CIRCULAR

Provisions on the organization of Radio and Television Festivals

Pursuant to the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

Based on Decree No. 51/2002/NĐ-CP dated April 26, 2002 of the Government detailing the implementation of the Press Law, the Law Amending and Supplementing Certain Articles of the Press Law;

Based on Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications,

c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides the organization of radio and television festival activities held in Vietnam, including:

1. National radio and television festivals.

2. Specialized radio and television festivals; regional radio and television festivals.

Article 2. Applicability

1. Radio stations, television stations, radio-television stations operating under the Press Law.

2. News agencies of ministries and sectors producing radio and television programs broadcast regularly on radio stations, television stations, and radio-television stations.

3. Organizations and individuals specified in the Charter and Rules of each Festival.

4. Each radio station, television station, radio-television station, and news agency specified in points a and b, Clause 2, Section I is one participating unit in the national radio and television festival.

Chapter II

PROVISIONS FOR NATIONAL RADIO AND TELEVISION FESTIVALS

Article 3. Name

The official name of the national radio and television festival is "Vietnam Radio and Television Festival".

Article 4. Emblem

The Vietnam Radio and Television Festival uses a unified emblem for all editions of the Festival.

The Ministry of Information and Communications organizes the competition and decides on the emblem of the Festival.

Article 5. Purpose and Significance

1. The Vietnam Radio and Television Festival is an annual professional activity and award ceremony of the Vietnamese radio and television industry and is part of the official state awards system.

2. The Festival is organized to evaluate and commend outstanding radio and television works; recognize the contributions of individuals and groups with radio and television works that have good content and presentation; promote creativity and contribute to building a modern and distinctive Vietnamese cultural life.

3. The Festival also serves as a forum for radio and television stations to exchange and cooperate in producing radio and television programs; for those working in radio and television to strengthen solidarity, exchange experiences; introduce excellent radio and television works and interact with a large audience.

Article 6. Festival Steering Committee

1. The Festival Steering Committee includes the Chairman, Deputy Chairmen in charge of the Festival, Deputy Chairmen, and some members appointed by the Minister of Information and Communications to establish the committee.

The Festival Chairman directly oversees the Festival.

The Festival Steering Committee may use the seal of the Ministry of Information and Communications to facilitate the management of the Festival's operations.

2. The Festival Steering Committee directs the common activities of the Festival through the Organizing Committee and the Judging Board of the Festival.

3. The Festival Steering Committee decides to issue criteria, judging regulations, and themes of the Festival; approves the Charter, organizing plan, and judging plan of the Festival; submits to the Ministry of Information and Communications for approval of the level and form of awards at the Festival.

Article 7. Organizing Committee of the Festival

1. The Organizing Committee of the Festival includes the Chairperson, Deputy Chairpersons, and members appointed by the Chairperson of the Festival Steering Committee upon decision of the Minister of Information and Communications.

2. Develop criteria, themes of the Festival, the Rules of the Festival, and the organizational plan for the Festival to be submitted to the Chairperson of the Festival Steering Committee for approval.

3. Decide on the establishment of specialized sub-committees and secretarial teams to assist with work.

4. Implement the organizational plan for the Festival.

Article 8. Judging Committee of the Festival

1. The Judging Committee of the Festival includes the Chairperson, Deputy Chairpersons, and members appointed by the Chairperson of the Festival Steering Committee upon decision of the Minister of Information and Communications.

2. Develop the Examination Regulations, Examination Plan, and submit them to the Chairperson of the Festival Steering Committee for approval.

3. Organize and implement the examination process.

4. Prepare evaluation reports, classify entries, and propose award levels and forms to be submitted to the Chairperson of the Festival Steering Committee.

Article 9. Time of Organization

1. The Festival is organized annually.

2. The specific time for organizing the Festival each year is decided by the Ministry of Information and Communications.

Article 10. Awards

1. The awards of the Festival are decided and presented by the Ministry of Information and Communications.

2. Awards for radio and television works participating in the competition at the Festival include Gold Medals, Silver Medals, Bronze Medals, and other special awards.

3. Commendations for collectives and individuals who have made significant contributions to the Festival are Certificates of Merit.

Article 11. Rights and Obligations of Collectives and Individuals Receiving Awards

1. Collectives and individuals receiving awards at the Festival shall receive certificates and monetary rewards as prescribed by the State.

2. Strictly prohibited are acts of buying, renting, lending, or giving away awards in physical form, except for displaying them in traditional rooms of units, localities, or sectors where the awardees are members.

3. In cases where violations related to works, organizations, or individuals receiving awards at the Festival are discovered, the Ministry of Information and Communications will consider revoking the awards and applying legal sanctions accordingly.

Article 12. Activities During the Festival

1. Activities for evaluating and announcing competition entries.

2. Professional activities.

3. Trade fairs for exchanging and introducing radio and television programs, showcasing cooperation capabilities in producing radio and television programs, and other related activities.

Encourage free exchange and sharing of competition entries among radio and television stations to enrich domestic radio and television program content.

Article 13. Financial Sources for Organizing the Festival

1. State budget;

2. Contributions from participating units according to the Festival Rules.

3. Sponsorship funds from organizations and individuals.

Chapter III

REGULATIONS FOR SPECIALIZED FESTIVALS IN THE FIELD OF RADIO AND TELEVISION AND REGIONAL RADIO AND TELEVISION FESTIVALS

Article 14. Name

The name of the festival is determined by the festival organizing unit in accordance with the scale and nature of the festival and legal regulations.

The name of this Festival must not be identical to the name of the Vietnam Radio and Television Festival stipulated in Article 3, Chapter II of this Circular.

Article 15. Emblem

Each Festival may use its own emblem according to its nature, characteristics, purpose, and significance. The emblems of these Festivals must not be identical to the emblem of the Vietnam Radio and Television Festival as stipulated in Section 2 of this Circular.

Article 16. Organization of Festivals

1. The organization of Festivals must comply with specialized legal regulations and must obtain the approval of the management agency of the organizing unit and the local state management agency for radio and television where the Festival is organized.

2. Radio stations, television stations, and radio-television stations organizing Festivals shall be responsible for drafting and publicly announcing the rules and procedures for organizing the Festivals.

The rules and procedures for Festivals must clearly specify the purpose of the Festival, the participants and their eligibility criteria, the time and location of the event, activities within the Festival, criteria for awarding prizes, and the forms of recognition for the Festival.

3. The financial source for organizing the Festival shall be determined by the organizing unit based on actual circumstances and the specific content of each Festival.

Article 17. Notification of Festival Organization Plans and Results

Radio stations, television stations, and radio-television stations shall be responsible for notifying the Ministry of Information and Communications of the plans for organizing Festivals as stipulated in Article 16, Chapter III of this Circular at least 30 days before the planned date of the Festival, and reporting the results of the Festival to the Ministry of Information and Communications within 15 days after the end of the Festival.

Chapter IV

IMPLEMENTATION

Article 18. Implementation Organization

1. This Circular takes effect from July 1, 2009.

2. Radio stations, television stations, radio-television stations, relevant organizations, and individuals shall be responsible for implementing this Circular.

3. During the implementation process, the Ministry of Information and Communications will review and adjust the provisions of this Circular as necessary to suit actual conditions./.
