CIRCULAR
Regulations on organizing physical education and sports activities for students in vocational training institutions

Pursuant to the Vocational Training Law dated November 29, 2006;
Based on the Law on Physical Education and Sports dated November 29, 2006;
Based on Decree No. 106/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Based on Decree No. 70/2009/NĐ-CP dated August 21, 2009 of the Government stipulating responsibilities for state management of vocational training;
Based on Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding implementation of certain provisions of the Law on Physical Education and Sports;
At the proposal of the General Director of the Vocational Training Administration;
The Minister of Labor, Invalids and Social Affairs issues this Circular to regulate organizing physical education and sports activities for students in vocational training institutions,
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular regulates organizing physical education and sports activities for students in vocational training institutions.
Article 2. This Circular applies to organizations and individuals participating in physical education and sports activities for students in vocational training institutions.
Article 2. Objectives of organizing physical education and sports activities for students
Point 1. Physical education and sports activities for students in vocational training institutions aim to develop physical fitness, cultivate moral qualities and personality, contribute to improving academic results and vocational skills for students, and implement comprehensive education policies.
Point 2. Encourage and motivate students to voluntarily participate in physical education and sports training and form habits of regular physical exercise to enhance physical fitness to meet human resource needs during industrialization and modernization.
Point 3. Contribute to preventing social evils and building a healthy living and learning environment for students in vocational training institutions.
Article 3. Principles of organizing physical education and sports activities for students
Point 1. In accordance with the Party's guidelines, state policies and laws; suitable to the specific conditions of vocational training institutions, ministries, sectors, and localities, avoiding waste and formalism.
Point 2. Suitable to students' preferences, gender, age, and health conditions.
Point 3. Implement the policy of socialization, combining state budget resources with other sources to organize and implement physical education and sports activities for students in vocational training institutions.
Chapter II
REGULATIONS ON ORGANIZING PHYSICAL EDUCATION AND SPORTS ACTIVITIES FOR STUDENTS
IN VOCATIONAL TRAINING INSTITUTIONS
Article 4. Content of organizing physical education and sports activities
Point 1. Organize for students to study the compulsory curriculum of physical education subjects as prescribed.
Point 2. Guide students to practice extracurricular physical education and sports, games, and intellectual games according to the conditions of each vocational training institution.
Point 3. Encourage and motivate students to self-practice physical education and sports outside class hours according to their preferences and suitability for individual conditions.
Point 4. Organize exchange sports activities to disseminate knowledge, skills, attitudes, and experiences in physical education and sports training and maintaining health.
Point 5. Organize sports competitions.
Article 5. Forms of Physical Education and Sports Activities
Physical education and sports activities for students are manifested in several forms as follows:
1. Organizing the teaching of physical education curriculum subjects according to class units in vocational training institutions.
2. Organizing extracurricular physical education and sports activities according to the plan of vocational training institutions, departments, and classes.
3. Organizing various physical education and sports competitions or tournaments at different scales and levels (hereinafter referred to collectively as Sports Festival).
4. Encouraging the establishment of physical education and sports clubs or centers within vocational training institutions to create favorable conditions for students to participate in training and competition.
Article 6. Sports Festival
1. The institutional-level Sports Festival is organized annually by vocational training institutions to maintain physical education and sports activities within these institutions; selecting individuals and teams to participate in provincial-level Sports Festivals.
2. Provincial-level Sports Festivals (hereinafter referred to as Provincial Sports Festivals) are organized every two years by the Department of Labor, Invalids, and Social Affairs for students from vocational training institutions located within the province to select individual and team participants for the National Sports Festival.
3. The National Sports Festival is organized every three years by the General Department of Vocational Training. Individuals and teams that have participated in provincial Sports Festivals held between two consecutive National Sports Festivals and achieved high results (First, Second, Third prizes, and Honorable Mentions) are eligible to participate in the National Sports Festival.
4. Non-periodic Sports Festivals organized according to the provisions of Clause 1, 2, and 3 of this Article are initiated and organized by the management agencies of vocational training institutions at all levels or political organizations, political-social organizations, social organizations, and occupational-social organizations for students in vocational training institutions to implement specific political requirements at certain times.
Article 7. Requirements for Organizing Sports Festivals
1. Ensuring that the Sports Festival is a healthy sporting activity consistent with national customs and traditions, promoting the spirit of fair play and nobility.
2. Ceremonies must be conducted solemnly, appropriate to the scale of the event, ensuring economy.
3. Ensuring necessary material conditions and equipment according to the professional requirements of the event.
4. Ensuring security, safety, fire prevention, and environmental hygiene during the event period.
5. Ensuring fairness, accuracy, and objectivity in directing and managing the competition.
6. Not organizing or participating in illegal gambling.
Article 8. Preparations for Sports Festivals
1. Establishing the Organizing Committee and the Arbitration Council to manage and carry out the tasks and responsibilities of the Sports Festival; the Organizing Committee decides on the establishment of sub-committees (teams) assisting the Sports Festival.
2. Developing the Sports Festival Plan including: objectives, contents of work to be done, and procedures for implementation (preparation work such as material conditions, personnel, awards, funds, and other necessary conditions, opening and closing ceremonies, schedules for events and other activities of the Sports Festival), and organizing its implementation.
3. Issuing the Regulations of the Sports Festival.
4. Soliciting sponsorships (if necessary).
Article 9. Construction and issuance of the Sports Meeting Charter
1. The Sports Meeting organizing committee shall construct and issue the Sports Meeting Charter.
2. The basic contents of the Sports Meeting Charter include:
a) Name of the Sports Meeting;
b) Objectives and requirements;
c) Time and location of the Sports Meeting;
d) Participants and conditions for participation in the Sports Meeting;
đ) Content, format, and method of calculating competition results;
e) Application of competition rules;
g) Regulations on rewards, disciplinary actions, and handling complaints;
h) Regulations on registration files and procedures;
i) Budget;
k) Other provisions (if any);
l) Implementation clauses.
3. Based on the scale of the grassroots-level Sports Meeting, the head of the Sports Meeting organizing committee decides to seek opinions from the state management agency responsible for physical culture and sports at the appropriate level before issuing the Charter.
4. The provincial-level Sports Meeting Charter must obtain opinions from the provincial-level state management agency responsible for sports; the national-level Sports Meeting Charter must obtain opinions from the Ministry of Culture, Sports and Tourism before issuance.
5. The provincial-level and national-level Sports Meeting Charters must be issued at least one month prior to the opening of the Sports Meeting; the grassroots-level and other Sports Meeting Charters must be issued at least twenty days prior to the opening of the Sports Meeting. The Charters of all Sports Meetings must be publicly announced.
6. Other Sports Meetings: Based on the scale and level of the Sports Meeting, the head of the Sports Meeting organizing committee decides to seek opinions from the state management agency responsible for physical culture and sports at the appropriate level regarding the Sports Meeting Charter before issuance.
Article 10. Opening and Closing Ceremonies of the Sports Meeting
1. The opening and closing ceremonies shall be organized solemnly; flags, banners, and slogans displayed during the ceremonies and at competition venues may include the national flag, appropriate banners and slogans related to the Sports Meeting, logos of the Sports Meeting, and names of organizing and sponsoring units (if any).
2. Contents of the opening ceremony of the Sports Meeting:
a) Marching or gathering in place depending on the scale and nature of the Sports Meeting;
b) The ceremonial part, led by the organizing committee, includes: Flag-raising (national anthem singing); declaration of purpose, introduction of delegates, opening speech, athlete's oath, referee's oath, announcement of the Sports Meeting program, presentation of commemorative flags and flowers to delegations (if any);
c) The welcoming activities, which depend on the conditions of the organizing unit, may include mass gymnastics performances, cultural performances, sports demonstrations, martial arts displays.
3. Contents of the closing ceremony of the Sports Meeting include summarizing work, rewarding collectives and individuals in a manner that honors their achievements, is practical, and effective, suitable to the nature and scale of the Sports Meeting.
Article 11. Budget for Organizing Physical Culture and Sports Activities
1. The budget for organizing physical culture and sports activities, training, and competitions shall be implemented according to the provisions of Decision No. 32/2011/QĐ-TTg dated June 6, 2011, of the Prime Minister on certain regulations for sports coaches and athletes who are centrally trained and compete; Circular Joint No. 200/2011/TTLT-BTC-BVHTTDL dated December 30, 2011, of the Ministry of Finance and the Ministry of Culture, Sports and Tourism on financial expenditure regulations for sports competitions.
2. The budget for organizing physical culture and sports activities shall be ensured from the following sources:
a) State budget; National-level physical culture and sports activities are funded by the Ministry of Labor, Invalids and Social Affairs according to approved budgets;
b) Donations and support from organizations and individuals both domestically and internationally as stipulated by law;
c) Other legitimate revenue sources of vocational training institutions, voluntary contributions from members of sports associations, sports clubs, and participants in physical culture and sports activities.
3. Management and use of the budget for organizing physical culture and sports activities for students shall be carried out according to current financial regulations.
Chapter III
REGULATIONS ON REPORTING, REWARDING, AND HANDLING VIOLATIONS
Article 12. Reporting System for Physical Education and Sports Activities
1. Annually, vocational training institutions shall report on the organization of physical education and sports activities for students to the Department of Labor, Invalids and Social Affairs and their supervising authorities before November 15.
2. The Department of Labor, Invalids and Social Affairs shall compile and evaluate the implementation status of vocational training institutions within its jurisdiction, reporting to the People's Committee of the province and the Ministry of Labor, Invalids and Social Affairs before November 30.
3. In addition to the regular reports mentioned above, the Department of Labor, Invalids and Social Affairs and vocational training institutions shall be responsible for submitting ad hoc reports on the organization of physical education and sports activities for students to serve management work according to the requirements of competent authorities at all levels.
4. The content, format, and form of reports on organizing physical education and sports activities shall follow the guidelines of the Vocational Training General Department.
Article 13. Rewards and Sanctions for Violations in Physical Education and Sports Activities
1. Based on the results of participation in physical education and sports activities for students, the heads of vocational training institutions and state administrative agencies shall promptly reward collectives and individuals who achieve outstanding results in sports meetings or contribute effectively to organizing such activities.
2. The head of the vocational training institution shall decide to grant bonus points in evaluating the performance of students who win awards at sports meetings.
3. Organizations and individuals violating regulations will be subject to disciplinary actions according to current provisions depending on the severity of the violation.
Chapter IV
IMPLEMENTING PROVISIONS
Article 14. Responsibilities of the Vocational Training General Department
1. Inspect the organization of physical education and sports activities for students.
2. Develop and submit to the Minister of Labor, Invalids and Social Affairs for approval plans to organize national sports meetings.
3. Take the lead and coordinate with relevant ministries, sectors, and provincial people's committees where the national sports meetings are held to implement the approved sports meeting plan.
4. Establish the Organizing Committee and Arbitration Board for the national sports meetings.
5. Organize fundraising and mobilize other legitimate financial resources to organize the national sports meetings.
6. Annually, develop plans and organize training courses to update professional knowledge and skills in managing and organizing physical education and sports activities for staff working with students and specialized lecturers and teachers in vocational training institutions.
Article 15. Responsibilities of the Department of Labor, Invalids and Social Affairs
1. Advise the provincial people's committee on directing, guiding, and inspecting the implementation of physical education and sports activities in vocational training institutions within its jurisdiction; regularly organize mid-term and final reviews of these activities.
2. Advise the provincial people's committee to allocate funds for organizing provincial sports meetings and encourage units and individuals participating in national sports meetings.
3. Proactively coordinate with the Department of Culture, Sports and Tourism and related organizations in the locality in implementing this Circular.
4. Develop and submit to the Chairman of the provincial people's committee for approval plans to organize provincial sports meetings.
5. Establish the Organizing Committee and Arbitration Board for the provincial sports meetings.
6. Lead and coordinate with relevant departments and units to implement the approved provincial sports meeting plan.
7. Form and organize teams to participate in national sports meetings.
8. Perform other tasks as required.
Article 16. Responsibilities of Vocational Training Institutions
1. Annually, develop plans to organize physical education and sports activities for students and institutional sports meetings that are appropriate, practical, and effective; allocate reasonable funds to organize physical education and sports activities for students; conduct self-inspection and evaluation of the implementation results of the unit.
2. Closely cooperate with local sports management agencies, associations, and organizations within vocational training institutions to mobilize and encourage students to actively participate in physical education and sports activities.
3. Create favorable conditions for students to participate in physical education and sports activities and various levels of sports meetings.
4. Establish and organize teams to participate in provincial sports meetings and national sports meetings.
5. Strengthen material and equipment infrastructure to serve physical education and sports activities of the unit.
6. Perform other tasks as required.
7. Approve annual plans to organize physical education and sports activities for students at vocational training institutions.
8. Approve plans to organize institutional sports meetings.
9. Decide on the establishment of the Organizing Committee and Arbitration Council for institutional sports meetings.
10. Be responsible for organizing physical education and sports activities for students within the unit.
Article 17. Staff Members Involved in Student Affairs, Physical Education, and National Defense Education
Propose and directly participate in organizing physical education and sports activities for students; propose and organize the selection and training of students to become athletes participating in provincial and national sports meetings.
Article 18. Effective Date
1. This Circular takes effect from October 12, 2013.
2. In case of difficulties during implementation, please promptly report to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution.
