Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister, Chairman of the Committee for Ethnic Minority Affairs,

DECISION:

Article 1. Supplementing 16 safe zones (ATK) communes of Thái Nguyên Province and 22 newly established communes from communes under the Socio-Economic Development Program for Particularly Difficult Communes, Ethnic Minority Mountainous Areas, Border Regions, and Remote and Far-Flung Areas (Program 135) to the list of particularly difficult communes under the Program to implement investment support from 2005, including:

1. The ATK communes of Thái Nguyên Province include: communes Trung Lương, Đồng Thịnh, Phú Tiến, Phúc Chu, and Phượng Tiến in Định Hóa District; commune Hợp Thành in Phú Lương District; communes La Bằng, Mỹ Yên, Phú Xuyên, Minh Tiến, Phúc Lương, Đức Lương, Bản Ngoại, Khuôi Kỳ, Hoàng Nông, and Phú Chương in Đại Từ District.

2. Newly established communes supported by central budget investment include:

a) Commune Ealy in Sông Hinh District, Phú Yên Province;

b) Communes Long Bình and Mỹ Bình in Ngã Năm District, Sóc Trăng Province;

c) Commune Sơn Kim 2 in Hương Sơn District; commune Kỳ Trung in Kỳ Anh District, Hà Tĩnh Province;

d) Communes YaTăng in Sa Thầy District; commune Đắk Tơ Lưng in Kon Rẫy District; commune Đắk Kan in Ngọc Hồi District; communes Đắk Long, Đắk Tăng, and Đắk Nên in Kon Plong District, Kon Tum Province;

đ) Commune Đông Hà in Đức Linh District; commune Sông Phan in Hàm Tân District, Bình Thuận Province;

e) Communes Vĩnh Hậu A in Vĩnh Lợi District; commune Vĩnh Lộc A in Hồng Dân District, Bạc Liêu Province;

g) Communes Cư Klông; commune Ea Tân in Krông Năng District, Đắk Lắk Province;

h) Commune Nậm N'Điu in Krông Nô District; commune Đắk Ru in Đắk Râp District, Đắk Nông Province;

i) Commune Bắc Sơn in Móng Cái Town, Quảng Ninh Province;

k) Commune Hướng Việt in Hướng Hóa District, Quảng Trị Province.

3. New commune supported by local budget investment includes commune Thạnh Yên A in An Biên District, Kiên Giang Province.

Article 2. Renaming communes under Program 135 as specified in Decision No. 1232/QĐ-TTg dated December 24, 1999 of the Prime Minister approving the list of particularly difficult communes and border communes within the scope of the Socio-Economic Development Program for Particularly Difficult Communes in mountainous areas and remote and far-flung areas, including: commune Sơn Kim in Hương Sơn District, Hà Tĩnh Province becomes commune Sơn Kim 1; commune Nam Nung in Krông Nô District, Đắk Nông Province becomes commune Nậm Nung.

Article 3. Source of funds and level of investment support funding:

For communes supported by the central budget, the Ministry of Planning and Investment, the Ministry of Finance will allocate funds from the 2005 plan for provinces to organize implementation.

The level of investment support funding for communes shall be implemented according to the current regulations of Program 135.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Ministers of the Ministries of Planning and Investment, Finance, Agriculture and Rural Development, Labor, Invalids and Social Affairs, the Minister, Chairman of the Committee for Ethnic Minority Affairs, and the Chairmen of the People's Committees of Thái Nguyên, Phú Yên, Sóc Trăng, Hà Tĩnh, Kon Tum, Bình Thuận, Bạc Liêu, Đắk Lắk, Đắk Nông, Quảng Ninh, Quảng Trị, and Kiên Giang are responsible for implementing this Decision./.
