CIRCULAR

      Issuing the List of Occupations and Jobs that are Heavy, Hazardous, Dangerous, and Particularly Heavy, Hazardous, Dangerous

Pursuant to Decree No. 39/2016/NĐ-CP dated May 15, 2016 of the Government detailing the implementation of certain provisions of the Labor Safety Law;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

At the proposal of the Director of the Occupational Safety and Health Inspectorate;

The Minister of Labor, Invalids, and Social Affairs issues this Circular to issue the List of Occupations and Jobs that are Heavy, Hazardous, Dangerous, and Particularly Heavy, Hazardous, Dangerous.

Article 1. List of Occupations and Jobs that are Heavy, Hazardous, Dangerous, and Particularly Heavy, Hazardous, Dangerous

Attached to this Circular is the List of Occupations and Jobs that are Heavy, Hazardous, Dangerous, and Particularly Heavy, Hazardous, Dangerous.

Article 2. Implementation

1. Workers engaged in occupations and jobs issued with this Circular and Decision No. 1453/LDTBXH-QĐ dated October 13, 1995, Decision No. 915/LDTBXH-QĐ dated July 30, 1996, Decision No. 1629/LDTBXH-QĐ dated December 26, 1996, Decision No. 190/1999/QĐ-BLDTBXH dated March 3, 1999, Decision No. 1580/2000/QĐ-BLDTBXH dated December 26, 2000, Decision No. 1152/2003/QĐ-BLDTBXH dated September 18, 2003, Circular No. 36/2012/TT-BLDTBXH dated December 28, 2012 of the Minister of Labor, Invalids, and Social Affairs shall enjoy labor protection, wage, and social insurance benefits as prescribed in the Labor Code, the Law on Occupational Safety and Health, the Social Insurance Law, and guiding documents.

2. Employers and related agencies and organizations shall ensure that workers engaged in occupations and jobs stipulated in Clause 1 of this Article enjoy labor protection, wage, and social insurance benefits as prescribed in the Labor Code, the Law on Occupational Safety and Health, the Social Insurance Law, and guiding documents.

3. Annually, relevant ministries in charge of industries and sectors shall proactively review the List of Occupations and Jobs that are Heavy, Hazardous, Dangerous, and Particularly Heavy, Hazardous, Dangerous to propose amendments and supplements in line with economic and social development, scientific and technological progress, and management requirements at each period.

Article 3. Effectiveness

1. This Circular takes effect from August 12, 2016.

2. In the course of implementation, if there are any difficulties, please report them to the Ministry of Labor, Invalids and Social Affairs for study and resolution./.
