CIRCULAR
Regulations on purchasing and selling reactive power capacity

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Based on the Electricity Law dated December 3, 2004, and the Law Amending and Supplementing Certain Provisions of the Electricity Law dated November 20, 2012;
Based on Decree No. 137/2013/NĐ-CP dated October 21, 2013, issued by the Government, detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law;
At the proposal of the Director of the Electricity Regulatory Authority,
The Minister of Industry and Trade issues this Circular to regulate the purchasing and selling of reactive power capacity.
Article 1. Scope of Regulation and Applicability
1. This Circular regulates the implementation of purchasing and selling of reactive power capacity as prescribed in Clause 3 and Clause 4, Article 15 of Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law (hereinafter referred to as Decree No. 137/2013/ND-CP).
2. This Circular applies to organizations and individuals purchasing and selling electricity from the national power system and related organizations and individuals.
Article 2. Interpretation of Terms
In this Circular, the following terms shall be understood as follows:
1. Electricity buyer is an organization or individual that has signed a power purchase contract with the electricity seller for production, business, service provision, or resale to other organizations or individuals.
2. Electricity seller is wholesale and retail electricity units holding a license to operate in the wholesale and retail electricity sectors.
Article 3. Guidance on Implementing Purchasing and Selling of Reactive Power Capacity
1. An electricity buyer with its own substation or without its own substation but with a maximum registered power consumption of 40 kW or more in the power purchase contract and with a power factor cosφ less than 0.9 must purchase reactive power capacity. The method for determining the power factor cosφ is specified in Clause 2 of this Article.
If the electricity buyer has a maximum registered power consumption of less than 40 kW in the power purchase contract but has a maximum actual power consumption of 40 kW or more in three consecutive meter reading cycles, then the electricity buyer falls within the category required to purchase reactive power capacity starting from the next meter reading cycle following the three aforementioned cycles. The electricity buyer is responsible for renegotiating the power purchase contract with the electricity seller to comply with the provisions of Clause 3, Article 15 of Decree No. 137/2013/ND-CP.
2. The power factor cosφ used to determine the purchase of reactive power capacity by the electricity buyer is calculated based on the measurement data from the electricity meter over one meter reading cycle according to the following formula:

Ap: Active energy in the meter reading cycle (kWh);
Aq: Reactive energy received in the meter reading cycle, which is the amount of reactive power consumed by electrical equipment during the period between two meter readings (kVArh).
3. In cases where the electricity buyer signs a single contract for multiple meters measuring electricity at one location supplied through the same medium voltage or high voltage line, the active energy is the total active energy measured by all meters, and the reactive energy is the total reactive energy measured by all meters.
4. In cases where the electricity buyer uses electricity for purposes other than production, business, and services together, the determination of the power factor cosφ is as follows:
a) When there is a separate meter for the portion of electricity used for production, business, and services, the purchase of reactive power capacity only applies to this portion.
b) When there is no separate meter for the portion of electricity used for production, business, and services, but only a common meter, if the power factor cosφ is less than 0.9, the electricity buyer still must purchase reactive power capacity for the entire common portion.
5. The cost of purchasing reactive power capacity is the amount of money the electricity buyer must pay the electricity seller to compensate for additional costs incurred due to the electricity buyer's excessive use of reactive power capacity, calculated according to the following formula:

Tp: Cost of purchasing active energy (excluding VAT);
k: Compensation rate for additional costs due to excessive use of reactive power capacity by the electricity buyer (%).

6. The electricity buyer must pay the cost of purchasing reactive power capacity concurrently with the cost of purchasing active energy. The invoice for purchasing reactive power capacity shall be implemented in accordance with the regulations of the Ministry of Finance. The handling of overdue payments for purchasing reactive power capacity shall be treated similarly to the handling of overdue payments for purchasing active energy.
7. In cases where the electricity seller fails to ensure the quality of electricity as stipulated in Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law, the electricity buyer does not have to purchase reactive power capacity when the power factor cosφ is less than 0.9.
8. In cases where the electricity buyer has the ability to supply reactive power capacity to the power system and the electricity seller has a need to purchase reactive power capacity, both parties may agree on the purchase and sale of reactive power capacity through a contract. In cases where both parties cannot reach an agreement, they should refer the matter to the Ministry of Industry and Trade for consideration and decision.
Article 4. Effective date
1. This Circular takes effect from December 10, 2014; Circular No. 07/2006/TT-BCN dated October 27, 2006 of the Ministry of Industry guiding the purchase and sale of reactive power capacity ceases to be effective from the date this Circular takes effect.
2. During the implementation process, if there are any difficulties, relevant units are requested to directly reflect them to the Electricity Regulatory Authority for examination and resolution within their authority or report to the Ministry of Industry and Trade for resolution./.
