CIRCULAR

Amending and supplementing certain provisions of Circular No. 07/2015/TT-BTTTT dated March 24, 2015 of the Minister of Information and Communications on telecommunications interconnection

The Minister of Information and Communications issues this Circular amending and supplementing certain provisions of Circular No. 07/2015/TT-BTTTT dated March 24, 2015 of the Minister of Information and Communications on telecommunications interconnection.

Article 1. Amending and supplementing certain provisions of Circular No. 07/2015/TT-BTTTT dated March 24, 2015 of the Minister of Information and Communications on telecommunications interconnection:

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011, issued by the Government, detailing and guiding the implementation of certain provisions of the Law on Telecommunications;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Telecommunications Department;

1. Amending and supplementing Section II - Appendix 01 as follows:

For interconnection to provide other telecommunication services (data transmission services, Internet connection services, etc.)

A. Criteria for determining congestion in interconnection

Interconnection is determined to be congested when the peak traffic volume in the highest 95% (95th Percentile) of each direction of interconnection (upstream and downstream) of a participating enterprise exceeds 90% of the interconnection capacity for seven consecutive days.

B. Evaluation Method

- Based on the actual capacity and traffic recorded in the bandwidth monitoring system (such as PRTG, CACTI, SolarWinds, or other monitoring applications...).

- Sampling interval is 5 minutes per sample.

- Peak traffic volume in the highest 95%: Discard the top 5% of the highest traffic samples and take the highest traffic sample from the remaining 95% of traffic samples in a day.

C. Procedure, criteria

Monitor traffic 24 hours a day, 7 days a week, continuously for 30 days to determine the peak traffic volume in each direction of interconnection.

2. Amending and supplementing Section II - Appendix 03 as follows:

The capacity of each direction of interconnection of a participating enterprise shall be agreed upon by the parties and must ensure that there is no congestion in interconnection;

In case of necessity, the parties shall base on the quality criteria of interconnection as stipulated in Clause 2, Article 6 of this Circular to calculate the interconnection capacity between the two parties.

Interconnection is determined to be congested when the peak traffic volume in the highest 95% (95th Percentile) of each direction of interconnection (upstream and downstream) of a participating enterprise exceeds 90% of the interconnection capacity for seven consecutive days.

Article 2. Implementation Provisions:

1. This Circular takes effect from December 22, 2021

2. The Director of the Office, the Director of the Telecommunications Department; Heads of agencies and units under the Ministry; Directors of Provincial Departments of Information and Communications; General Directors, Directors of telecommunications enterprises and organizations and individuals related to this matter are responsible for implementing this Circular.

3. During the implementation process, if there are difficulties, organizations and individuals need to promptly reflect to the Ministry of Information and Communications (Telecommunications Department) for guidance or consideration and resolution./.

2. The Head of the Office, the Director of the Telecommunications Department; the Heads of agencies and units under the Ministry; the Directors of Provincial Departments of Information and Communications; the General Directors and Directors of telecommunications enterprises and other related organizations and individuals shall be responsible for implementing this Circular.

3. In the course of implementation, if there are any difficulties, organizations and individuals shall promptly report to the Ministry of Information and Communications (Telecommunications Department) for guidance or consideration and resolution./.
