Guidelines for Implementing Decree No. 25/2006/NĐ-CP dated March 10, 2006 of the Government

Regarding Material Standards for Logistics for Officers, Non-Commissioned Officers, and Soldiers

Serving in the People's Public Security Force

Implementing Decree No. 25/2006/NĐ-CP dated March 10, 2006 of the Government on material standards for logistics for officers, non-commissioned officers, and soldiers serving in the People's Public Security Force (hereinafter referred to as Decree No. 25/2006/NĐ-CP), the Ministry of Public Security, the Ministry of Finance, and the Ministry of Planning and Investment provide specific guidelines on food standards, uniform standards for officers, non-commissioned officers, and soldiers of the People's Public Security Force, sources of budget and progress in implementing certain material standards for logistics as follows:

I. FOOD STANDARDS FOR OFFICERS, NON-COMMISSIONED OFFICERS, AND SOLDIERS OF THE PEOPLE'S PUBLIC SECURITY FORCE

1- The basic food standard for non-commissioned officers and soldiers of the People's Public Security Force at Clause 1 Article 4 Chapter II of Decree No. 25/2006/NĐ-CP is ensured by specific quantitative measures as shown in the table below:

2- Food standards for officers, non-commissioned officers, and soldiers undertaking particularly arduous, dangerous, or heavy and dangerous tasks; when participating in training, combat, readiness duty, exercises, flood and storm prevention, accident and injury prevention, search and rescue operations, and other tasks, specifically as follows:

- Level I: food allowance equal to 3.5 times the basic food standard. Applied to criminal investigation officers in major case teams (special forces); special police.

- Level II: food allowance equal to 2.4 times the basic food standard. Applied to criminal investigation officers (excluding those at Level I); strong mobile police; officers, non-commissioned officers, and soldiers directly engaged in firefighting duties; external line investigators; political security protection police, rural area public security officers, intelligence officers operating in highland and island districts; officers, non-commissioned officers, and soldiers of the ceremonial band; rapid response police (police 113); instructors and teachers of martial arts - special forces; teachers teaching fire-fighting courses during practical training outside the training ground, students of public security schools during martial arts, special forces, and fire-fighting practical training outside the training ground.

- Level III: food allowance equal to 1.3 times the basic food standard. Applied to mobile police (excluding those at Level II); instructors and handlers of service dogs; officers, non-commissioned officers, and soldiers of the honor guard; rural area public security officers in midland and mountain districts; officers, non-commissioned officers, and soldiers engaged in armed patrol, guarding, and protecting targets.

Officers, non-commissioned officers, and soldiers during combat, exercises, flood and storm prevention, accident and injury prevention, and search and rescue operations are provided with supplementary food according to Level I food standards; during martial arts training and readiness duty, they are provided with supplementary food according to Level II food standards.

During implementation, the Minister of Public Security may supplement and adjust the application of food standards for some other tasks to be consistent with the nature of work and combat of the People's Public Security Force after obtaining written agreement from the Ministry of Finance and the Ministry of Planning and Investment.

II. UNIFORM STANDARDS FOR OFFICERS, NON-COMMISSIONED OFFICERS, AND SOLDIERS OF THE PEOPLE'S PUBLIC SECURITY FORCE

1- Ensure sufficient provision of regular uniforms and common uniforms for officers, non-commissioned officers, and soldiers of the Public Security Force suitable for each force, each category, and each region with appropriate usage periods for each force.

2- Ensure sufficient provision of specialized uniforms suitable for the work, combat, training, and professional duties of each force including: disguise uniforms, uniforms for force conversion, additional uniforms, ceremonial uniforms, combat uniforms, training and instruction uniforms, conscript soldier uniforms, professional duty uniforms, labor protection uniforms, HIV prevention uniforms, firefighting uniforms, helmets, tents, folding beds, integrated mosquito nets, and other specialized uniforms. Standards and usage periods are prescribed by the Minister of Public Security.

III. SOURCES OF FUNDS FROM THE STATE BUDGET AND PROGRESS IN IMPLEMENTING MATERIAL STANDARDS FOR LOGISTICS

Based on the provisions of Decree No. 25/2006/NĐ-CP and the guidelines in this Circular, the Ministry of Public Security, the Ministry of Finance, and the Ministry of Planning and Investment have agreed on the requirements and progress in ensuring the State Budget to implement Decree No. 25/2006/NĐ-CP as follows:

1- Recurrent budget:

a- In the state budget estimate for 2008, supplement the budget to ensure the following standards:

- Food standards for officers, non-commissioned officers, and soldiers of the Public Security Force.

- Uniform standards for officers, non-commissioned officers, and soldiers of the Public Security Force including: regular uniforms and common uniforms; disguise uniforms; additional uniforms; combat uniforms; ceremonial uniforms; uniforms equipped according to the special needs of combat, training, and professional duties; medical service uniform standards.

- Medical supplies, bandages, chemicals standards.

- Sanitation miscellaneous expenses standards.

- Medical equipment supply standards: consumable materials, repair and maintenance, standards for professional cloth items.

b- In the two years from 2008 to 2009, supplement and allocate sufficient funds to ensure the following quotas:

- Clean water usage quota for daily life.

- Electricity usage quota for daily life, work, and other tasks.

        c- In the three years from 2008 to 2010, supplement and allocate sufficient funds to ensure annual replacement standards for medical equipment.

        d- In the four years from 2008 to 2011, supplement and allocate sufficient funds to ensure kitchen, kitchenware, and catering equipment standards.

e- From 2008 to 2012, within five years, supplement and allocate sufficient budget to ensure the standard quota for equipment.

2- Investment budget:

a- From 2008 to 2010, within three years, supplement and allocate sufficient budget to ensure the following standards:

- Standard for equipping generator systems for units stationed in areas without national power grid.

- Standard for machinery and equipment to exploit and process water sources in areas without clean water.

b- From 2008 to 2014, within seven years, supplement and allocate sufficient budget to ensure the initial standard for equipping hospitals and public health facilities of the police force.

c- From 2008 to 2015, within eight years, allocate budget to construct sufficient office space, public utility buildings, and other auxiliary facilities according to the standard quota, which may be extended by two to three additional years depending on the state budget's capacity. Focus investment on grassroots police units and frontline combat units.

Based on the standard quota and implementation progress, annual state budget balance capacity, the Ministry of Public Security will prepare the state budget estimate to send to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and submission to the Government for consideration and decision by the National Assembly. For standards and quotas defined by quantity and physical items, they shall be converted into monetary value at the current time, and when market prices fluctuate, the Ministry of Public Security will adjust accordingly and report to the state for timely supplementary budget allocation.

IV. IMPLEMENTATION

1- This Circular takes effect fifteen days from the date of publication in the Official Gazette. All previous regulations contrary to this Circular are hereby abolished.

2- Standards and quotas not specified in this Circular shall be implemented in accordance with Decree No. 25/2006/NĐ-CP.

3- In the course of implementation, if there are any difficulties, units shall promptly reflect them to the Ministry of Public Security for unified resolution with the Ministry of Finance and the Ministry of Planning and Investment.
