CIRCULAR

Regulations on certain contents regarding specialized inspection in Information and Communications

Pursuant to the Inspection Law on November 14, 2022;

Pursuant to Decree No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and implementing measures of the Inspection Law;

Pursuant to Decree No. 03/2024/NĐ-CP dated January 11, 2024 of the Government stipulating about specialized inspection agencies and activities of agencies assigned to perform specialized inspection functions;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Inspector General of the Ministry of Information and Communications,

The Minister of Information and Communications issues this Circular stipulating certain contents regarding specialized inspection in Information and Communications.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates on persons assigned to perform specialized inspection tasks; uniforms, specialized inspection cards for persons assigned to perform specialized inspection tasks; training specialized inspection skills and ensuring means and tools for specialized inspection activities.

Article 2. Applicability

This Circular applies to the Inspectorate of the Ministry of Information and Communications, units assigned to perform specialized inspection functions in Information and Communications, the Inspector General of the Ministry of Information and Communications, the Directors of units assigned to perform specialized inspection functions, persons assigned to perform specialized inspection tasks in Information and Communications, and other organizations and individuals related thereto.

Article 3. Persons assigned to perform specialized inspection tasks

1. Persons assigned to perform specialized inspection tasks must meet the conditions and standards prescribed in Clause 3, Article 38 of the Inspection Law and hold an inspector training certificate or higher.

2. The Director of the unit assigned to perform specialized inspection functions shall issue a Decision on assignment or removal from specialized inspection tasks upon the proposal of the head of the unit assigned to advise on specialized inspection work of the unit. The model of the Decision on assignment or removal from specialized inspection tasks is specified in Appendix 01 and Appendix 02 attached hereto.

Chapter II

SPECIALIZED INSPECTION CARD

Article 4. Specialized inspection card

1. Persons assigned to perform specialized inspection tasks shall be issued a specialized inspection card by the Minister of Information and Communications for use when performing specialized inspection tasks.

2. Persons assigned to perform specialized inspection tasks are responsible for preserving and using the specialized inspection card in accordance with the law, not to use it for personal purposes, nor to lend it to others for use.

3. The validity period of the specialized inspection card shall not exceed five years from the date of issuance, including newly issued, renewed, or reissued cards in accordance with Article 6 of this Circular.

4. In case of loss, damage, or expiration of the validity period of the specialized inspection card, persons assigned to perform specialized inspection tasks shall report to the Director to proceed with procedures for renewing or reissuing the card in accordance with regulations.

5. Persons who have been issued a specialized inspection card and are no longer assigned to perform specialized inspection tasks shall return the specialized inspection card to the Director.

Article 5. Model of specialized inspection card

1. The model of the specialized inspection card is specified in Appendix 03 attached hereto.

2. Card number of the specialized inspection card:

Persons assigned to perform specialized inspection tasks shall be issued one (01) card number for the specialized inspection card. The card number of the specialized inspection card consists of three parts, separated by hyphens as follows: A33-X-Y (printed in bold uppercase letters, black color, font size 10).

Part I consists of a capital letter and two digits: A33.

Part II consists of the uppercase letter X corresponding to the numbers from 1 to 6 (X=1-6) to distinguish the agencies using the person assigned to perform specialized inspection tasks, specifically as follows: X=1: the symbol of the Press Department; X=2: the symbol of the Radio, Television, and Electronic Information Department; X=3: the symbol of the Radio Frequency Department; X=4: the symbol of the Telecommunications Department; X=5: the symbol of the Publishing, Printing, and Distribution Department; X=6: the symbol of the Information Security Department.

Part III consists of the uppercase letter Y corresponding to the serial number of the Card issued from 1 to n (Y=1-n) for the person assigned to perform specialized inspection tasks.

Example: The Card code of the person assigned to perform specialized inspection tasks at the Radio, Television, and Electronic Information Department is: A33-2-1.

3. The specialized inspection Card code does not change when the person assigned to perform specialized inspection tasks is transferred or rotated within the same agency responsible for specialized inspection functions under the Ministry of Information and Communications.

4. The specialized inspection Card is laminated for external protection or made of PET material.

Article 6. Issuing new, replacing, and reissuing specialized inspection Cards

1. Issuing new specialized inspection Cards for civil servants who meet the conditions and standards stipulated in Clause 1, Article 3 of this Circular and are assigned to perform specialized inspection tasks by the Director of the Department responsible for specialized inspection functions.

2. Replacing specialized inspection Cards in the following cases:

a) The Card has expired;

b) The Card currently in use is damaged;

c) The Card still has validity but the person holding the Card changes position, rank, or transfers to another agency responsible for specialized inspection functions under the Ministry of Information and Communications, or for other reasons leading to a need to change the information of the person on the Card;

d) When the competent authority issues a new Card model to replace the old model.

3. Reissuing specialized inspection Cards in the case where the person who was issued a Card loses it due to objective reasons and is not subject to the circumstances of having the Card revoked or temporarily suspended as stipulated in Clause 3 and Clause 4, Article 7 of this Circular. If the person loses the Card due to violations as stipulated in Clause 2, Article 4 of this Circular, they will not be reissued a Card. The reissued Card will have the same validity period and Card code as the previously issued Card.

4. The application dossier for issuing new, replacing, and reissuing specialized inspection Cards includes:

a) The request letter for issuing new, replacing, and reissuing specialized inspection Cards from the Director of the Department responsible for specialized inspection functions, accompanied by a consolidated list of information of the persons proposed to be issued new, replaced, or reissued Cards.. The format of the request letter for issuing new, replacing, and reissuing specialized inspection Cards is specified in Appendix 04 attached to this Circular. For the case of reissuing a Card, the person holding the Card must submit a request letter for reissuing a specialized inspection Card according to the format specified in Appendix 05 attached to this Circular.

b) Two color photographs (size 20mm x 30mm) of the person assigned to perform specialized inspection tasks against a blue background (taken no more than six months prior to the submission of the dossier, with name and agency clearly marked on the back of the photograph).

c) Decision assigning the person to perform specialized inspection tasks (original or certified copy stamped by the agency), except in the case of requesting reissuance or replacement when the Card has expired or is currently damaged.

5. Within fifteen days from the date of receiving complete dossiers for issuing new, replacing, and reissuing specialized inspection Cards from the Departments responsible for specialized inspection functions, the Inspectorate of the Ministry is responsible for compiling and submitting to the Minister for consideration and signing the Decision to issue specialized inspection Cards according to the format of the Decision to issue specialized inspection Cards specified in Appendix 06 attached to this Circular. If the Inspectorate does not issue a specialized inspection Card based on the application dossier submitted by the Department, the Inspectorate must provide a written response to the Department explaining the reason for not issuing the Card.

6. The Ministry's Office is responsible for printing specialized inspection Cards after approval by the Minister and handing over the specialized inspection Cards to the Inspectorate of the Ministry.

7. The Inspectorate of the Ministry is responsible for receiving and handing over specialized inspection Cards to the Departments responsible for specialized inspection functions.

8. The Director of the Department responsible for specialized inspection functions is responsible for the information and dossiers of the persons proposed to be issued specialized inspection Cards; managing, handing over, and supervising the use of specialized inspection Cards by persons under their management.

Article 7. Revocation, Temporary Suspension of Use of the Card specialized inspection

1. The Director of the Department assigned to perform specialized inspection functions shall send a letter to the Ministry Inspector requesting the revocation or temporary suspension of use of the specialized inspection card for individuals assigned to perform specialized inspection tasks according to the Model Letter Requesting Revocation or Temporary Suspension of Use of the Specialized Inspection Card stipulated in Appendix 07 issued together with this Circular.

2. The Ministry Inspector has the responsibility to compile and submit to the Minister for review and signature the Decision on Revocation or Temporary Suspension of Use of the Specialized Inspection Card. The Model Decision on Revocation or Temporary Suspension of Use of the Specialized Inspection Card is stipulated in Appendix 08 issued together with this Circular.

3. Individuals assigned to perform specialized inspection tasks shall be subject to temporary suspension of use of the specialized inspection card in the following cases:

a) Engaging in acts of violation of laws during specialized inspection activities as prescribed by law without a decision on handling;

b) Being on temporary suspension from work pending disciplinary action;

c) Being indicted, detained, or imprisoned.

4. Individuals assigned to perform specialized inspection tasks shall have their specialized inspection cards revoked in the following cases:

a) Transferring to another agency or unit, or not being assigned to continue performing specialized inspection tasks, or retiring, resigning; death while on duty;

b) Being sentenced by a court with a valid criminal judgment or being disciplined with one of the measures of demotion in rank, reduction in position, removal from office, or forced resignation;

c) Losing civil capacity.

5. After the conclusion of the competent authority proving that the individual who was granted the card did not violate the law during the performance of official duties or the disciplinary period has expired, the Director of the Department assigned to perform specialized inspection functions shall send a letter to the Ministry Inspector requesting the Minister of Information and Communications to issue a Decision terminating the temporary suspension of use of the specialized inspection card. The Model Decision Terminating the Temporary Suspension of Use of the Specialized Inspection Card is stipulated in Appendix 09 issued together with this Circular.

Article 8. Funding for Printing Blank Forms, Cards, Issuing Specialized Inspection Cards

1. The funding for printing blank forms, cards, and issuing specialized inspection cards shall be sourced from the state budget allocated to the Ministry of Information and Communications.

2. The Ministry Inspector shall base on actual needs each year to prepare the budget estimate for printing blank forms, cards, and issuing specialized inspection cards and submit it to the Ministry Office for consolidation into the annual budget estimate of the Ministry of Information and Communications.

CHAPTER III

ENSURING CONDITIONS FOR SPECIALIZED INSPECTION ACTIVITIES

Article 9. Professional Training for Specialized Inspection

1. The Ministry Inspector shall take the lead and coordinate with the Cadre and Civil Servant Department to develop and submit to the Ministry Leadership for approval the Annual Plan for Training and Professional Development for Specialized Inspection for Inspectors and individuals assigned to perform specialized inspection tasks and related organizations and individuals participating in specialized inspection activities in the field of Information and Communications.

2. The Ministry Inspector shall organize the implementation of the Annual Plan for Training and Professional Development for Specialized Inspection after approval.

3. Priority shall be given to individuals assigned to perform specialized inspection tasks currently working in units responsible for specialized inspection advisory work to participate in professional development training courses for specialized inspection.

Article 10. Ensuring Means and Tools for Specialized Inspection Activities

The Director of the Department assigned to perform specialized inspection functions shall be responsible for equipping all necessary means for inspection activities, including computers, telephones, tablets, audio and video recording devices; tools for collecting evidence and proof to serve inspection and violation handling work (accounts for using paid broadcasting and television services, SIM cards, telecommunications service cards, postal service packages, goods, purchasing publications).

Article 11. Printing and Distributing the Inspection Team's Logbook

1. The printing of the Inspection Team's Logbook shall be carried out once a year.

2. The Model Inspection Team's Logbook shall comply with the regulations of the Government Inspectorate.

3. Each year, the Ministry Inspector shall take the lead and coordinate with Departments assigned to perform specialized inspection functions based on the inspection program and plan and the needs of the Departments to compile and register the number of Inspection Team's Logbooks to be printed and submit them to the Ministry Office.

4. The Ministry Office shall print and hand over the Inspection Team's Logbooks to the Ministry Inspector for management and distribution to Departments assigned to perform specialized inspection functions.

5. The Directors of Departments assigned to perform specialized inspection functions shall be responsible for registering the number, receiving, managing, and handing over the Inspection Team's Logbooks to inspection teams under their jurisdiction for use in accordance with regulations.

Article 12. Funds for professional training of specialized inspection, ensuring means and tools for inspection activities, printing Inspection Team's Daily Log

Funds for professional training of specialized inspection, ensuring means and tools for inspection activities, and printing Inspection Team's Daily Log shall be sourced from the State budget allocated to the Ministry of Information and Communications.

PART IV

||| APPAREL OF PERSONS ASSIGNED TO PERFORM||| SPECIALIZED INSPECTION TASKS

Article 13. Apparel of persons assigned to perform specialized inspection tasks

1. The apparel of persons assigned to perform specialized inspection tasks as stipulated in this Circular includes: trousers, shirts (winter, spring-summer); overcoat; leather belt; leather shoes; backless sandals; socks; necktie; raincoat trousers and shirts; rubber boots; file case; kepi hat; hat badge; juniper branch; nameplate, rank insignia, shoulder boards, rank insignia. 2. Based on specific regional conditions and the particularities of the work, the Director of the Bureau responsible for performing specialized inspection functions may consider and decide to switch the overcoat to spring-summer trousers and shirts or vice versa to suit actual circumstances.

Article 14. Specifications and colors of male attire

1. Overcoat:

a) Material: blended twill fabric, code: TW8058-1; weave type: 3/1 twill; ratio: PW45/55; density: warp 360s/cm; weft 270s/10cm

b) Color: dark heather gray.2c) Buttons: Plastic buttons 20mm and 15mm.2.

d) Style: Two-layered men's coat with lining, collar without lapel, front with pleated pocket, sleeve with vest style cuffs, each side with two slanted pockets, back with a slit at the center seam. Shoulder has 8mm buttonholes for rank insignia, with shoulder pads.

2. Winter jacket (Blazer):

d) Style: Two-layered outerwear with lining, notched collar, "V" shaped lapel, long lapel, three plastic buttons 20mm on the placket, shoulder with 8mm buttonholes for rank insignia. Front with blazer style, square gusset, left chest with one slanted pocket, two lower flap pockets with flaps, round cornered flaps, sleeve with vest style cuffs, slits, and four plastic buttons 15mm. Back with a slit at the center seam, two side slits, shoulder pads on both sides, two inner pockets under the armpit. Entire collar, pocket flaps, and front placket are reinforced with pleats. Waistband is reinforced with stiff fabric, inside waistband has elastic straps to secure the shirt when tucked in, with six buttonholes for belt attachment. Hem with crescent shape.

3. Winter trousers, spring-summer trousers:

b) Color: dark heather gray.2a) Material: blended twill fabric, code: TW8058-1; weave type: 3/1 twill; ratio: PW45/55; density: warp 360s/10cm2.

Waistband reinforced with stiff fabric, inside waistband with elastic straps to secure the shirt when tucked in, with six buttonholes for belt attachment. Hem with crescent shape.

4. Long-sleeved shirt for winter:

b) Style: Oxford style, smooth toe; four pairs of eyelets for decorative laces, foam padding in the shoe body for comfort, elastic inserts inside and outside the heel counter; upper made of soft and flexible black nappa leather with a matte finish and smooth grain, lining and insole made of light brown cowhide; PU outsole with a 4cm heel, molded in shape, featuring anti-slip patterns on the sole surface.

8. Backstrap Sandals:

a) Material: black nappa leather; thickness: 1.2mm to 1.4mm; tensile strength: (Mpa) ≥ 18; (N/cm2) ≥ 3.

Shoulder straps are 8mm wide for insignia attachment, with shoulder pads. The back has a stitched seam at the spine, without a back slit, and shoulder pads. The entire coat, flaps, and collar are reinforced with mex.

4. Long-sleeved shirt for winter:

a) Material: blended wool twill fabric, code TW8058-1; weave type: 3/1 diagonal; ratio: PW45/55; density: 360s/10cm2c) Color: navy blue.2; weight: 245g/m²2.

d) Style: Two-layered men's coat with lining, collar without lapel, front with pleated pocket, sleeve with vest style cuffs, each side with two slanted pockets, back with a slit at the center seam. Shoulder has 8mm buttonholes for rank insignia, with shoulder pads.

d) The name badge is attached to the top edge of the left pocket on the uniform jacket worn by individuals assigned to perform specialized inspection tasks. The name badge model is specified in Appendix 10 issued together with this Circular.

a) Material: black leather with number lock; thickness: 1.4mm ± 1.6mm; tensile strength: (MPa) ≥ 16, (N/cm²2) ≥ 1100; embossed with the logo of the industry.

b) Style: With carrying handle and shoulder strap.

7. Insignia Button:

a) Material: yellow brass sheet 0.8mm thick; bolt and nut made of brass M2;

b) Color: shiny white;

c) Plating process: copper base layer, followed by nickel and finally chromium plating.

d) Style: Circular with a star in the center between two pine branches.

8. Pine Branch:

a) Material: yellow brass sheet 0.7mm thick; clip made of brass 15mm x 3mm; weight: 6g ± 0.4;

b) Color: shiny white;

c) Plating process: copper base layer, followed by nickel and finally chromium plating.

d) Style: Straight, consisting of eleven leaves and seven fruits.

9. Hat Star:

10. Cap:

a) Material and color of the cap: the cap shell is made of woolen twill fabric marked TW8058-1, dark grayish green; decorative cord core is made of peco fiber with a rating of 34Nm, dark yellow, covered with metallic thread; forehead support is made of pure white plastic; brim is made of plastic covered with velvet edge imitation leather, black; the cap button is made of gold-plated brass sheet 0.6mm thick, with a red brass stud 0.8mm in diameter, 15mm long; plated with bright white color; plating process: copper plating first, then nickel plating, and finally chromium plating;

b) Material and plating process for the pine branch on the cap: the pine branch on the cap is made of gold-plated brass sheet 0.8mm thick, welded with four red brass studs 0.8mm in diameter, 15mm long; the pine branch on the cap is plated with bright white color; plating process: copper plating first, then nickel plating, and finally chromium plating;

c) Design of the cap: the cap top is high, the brim is curved, the crown and cap body are made of the same fabric; the cap body is circular, around the body is a plastic tube, inside the plastic tube is a steel spring; there is a foam cushion in front of the forehead, in the middle of the forehead is a round badge with a star surrounded by two pine branches, each side has two air vents; above the brim is a decorative cord braided in a fish tail style, dark yellow, with round metal buttons with a star surrounded by two pine branches at both ends; the brim is made of plastic covered with black velvet, gradually sloping forward, the upper part of the brim is attached with a bright white pine branch.

Article 17. Rank insignia

1. The rank insignia includes shoulder straps and rank badges worn on both shoulders of the uniform of individuals assigned to perform specialized inspection tasks.

The design of the shoulder straps and rank badges for individuals assigned to perform specialized inspection tasks is specified in Appendix 11 issued together with this Circular.

2. Regulations on shoulder straps:

The shoulder strap for individuals assigned to perform specialized inspection tasks measures 13cm in length, with the pointed end being 4cm wide and the tail end being 5cm wide; the insignia base is made of red felt, the insignia frame is made of white solid plastic; the stars on the insignia are made of gold-plated brass sheets; there is a 3mm wide blue strip; the button on the insignia is round with a star between two pine branches.

3. Regulations on shoulder straps and rank badges for individuals assigned to perform specialized inspection tasks who hold leadership and management positions:

a) Individuals assigned to perform specialized inspection tasks holding the position of Director of the Department responsible for specialized inspection functions under the Ministry of Information and Communications: the shoulder strap is attached with four 23mm stars in a vertical row on the shoulder strap, with two horizontal white metal stripes at the bottom of the shoulder strap;

b) Individuals assigned to perform specialized inspection tasks holding the position of Deputy Director of the Department responsible for specialized inspection functions under the Ministry of Information and Communications: the shoulder strap is attached with three 23mm stars in a vertical row on the shoulder strap, with two horizontal white metal stripes at the bottom of the shoulder strap;

2. Uniforms issued once: kepi hat, pine branch, nameplate, rank insignia, shoulder boards, rank badge. In case uniforms become old, damaged, lost, or there is a change in position (rank), they will be reissued.

Article 19. Management and Use of Uniforms for Persons Assigned to Carry Out Specialized Inspection Tasks

1. Persons assigned to carry out specialized inspection tasks have the responsibility to manage and use uniforms issued in accordance with the provisions of this Circular and other relevant regulations.

2. Uniforms of persons assigned to carry out specialized inspection tasks shall be used when performing duties, attending conferences, traditional days, and other ceremonies related to inspection activities.

3. The Director of the Bureau responsible for carrying out specialized inspection functions has the responsibility to provide uniforms for persons assigned to carry out specialized inspection tasks under their management in accordance with the provisions of this Circular.

Article 20. Budget for Making and Providing Uniforms

The budget for making and providing uniforms for persons assigned to carry out specialized inspection tasks shall be sourced from the state budget allocated to the Ministry of Information and Communications.

CHAPTER V

IMPLEMENTATION

Article 21. Effective Date

1. This Circular takes effect from January 28, 2025.

2. This Circular replaces Circular No. 36/2017/TT-BTTTT dated November 29, 2017 of the Minister of Information and Communications on the advisory department and inspection activities of agencies assigned to carry out specialized inspection functions under the Ministry of Information and Communications.

3. In cases where laws and regulations cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replacing laws and regulations shall apply.

Article 22. Responsibility for enforcement

1. The Head of the Ministry's Office, the Head of the Ministry's Inspectorate, the Director of the Department of Planning and Finance, the Director of the Department of Organization and Cadre Affairs, the Directors of Bureaus assigned to carry out specialized inspection functions, Heads of ministries' agencies and units, and related organizations and individuals are responsible for implementing this Circular.

2. During implementation, if there are difficulties or new issues arise, Heads of agencies, organizations, and individuals should promptly report to the Ministry of Information and Communications (Ministry Inspectorate) for guidance or amendments as necessary./.
