Provisions on training facilities, organization of training, examination, issuance, renewal, revocation of driver's licenses for the People's Public Security Forces

Based on Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating the functions, tasks, powers, and structure of the Ministry of Public Security;

The Ministry of Public Security stipulates provisions on training facilities, organization of training, examination, issuance, renewal, and revocation of driver's licenses for the People's Public Security Forces, as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

b) In cases where funds from organizations and individuals within and outside Vietnam are used for victim support work and victim support benefits, such activities shall be carried out in accordance with the regulations of the Ministry of Finance and the donor; in cases where there is no agreement between the donor or their authorized representative and the Ministry of Finance regarding the expenditure level, the expenditure level prescribed in this Circular shall apply.

This Circular stipulates provisions on training facilities, organization of training, examination, issuance, renewal, and revocation of driver's licenses for the People's Public Security Forces.

2.1. Training facilities for driving are established by decision of the Ministry of Public Security or permitted in writing according to regulations.

2.2. The Highway Police Traffic Management Department, Highway Police Traffic Management Office, officers, non-commissioned officers (hereinafter referred to as police officers) perform the task of examining and issuing, renewing, and revoking driver's licenses.

2.3. Police officers, public servants, workers of the People's Public Security Forces with labor contracts of at least twelve months (hereinafter referred to as police officers) shall be registered by the competent authority related to the study, examination for obtaining driver's licenses issued by the Public Security sector.

3. Validity period of the driver's license

3.1. Driver's licenses for motorbikes categories A1, A2, A3 have unlimited validity;

3.2. Driver's licenses for categories A4, B1, B2 have a validity of five years;

3.3. Driver's licenses for categories C, D, E, F have a validity of three years.

II. TRAINING FACILITIES AND ORGANIZATION

Driving training facilities under the Ministry of Public Security have duties, powers, and must meet the following conditions and standards:

1. Duties of driving training facilities

1.1. Organize enrollment, commencement, training, and issuance of vocational certificates.

1.2. At least fifteen days before the commencement of a class, the driving training facility must submit a letter accompanied by a list (Report No. 01) and the teaching plan of the course to the Highway Police Traffic Management Department (at central level) or the Police Traffic Management Office (at local level) to obtain recognition of the class and cooperate in monitoring and managing training, organizing examinations.

1.3. At least fifteen days before the end of the course, the training facility must submit a letter requesting an examination (proposed date and location of the examination) accompanied by a list (Report No. 02) to the Highway Police Traffic Management Department (at central level) or the Police Traffic Management Office (at local level) to obtain a decision on the examination.

1.4. Collect and use tuition fees for driving lessons and examination fees in accordance with regulations.

2. Standards and conditions for instructors

2.1. Instructors teaching Road Traffic Law must be a Bachelor of Law or graduate from the Academy of Public Security or University of Public Security or University of Transport, trained and certified in pedagogy and driving instruction.

2.2. Instructors teaching practical driving must hold a driver's license of category B2 or higher and corresponding to the type of vehicle being taught, holding a certificate of driving instruction, a pedagogical certificate, and having at least three years of actual driving experience (for category B2) and at least five years (for categories C, D, E, F).

3. Classroom, workshop, and school systems

3.1. Classrooms for teaching Road Traffic Law must have an area of at least 50 square meters for each class of 30 to 35 students, equipped with computer equipment, traffic signs, and models arranged to simulate situations when teaching Road Traffic Law.2 3.2. Classroom for vehicle construction: Includes classrooms for engine and electrical system construction and chassis; models, diagrams, and descriptions of the operation principles of engines, electrical systems, and chassis of gasoline and diesel vehicles; main components and assemblies, drive systems, steering systems.

3.3. Classroom for driving techniques must have models, teaching aids, miniature simulators to teach basic driving maneuvers, skills, and experiences on various types of roads, including electronic or high cab simulators for cold shifting practice (maneuvers when the engine is running) and other auxiliary equipment.

3.4. Workshop for maintenance and repair of engines, electrical systems, chassis, with models of detailed parts and assemblies of chassis, engines, electrical systems, fuel supply systems, braking systems, steering systems of gasoline and diesel vehicles; sufficient space and room for trainees, equipped with tools; each group of 5 to 8 students has a set of specialized tools for practical exercises on checking and adjusting engine, chassis, electrical systems, brakes, steering systems...

4. Standards for training and examination vehicles

4.1. Training vehicles:

4.1.1. Must have Vehicle Registration, Certificate of Safety Technical Inspection and Environmental Protection still valid: Driver's License according to the prescribed term and route.

4.1.2. Must be fitted with a "DRIVING PRACTICE" metal sign with blue background and white letters on the front and left rear of the vehicle; size of the front sign: 10cm x 25cm, rear sign: 35cm x 35cm, with an auxiliary brake mechanism, the vehicle must have seats for students to observe, with a roof to protect from rain and sun.

4.1.3. Vehicles must be sufficient and appropriate for the type of training allowed, ensuring that there are at least five students per vehicle for categories A3, A4, B1, B2; eight students for categories C, D, E, and upgraded to category F with trailer.

4.2. Examination vehicles

Vehicles must not exceed fifteen years of service life from the year of manufacture; equipped with automatic scoring devices as prescribed, fitted with a "EXAMINATION VEHICLE" metal sign with red background and white letters; size of the front sign: 10cm x 25cm, rear sign: 35cm x 35cm.

5. Standards for driving practice and examination centers

The field used for driving practice and examination must have sufficient area as prescribed; must have enough simulated driving scenarios for teaching and examining driving of cars and motorcycles as prescribed.

6. Driving training program

6.1. Driving training program for each category (Annex 01 issued together with this Circular).

6.2. For driver's licenses of categories A1, A2, candidates who understand the Road Traffic Law and can drive skillfully do not necessarily need to attend the prescribed driving training course but must register and submit an application for the examination board to register for the examination.

6.2. For category A1, A2 driving licenses, candidates who have knowledge of the Road Traffic Law and have demonstrated proficient driving skills are not necessarily required to attend a training course as prescribed but must register and submit an application for examination to the Examination Board to register for the examination.

6.3. For applicants seeking to take the driving license examination for category B1 without attending concentrated training but must ensure the number of class hours for each subject and the number of kilometers of practical driving as stipulated in the driver training program. During practice driving, there must be an instructor assisting with steering, who is authorized by traffic police authorities to issue a learner's permit.

7. Examination files for driving licenses

7.1. Examination files for issuing a driving license

7.1.1. Application form for taking, changing, or reissuing a driving license, confirmed by the head of the unit where the applicant works (at least at the level of the chief of a police precinct for police officers working in provincial-level public security agencies) or at the level of a department, bureau, institute, or school (for police officers working in agencies under the Ministry of Public Security) (model number 01 issued together with this Circular).

7.1.2. Health certificate (issued by the director of a health center or hospital at the county level or higher, confirming that the applicant is fit to drive the permitted type of vehicle).

7.1.3. Six photographs (size 3x4) taken in the style of a People's Police identification card (for officers, non-commissioned officers, and soldiers of the People's Police; taken in the style of a citizen identity card for public servants and workers of the People's Police and laborers under labor contracts).

7.1.4. Vocational certificate issued according to regulations by the driving school or the People's Police driving training center. For students specializing in traffic police from academies and people's police schools, the director of the Traffic Police Academy or the principal of the people's police school must confirm on the application form for taking, changing, or reissuing a driving license instead of the vocational certificate.

7.2. Examination files for upgrading a driving license

Upgrading a driving license from category B1 to B2; upgrading a driving license from category B2 to C or D; upgrading a driving license from category C to D or E; upgrading a driving license from category D to E; upgrading a driving license from categories B2, C, D, and E to categories of driving licenses for similar vehicles towing trailers and semi-trailers. The files for upgrading include:

7.2.1. Documents specified in points 7.1.1 to 7.1.3 of this Article.

7.2.2. Driving record (first time) and the driving license still valid.

7.2.3. Certificate of driving time and safe driving distance.

7.2.4. Vocational certificate issued by the driving school according to regulations.

7.3. Conditions for upgrading a driving license

7.3.1. For applicants taking the examination to upgrade their driving license from category B1 to B2, B2 to C, C to D, D to E, and corresponding categories F, they must have at least two years of driving experience and 30,000 kilometers of safe driving.

7.3.2. For applicants taking the examination to upgrade their driving license skipping one category (from B2 to D, from C to E), they must have at least three years of driving experience and 50,000 kilometers of safe driving.

For upgrading a driving license from category B1 to B2, the driver declares and is responsible for the driving time and safe driving distance (instead of a confirmation certificate).

III. DRIVING LICENSE EXAMINATION

A. DRIVING LICENSE EXAMINATION CENTERS

1. The examination for issuing automobile driving licenses must be conducted at driving license examination centers.

2. Driving license examination centers must be constructed according to planning, equipped with sufficient facilities and technical infrastructure to meet the requirements of driving license examinations as per industry standard number 22 TCN-286-01 of the Ministry of Transport.

3. Each driving license examination center has its own seal. The organization and operation of the center must comply with the regulations of the Ministry of Public Security and the Highway and Railway Traffic Police Bureau. The operational rules of the driving license training centers of the Highway and Railway Traffic Police Bureau are regulated by the Director of the Highway and Railway Traffic Police Bureau; the driving license training centers of local public security agencies are regulated by the Director of the provincial or centrally-administered city public security agency.

3.1. At the Ministry: The driving license examination center under the Direction Department for Registration and Management of Motor Vehicles of the Highway and Railway Traffic Police Bureau (referred to as Room 4/C26) conducts training and examination for issuing driving licenses to police officers. The center is headed by the Deputy Director of Room 4/C26 as the Director and two Deputy Directors assist.

3.2. At local public security agencies: The driving license examination center under the Traffic Police Department conducts training and examination for issuing driving licenses to local police officers. The center is headed by the Deputy Director of the Traffic Police Department as the Director and two Deputy Directors assist.

B. PRINCIPLES OF THE EXAMINATION

1. Candidates must first take the examination for the Road Traffic Law, achieving the required standard before being allowed to take the practical skills driving examination.

2. Candidates taking the practical skills driving examination must first complete the driving test in a simulated environment, achieving the required standard before continuing with the practical driving test on public roads.

3. Candidates who fail the practical driving test on public roads will not meet the requirements for the practical skills driving examination, but their results from the driving test in a simulated environment will be retained (for up to six months).

4. Candidates who pass the Road Traffic Law examination but fail the practical skills driving examination will retain their results from the Road Traffic Law examination (for up to six months).

5. Candidates who pass both the Road Traffic Law and practical skills driving examinations will be recognized as successful and issued a driving license according to regulations.

6. The interval between the Road Traffic Law examination and the practical skills driving examination shall not exceed seven days.

7. The rescheduling period for retaking a single examination subject must be at least fifteen days from the date of the failed examination.

8. Candidates who fail the Road Traffic Law examination or the practical skills driving examination twice consecutively must wait one month before retaking the examination and must retake both subjects (Road Traffic Law and practical skills driving).

C. EXAMINATION BOARD

1. Duties and powers of the Examination Board

1.1. Reviewing candidates' examination files.

1.2. Deciding to establish the Examination Team.

1.3. Organizing the examination according to regulations.

1.4. Deciding the time and location of the examination.

1.5. Deciding the examination results of candidates.

1.6. Examining and resolving complaints about the examination process made by candidates.

1.7. Decision on disciplinary measures against candidates who violate examination rules.

1.8. Require training institutions and candidates to settle compensation if accidents occur during the examination at the center (if caused by the candidate's fault).

1.9. When performing their duties, members of the Examination Board and examiners must wear a red armband on the left arm (model 02 issued together with this Circular).

2. Composition of the Examination Board

2.1. The motor vehicle driving license examination board of the Highway and Railway Traffic Police Department shall be chaired by the head of the Registration and Management of Motor Vehicles Office, with the principal of the training institution and the director of the examination center serving as members for students from academies. Members also include the heads of public security forces and officers from bureaus and departments under the Ministry.

2.2. The motor vehicle driving license examination board of provincial-level public security organs shall be chaired by the head of the traffic police department to organize examinations for local-managed officers and soldiers. If there is no training institution in the locality and officers and soldiers need to learn to drive, they shall be sent to non-public security training institutions. Upon completion of the course, the training institution will issue a certificate; the examination for issuing the driving license shall be conducted by the provincial public security examination board.

D. EXAMINATION TEAM

1. Responsibilities of the Examination Team

1.1. To disseminate specific regulations on examinations, examination content, methods, and time calculation for the traffic law examination and practical driving skills examination at the examination center and on public roads.

1.2. To control the examination process, take attendance, and inspect candidates participating in the examination, ensuring compliance with examination rules.

1.3. To check examination vehicles and equipment to ensure they meet standards and are safe.

1.4. To evaluate the results of each examination subject.

1.5. To prepare records for candidates who violate examination rules and report them to the Chairman of the Examination Board for decision.

2. Composition of the Examination Team

2.1. The team leader shall be the head of the Registration and Management of Motor Vehicles Office of the Highway and Railway Traffic Police Department (at the central level) or the head of the Traffic Police Department of provincial-level public security organs (at the local level). There shall be one secretary and several examiners appointed by the Examination Board to assist.

2.2. Officers and soldiers performing examination duties (including secretaries) must have attended training courses according to the program provided by the Highway and Railway Traffic Police Department, obtaining an Examiner Card (model number 03 issued together with this Circular); they must also hold a driving license equivalent to the category being examined (except for category B1).

E. CONTENT AND FORM OF MOTOR VEHICLE DRIVING LICENSE EXAMINATIONS

1. Content of the driving license examination: Examination of traffic laws and driving skills (combined tests at the examination center and on public roads).

1.1. Examination of traffic laws: Questions include traffic laws, road signs, and their application on model road scenes. The examination format for each license category is as follows:

1.1.1. For category A1, A2, A3, and A4 licenses, examine 20 questions (10 on traffic laws, 6 on road signs, 4 on model road scenes) within 20 minutes.

1.1.2. For category B1, B2, C, D, E, and F licenses, examine 30 questions (10 on traffic laws, 10 on road signs, 10 on model road scenes) within 30 minutes.

1.1.3. Each question has two to four pre-printed answers, of which only one is correct. Candidates select one answer to respond.

1.2. Practical driving skill examination at the center and on public roads as follows:

1.2.1. Practical driving skill examination at the center

1.2.1.1. For category A1 and A2 licenses, there are four consecutive road shape tests. Test 1: Figure 8; Test 2: Straight line; Test 3: Obstacle course; Test 4: Rough terrain (Annex 02 issued together with this Circular).

1.2.1.2. For category A3 and A4 licenses, there is one continuous road shape test in the form of a Chinese character "chi" (Annex 03 issued together with this Circular).

1.2.1.3. For category B1, B2, C, D, and E licenses, there are ten consecutive road shape tests. Test 1: Start; Test 2: Stop and yield to pedestrians; Test 3: Stop and start on a hill; Test 4: Follow tire tracks and make a right-angle turn; Test 5: Cross an intersection with traffic signals; Test 6: Drive around a winding road; Test 7: Park in a designated spot; Test 8: Temporary stop at a railway crossing; Test 9: Change gears on a flat road; Test 10: End (Annex 04 issued together with this Circular).

1.2.1.4. For category FB2, FC, FD, and FE licenses, there is one continuous road shape test in the form of a Chinese character "chi" (Annex 05 issued together with this Circular).

1.2.2. Practical driving skill examination on public roads takes place on a 2-kilometer stretch with complex traffic conditions, including intersections, wide and narrow sections, and inclines (if there is no incline, a 100-meter flat section with complex traffic can be chosen for gear shifting practice).

2. Examination Format

2.1. Traffic Law Examination (on a computer with installed software)

2.1.1. Based on the list of candidates, the examination team calls candidates one by one to the examination station. Once seated, the team explains the examination procedures on the computer. After understanding, the examiner starts the computer, and the examination time begins.

2.1.2. Upon completion, candidates must not shut down the computer themselves but must sign the examination result record before leaving the examination room. If the examination time ends before completing the test, candidates must still sign the record.

2.1.3. The examination team is responsible for reviewing and collecting examination result records.

2.2. Practical Driving Skill Examination in the Center and on Public Roads

2.2.1. For candidates taking category A1, A2, A3, A4, FB2, FC, FD, and FE licenses, examiners observe and score based on specified criteria.

2.2.2. For candidates taking the driving license examination for categories B1, B2, C, D, and E, the examiner shall record the examination results from the pre-installed computer system.

2.2.3. When conducting examinations on public roads, there must be two examiners seated in the vehicle together, both responsible for safety.

G. MARKING

1. Traffic Law Subject

1.1. The marking must be based on the candidate's answers printed in the examination result sheet from the computer system (Pass/Fail).

1.2. Examination Results:

1.2.1. Answering correctly 16 questions or more meets the requirement for category A1.

1.2.2. Answering correctly 18 questions or more meets the requirement for categories A2, A3, and A4.

1.2.3. Answering correctly 26 questions or more meets the requirement for categories B1 and B2.

1.2.4. Answering correctly 28 questions or more meets the requirement for categories C, D, E, and F.

1.3. The examination result sheet must be signed by two examiners to confirm the examination results.

2. Practical Driving Skill Examination

2.1. Driving test in simulation: For categories A1, A2, A3, A4, B, C, D, E, and F (The maximum total score for the simulation test is 100 points, with a passing score of 80 points or higher). Exceeding the prescribed time limit for practical driving simulation: 25 minutes for categories C and E; 20 minutes for categories B1, B2, and D. Candidates who skip any part of the examination will not meet the requirements.

2.1.1. For category A1 and A2 driving tests in simulation, the method of marking errors and deducting points is specified in Appendix No. 02 issued along with this Circular.

2.1.2. For category A3 and A4 driving tests in simulation, the method of marking errors and deducting points is specified in Appendix No. 03 issued along with this Circular.

2.1.3. For category B1, B2, C, D, and E driving tests in simulation, the method of marking errors and deducting points is specified in Appendix No. 04 issued along with this Circular.

2.1.4. For category FB2, FC, FD, and FE driving tests in simulation, the method of marking errors and deducting points is specified in Appendix No. 05 issued along with this Circular.

2.2. Driving test on public roads

The maximum total score is 20 points, with a passing score of 16 points or higher (For categories A3, A4, B1, B2, C, D, E, and F). The method of marking errors and deducting points is specified in Appendix No. 06 issued along with this Circular.

2.3. After completing the practical driving skill examination in simulation and on public roads, the examiner shall comment, announce the examination results of the candidate, and sign in the examination result sheet.

H. INTERNAL RULES AND DISCIPLINE FOR EXAMINATIONS

1. Internal rules in the traffic law examination room:

1.1. Persons not assigned to organize, control, or examine shall not be present in the examination room.

1.2. Candidates must be present at the examination area at the designated time. If a candidate is absent from the examination room five minutes after roll call, they will be considered absent and their name will be removed from the list of candidates for that examination period.

1.3. In the examination room, candidates must follow the instructions of the Examination Team.

1.4. Candidates may only bring writing instruments into the examination room and may not bring books or any other materials.

1.5. During the examination, if a candidate violates regulations by causing disorder, talking, exchanging information, using books or materials brought in from outside, copying another person's work, or doing someone else's work, they will be recorded in a report, suspended from the examination, and their examination results will be invalidated. Depending on the severity of the violation, further action will be taken according to the regulations.

2. Internal rules in the practical examination area:

2.1. Persons not assigned to organize, control, or examine shall not be present in the examination area.

2.2. Candidates who have not yet reached their turn must gather at the examination area at the designated time. If a candidate is absent five minutes after roll call without prior notice, they will be considered absent and their name will be removed from the list of candidates for that examination period.

2.3. Candidates who have not yet reached their turn must gather in the designated waiting area, and must not cause disorder or enter the examination area. Absolutely forbidden are any forms of signaling or verbally reminding candidates during the examination. During the examination, if a candidate has any questions or complaints about the examination, they can present them to the Examination Team or appeal to the Examination Board; they must not make any statements or actions that disrupt order or hinder the examination.

2.4. Candidates who violate internal rules will be recorded in a report, suspended from the examination, and subject to disciplinary action according to the regulations.

3. Members of the Examination Board and Examination Team who fail to perform their duties properly, lack fairness, show favoritism, or engage in misconduct during the examination will be subject to disciplinary action or criminal liability depending on the severity of the violation.

IV. REGULATIONS ON EXCHANGE, REISSUE, AND REVOCATION OF DRIVING LICENSES

A. EXCHANGE AND REISSUE OF DRIVING LICENSES

Personnel stationed in a locality shall handle the procedures for issuing, exchanging driving licenses according to the regulations, including personnel from General Departments, Bureaus, and Directorates under the Ministry with offices located in that locality (including those from the Ministry's headquarters in Hanoi).

1. Exchange of Driving License

1.1. Driving License

1.2. Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular.

1.3. Original driver's file.

2. Reissue of Driving License that is torn, faded, or damaged.

2.1. Driving License

The driving license remains valid for use. In case of expiration due to special reasons, confirmation from the head of the unit where the holder works is required, but not exceeding three months.

3. In case of loss of the driving license but the original driver's file is still available.

3.1. Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular.

3.2. Original driver's file.

In case of loss of the driving license within its validity period, it will be reissued after thirty days; if expired, a practical driving skills examination must be retaken and passed before a new driving license can be issued.

4. In case of loss of both the driver's file and the driving license, a traffic law examination and a practical driving skills examination must be retaken and passed before a new driving license can be issued. (Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular).

5. In case the original driving license file is lost; if the driving license is still valid, a new driving license file shall be established: Application for examination to obtain or change a driving license (Form 01); Statement explaining the reason for loss, confirmed by the employer; Certificate from the training institution shall be issued a driving license according to regulations. If the original driving license file is lost and the driving license has expired, the applicant must retake the Traffic Law and practical driving skills examinations. (Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular and an expired driving license instead of a certificate).

The issuance of a replacement driving license as stipulated in Points 2 to 5 above must bear a stamp and note "Issued again on the ... day of ... month of ... year" on the application for changing the driving license and in the middle of the back side of the driving license.

B. CHANGE OF DRIVING LICENSE ISSUED BY THE TRANSPORTATION DEPARTMENT OR THE MILITARY

1. Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular.

2. Original driving license file (issued by the transportation department).

3. Valid driving license.

4. Recruitment decision or long-term labor contract of the competent authority (a copy must be confirmed by the head of the unit).

In case police officers self-study driving and obtain a driving license from the transportation department, the file must include a transfer driving license form issued according to the provisions of this Circular.

C. CHANGE OF DRIVING LICENSE ISSUED BY AN AUTHORIZED FOREIGN BODY

1. Documents specified in Points 7.1.1 to 7.1.3 of Part II of this Circular.

2. Valid driving license or driver's license issued by a foreign country.

3. Notarized Vietnamese translation of the foreign driving license or driver's license.

In case newly recruited or hired under a long-term labor contract, an additional recruitment decision or long-term labor contract of the competent authority (a copy must be confirmed by the head of the unit) is required.

D. TRANSFER OF DRIVING LICENSE FILE AND DRIVING LICENSE

Within 60 days from the date of the work transfer decision for police officers, workers, students of the Academy or Police School moving to another locality or police officers with retirement, discharge, resignation decisions, if they wish to continue working as drivers, they must go to the traffic police office managing them to complete the procedures for transferring the driving license (Form 05 issued along with this Circular). Procedures include:

1.1. Driving License

1.2. Driving license file.

1.3. Work transfer, retirement, discharge, resignation decision of the competent authority (a copy confirmed by the head of the unit).

2. The local police office receiving the driving license transfer form will accept the file to change the driving license, with the validity period recorded in the driving license being the same as that of the old driving license. If the validity period is within six months, a health check is required before issuing the driving license according to regulations. For retired, discharged, or resigned police officers, they must go to the transportation department at their place of residence to change the driving license according to regulations.

E. BOOKS AND RECORD CARDS FOR DRIVING LICENSES

1. Driving license issuance book: The Highway and Railway Traffic Police Department (at the Ministry); the Traffic Police Office (at the locality) maintains two types of books for tracking the issuance of automobile and motorcycle driving licenses (Form 06 issued along with this Circular).

2. Record card for drivers (Form 07 issued along with this Circular).

To track the movement and violations of drivers, traffic police must maintain and consolidate records. All selected drivers must establish two record cards according to the model (one retained at the issuing location, one attached to the driver's file transferred to the receiving location for retention). For category A1, A2, only one record card for drivers is established. When upgrading a driving license, a new record card is not issued but the old record card is withdrawn to supplement the upgraded vehicle category (except for record cards for categories A1, A2, A3, A4).

G. REVOCATION OF DRIVING LICENSES

1. In case a driver is subject to an administrative penalty of revoking the driving license indefinitely, the driving license becomes invalid, and it must be reported to the Council for revocation of the driving license according to regulations.

2. In case a driver causes a traffic accident and is criminally punished with the revocation of the driving license or prohibited from engaging in the profession of driving, the driving license must be revoked and reported to the Council for revocation of the driving license according to regulations.

3. In case a driver changes an expired driving license or upgrades it, the traffic police office must revoke the driving license by cutting off the upper right corner of the front face of the driving license and retaining it in the driver's file.

4. Composition of the Council for Revocation of Driving Licenses

4.1. At the Ministry: The Director of the Highway and Railway Traffic Police Department serves as chairman, the Heads of the Force Construction, Logistics Department and the Registration and Management of Motor Vehicles Department of the Highway and Railway Traffic Police Department serve as members.

4.2. At the Provincial Police Departments: The Director of the Provincial Police Department serves as chairman; the Chief Inspector and the Head of the Traffic Police Department serve as members.

After one year from the date the competent authority issues a decision to revoke the driving license, the driver may apply for the examination to obtain a new driving license according to regulations.

V. MANAGEMENT OF FILES, FORMS, AND COMPUTER-BASED DRIVING TEST PROGRAMS

1. The driving license form is managed and issued nationwide by the Ministry of Public Security.

2. The driving license issuance book, driver record card, and other forms are printed by localities according to the prescribed models of this Circular.

3. The driving license issuance book and driver record card are managed according to the file management system of the Ministry of Public Security and directly managed, operated, and preserved by the driving license issuance and change offices according to regulations.

4. The driver's file is managed by the driver themselves; when handling procedures related to driver management, the driver must bring the entire driver's file to the directly managing traffic police office for resolution.

5. Authority to sign documents

5.1. The Director of the Highway and Railway Traffic Police Department shall issue the decision to establish the Examination Board; the Head of the Registration and Management of Motor Vehicles Section within the Highway and Railway Traffic Police Department shall sign the examination score sheet (Form 04 issued together with this Circular), the Driver's License (Form 08 issued together with this Circular), and other documents related to drivers for the drivers.

5.2. The Director of the Local Public Security Organs shall issue the decision to establish the Examination Board; the Head of the Traffic Police Department of the provincial and centrally-administered city public security organs shall sign the examination score sheet (Form 04 issued together with this Circular), the Driver's License (Form 08 issued together with this Circular), and other documents related to drivers for the drivers under their management.

6. Management of the driving examination program on computers

Uniformly use the driver management program, driving examination program, marking system for traffic violations, deduction points for traffic law examination, and practical driving skills examination in traffic law on computer nationwide.

6.1. The Highway and Railway Traffic Police Department shall be responsible for building the driver management program, setting up the traffic law examination questions; conducting practical driving skill tests on automatic scoring devices at the driving examination centers, printing driver's licenses on computers.

6.2. The Provincial Public Security Director shall instruct the Traffic Police Department to accept the program for traffic law examinations, print driver's licenses on computers according to the regulations for installing the computer program.

Information Reporting System

7.1. In the periodic reports every six months and annually, the Traffic Police Departments of the provinces and centrally-administered cities must report on the situation and results of the management of training, examination, and issuance of driver's licenses as prescribed.

7.2. Regarding the driver database:

7.2.1. Every six months, the Traffic Police Departments of the local public security organs must transfer the driver data they manage onto CDs or floppy disks or transmit the report to the Highway and Railway Traffic Police Department.

7.2.2. The Highway and Railway Traffic Police Department shall be responsible for managing the national driver database to serve management requirements and business needs.

IV. IMPLEMENTATION

1. This Circular takes effect from July 1, 2009, and replaces Decision No. 1305/2002/QĐ-BCA(C11-C26) dated December 27, 2002, of the Minister of Public Security regarding the organization of training, examination, and issuance of driver's licenses in the People's Public Security Forces.

2. The Director of the Highway and Railway Traffic Police Department, the Directors of the provincial and centrally-administered city public security organs shall be responsible for inspecting, urging, and organizing the Highway and Railway Traffic Police forces to implement this Circular and other relevant laws correctly.

3. The Director of the National Police Academy shall be responsible for directing, inspecting, and guiding the implementation of this Circular./.
