Decision.

PART I
FUNCTIONS, TASKS, POWERS
Article 1. The Institute of Applied Technology (hereinafter referred to as the Institute) is a scientific and technological public service unit under the Ministry of Science and Technology (hereinafter referred to as the Ministry), with the function of researching, applying, and transferring high-tech and new technologies in production and daily life in fields such as Lasers, Infrared, Microelectronics, Computing, New Materials, Optoelectronics, and Biotechnology.
The international trade name of the Institute is: National Center for Technological Progress (abbreviated as: NACENTECH)
The Institute has legal personality, may use its own seal, and is entitled to open accounts at the State Treasury and Banks.
Article 2. The Institute has the following main tasks and powers:
1. Researching, applying, and transferring high-tech and new technologies in fields specified in Article 1 of this Charter into production and daily life.
2. Participating in activities related to technical assessment, consultation, and technology evaluation.
3. Participating in research to develop policies encouraging the application of high-tech and new technologies in production and daily life.
4. Participating in research to develop regulations on evaluation, acceptance, application, and publication of results of scientific research and technological development.
5. Training and developing cadres in high-tech and new technology fields relevant to the Institute's and the Ministry's tasks according to the law.
6. Cooperating to implement international cooperation activities in science and technology within the Institute's work directions as assigned by the Ministry and regulated by the State.
7. Participating in advisory activities for planning the development of some high-tech fields.
8. Managing the organization and personnel, finance, assets, and other activities of the Institute according to the Ministry's classification and State regulations.
9. Performing other tasks assigned by the Minister.
Chapter II
ORGANIZATIONAL STRUCTURE
Article 3. The Institute of Applied Technology operates and works under the head system combined with collective discussion.
The Director of the Institute of Applied Technology is responsible to the Minister of Science and Technology for all activities of the Institute.
The Director is assisted by several Deputy Directors. The Deputy Directors assist the Director in general leadership of the Institute's work, are assigned by the Director to be responsible for certain aspects of the Institute's work, and are accountable to the Director for the tasks assigned; they have the authority to decide matters within their assigned responsibilities.
When the Director is absent, a Deputy Director may be authorized to manage and direct the Institute's operations.
Article 4. The organizational structure of the Institute includes the following units:
1. Institute Office;
2. Laser Technology Center;
3. Microelectronics and Computing Technology Center;
4. Optoelectronics Center;
5. Experimental Biotechnology Center;
6. Technology Transfer Center;
7. Vietnam-Korea Technology Cooperation Center;
8. Material Technology Center;
9. Branch of the Institute of Applied Technology in Ho Chi Minh City.
During operation, the Director may propose the Minister to decide on establishing or dissolving units under the Institute as necessary for the Institute's development.
Units under the Institute have their own Charters on Organization and Operation, legal personality, seals, and separate accounts.
Article 5The Charters on Organization and Operation of these units as stipulated in Article 4 of this Charter shall be prescribed by the Director after approval by the Minister.
The establishment, merger, dissolution, and specific functions and tasks of department-level and equivalent organizations under units under the Institute shall be examined and decided by the Director.
Article 6The appointment and removal of heads of units under the Institute shall be proposed by the Director and decided by the Minister after examination.
The appointment and removal of deputy heads of units under the Institute shall be decided by the Director according to the Ministry's cadre management regulation.

The regulations on organization and operation of the Scientific and Technological Council of the Institute shall be decided by the Director.
Chapter III
WORK RELATIONSHIPS
Article 8. The Director manages and directs the Institute's operations according to the Charter on Organization and Operation of the Institute and the Ministry of Science and Technology's regulations.
The Director implements working hours and work relations with the Heads of units directly under the Ministry according to the Ministry's working regulations and other regulations issued by the Minister.
Article 9. Units directly under the Institute operate and work under the head system combined with collective discussion. The Head of each unit manages and directs all activities of the unit according to the prescribed Charter on Organization and Operation; strictly implements the Director's Decisions and Directives; actively coordinates with units within the Institute to resolve related matters to fulfill assigned tasks.
The Head of a unit directly under the Institute is responsible to the Director for all activities of his/her unit.
Deputy Heads of units directly under the Institute assist the Head in directing certain specific aspects of the unit's work and are accountable to the Head for the tasks assigned or delegated.
When the Head of the unit is absent, an authorized Deputy Head manages and directs the activities of the unit, but the Head remains responsible to the Director for the decisions made by the authorized person.
Article 10. In order to promote collective wisdom, when necessary, the Director or the Head of the unit under the Institute may seek broad opinions within the Institute or within the unit on important issues of the Institute or the unit.
Every officer and civil servant in the Institute has the right to contribute their opinions and the right to retain their opinions.
Once decisions of the Institute or units under the Institute have been issued, everyone in the Institute or in the units under the Institute has the obligation and responsibility to implement them.
Chapter IV
IMPLEMENTING PROVISIONS
Article 11. The Director of the Institute of Technology Application and the Department Head of the Cadre and Civil Servant Organization Department are responsible for organizing the implementation of this Charter.
This Charter serves as the basis for managing all activities of the Institute, providing grounds for establishing management regulations and working regulations of the Institute and its subordinate units.
Article 12. Any amendment or supplementation to this Charter shall be proposed by the Director of the Institute of Technology Application in coordination with the Department Head of the Cadre and Civil Servant Organization Department for consideration and decision by the Minister of Science and Technology./.
