DIRECTIVE
On Strengthening Management of Capital, Assets, and Personnel at State Agencies and Units

Recent serious cases of corruption that have been uncovered demonstrate that the management of state capital and assets, as well as the management and utilization of personnel in many ministries, sectors, localities, and units, has been lax, leading to corruption, embezzlement, waste of state capital and assets, causing public discontent and social instability.
The current situation requires the Party and Government to promptly identify causes and implement timely and resolute measures. In this spirit, the Prime Minister requests:
1. Ministries, central agencies, People's Committees at all levels, state economic units and public service units, and organizations (hereinafter referred to as agencies and units) responsible for managing state budget capital, domestic and foreign loans, and personnel management must regularly review policies and mechanisms for managing capital, assets, and personnel, improve weaknesses and deficiencies, and make timely supplements and amendments.
2. Heads of agencies and units using state budget capital, government bonds, and loans must organize self-inspections and reviews of their performance in managing state capital and assets and personnel management to promptly identify weaknesses and issues; take measures or recommend competent authorities to strictly handle (including criminal proceedings) organizations and individuals involved in violations. The head of the agency or unit shall be responsible for the results of self-inspection and subject to disciplinary action if competent authorities later discover issues inconsistent with the conclusions and measures already implemented.
3. For agencies and units where serious acts of corruption and waste have occurred, and where corrupt officials have been discovered by competent authorities and mass media, immediate actions must be taken to assess the damage, analyze the specific direct causes of corruption, and appropriately deal with those who violated the rules. The tasks outlined in points 2 and 3 above must be completed and reported to the Government Inspectorate by July 2006 for consolidation and reporting.
Establish a Working Group
a) To accurately assess losses and impacts; determine subjective and objective causes; clarify methods of embezzling state capital and assets; and analyze why anti-corruption efforts in these agencies and units were ineffective.
b) To propose to the Party and Government the most effective measures to strictly address key causes of violations; and explain to the people and society to gain their understanding and participation in preventing and curbing corruption.
The Office of the Government and the Prime Minister's Research Board shall propose the composition, functions, and responsibilities of the Working Group and submit it to the Prime Minister for decision.
