Amending and supplementing some provisions of the regulations on the certification of measurement standards for calibration of measuring instruments issued
together with Decision No. 28/2007/QĐ-BKHCN dated December 25, 2007 of the Minister of Science and Technology

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
On the basis of Resolution No. 67/NQ-CP dated December 24, 2010, issued by the Government regarding the simplification of administrative procedures within the scope of management functions of the Ministry of Science and Technology;
Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,
The Minister of Science and Technology stipulates:
Article 1. Amending and supplementing some provisions of the regulations on the certification of measurement standards for calibration of measuring instruments issued together with Decision No. 28/2007/QĐ-BKHCN dated December 25, 2007 of the Minister of Science and Technology as follows:
1. Unit prices for construction projects published by the People's Committee of the province in accordance with Clause 2, Article 26 of Decree No. 10/2021/NĐ-CP serve as the basis for determining and managing construction investment costs within the province. The unit prices for construction projects published by the People's Committee of the province are determined based on construction norms issued by competent authorities and the cost factors' prices specified in Clause 3, Clause 4, and Clause 5 of this Article, consistent with the time of determining the unit price for construction projects. Cost factors' prices include: material prices, labor unit prices, machinery and equipment rental prices.
"Article 8. Application Documents
1. One (01) set of application documents to be submitted to the General Department. The documents include:
a) An application for certification of measurement standards for calibration according to the form prescribed in Appendix I of Decision No. 28/2007/QĐ-BKHCN;
b) Documents on measurement standards for calibration according to the form prescribed in this regulation's Appendix I;
c) A copy (certified true copy by the entity) of the Certificate of Calibration of Measurement Standards as provided for in Article 10 of Decision No. 28/2007/QĐ-BKHCN.
2. In case of re-certification, at least one (01) month before the Certification Decision expires, the calibration organization shall submit one (01) set of application documents to the General Department. The documents include:
a) An application for certification of measurement standards for calibration according to the form prescribed in Appendix I of Decision No. 28/2007/QĐ-BKHCN;
b) Documents on measurement standards for calibration according to the form prescribed in this regulation's Appendix I (if there are changes in technical characteristics and main measurements compared to the initial certification);
c) A copy (certified true copy by the entity) of the Certificate of Calibration of Measurement Standards as provided for in Article 10 of Decision No. 28/2007/QĐ-BKHCN".
2. Amend Clause 2 of Article 9 as follows:
"Within ten (10) working days from the date of receipt of complete and valid documents, the General Department shall issue a Certification Decision on measurement standards for calibration for the calibration organization".
3. Amend and supplement Article 14 as follows:
"Article 14. Archiving of Calibration Measurement Standard Documents
1. Documents of calibration measurement standards that have been certified (including certification applications, calibration standard documents, and certification decisions) must be stored at the General Department for at least five (05) years after the Certification Decision expires.
2. The entity is responsible for preparing and storing the documents of calibration measurement standards that have been certified at the entity according to the time limit specified in Clause 1 of this Article".
4. Amending and replacing Appendix II issued together with Decision No. 28/2007/QĐ-BKHCN by Appendix I of this Circular.
Article 2. The General Department of Standardization, Metrology and Quality Control is responsible for guiding and organizing the implementation of this Circular.
Article 3.
1. This Circular takes effect from August 20, 2011.
2. The Director of the General Department of Standardization, Metrology and Quality Control, the Head of the Legal Affairs Department, and related organizations and individuals are responsible for implementing this Circular./.
