CIRCULAR
REGULATIONS ON THE GRADING AND DEFINITION OF AUTHORITY OF LOCAL ADMINISTRATIONS AT TWO LEVELS IN THE FIELD OF TRADITIONAL MEDICINE AND TRADITIONAL PHARMACY
Pursuant to the Law on Government Organization 2025;
Pursuant to the Law on Local Government Organization 2025;
Pursuant to Resolution No. 190/2025/QH15 of the National Assembly in 2025 on handling certain issues related to the restructuring of state administrative bodies;
Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Traditional Medicine Management Department;
The Minister of Health promulgates this Circular regulating the grading and definition of authority of local administrations at two levels in the field of traditional medicine and traditional pharmacy.
Article 1. Issuance, reissuance, and revocation of certificates for traditional medical practitioners
1. The authority to issue, reissue certificates for traditional medical practitioners for the subjects specified in Clause 2 and Clause 3 of Article 1 of Circular No. 02/2024/TT-BYT dated March 12, 2024 of the Minister of Health on issuing certificates for traditional medical practitioners, certificates for individuals with family herbal prescriptions, certificates for individuals with family traditional healing methods, and combining traditional medicine with modern medicine at healthcare facilities (hereinafter referred to as Circular No. 02/2024/TT-BYT) shall be carried out by specialized agencies under the People's Committee of the province.
2. The dossier, procedures, and formalities for issuing and reissuing certificates for traditional medical practitioners shall be implemented according to the provisions set forth in the Appendix attached hereto.
3. The authority to revoke certificates for traditional medical practitioners that have been issued for the subjects specified in Clause 2 and Clause 3 of Article 1 of Circular No. 02/2024/TT-BYT shall be carried out by specialized agencies under the People's Committee of the province.
4. The procedure for revoking certificates for traditional medical practitioners that have been issued for the subjects specified in Clause 2 and Clause 3 of Article 1 of Circular No. 02/2024/TT-BYT shall be implemented according to the procedure stipulated in Article 19 of Circular No. 02/2024/TT-BYT.
Article 2. Receiving reports on issues arising that affect project implementation and proposals for solutions
The authority to receive reports on issues arising that affect project implementation and proposals for solutions as stipulated in Point e, Clause 3, Article 14 of Circular No. 10/2022/TT-BYT dated September 22, 2022 of the Minister of Health guiding the implementation of investment and support for developing precious medicinal plant cultivation areas under the National Target Program for Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 10/2022/TT-BYT) shall be carried out by the People's Committee of the province.
Article 3. Transitional Provisions
1. For dossiers submitted before the effective date of this Circular: The agency receiving the dossier shall continue to process according to current regulations until the administrative procedure is completed.
2. Localities currently implementing projects shall continue to implement investment and support for developing precious medicinal plant cultivation areas approved by competent authorities according to the provisions of Circular No. 10/2022/TT-BYT until completion.
Article 4. Effective date
Article 32. Responsibilities of Agencies
2. This Circular shall cease to be effective from March 1, 2027.
3. Replace the term "district" with "province" in Clause 1, Article 6 and replace the term "district" with "commune" in Clause 2, Article 6 of Circular No. 10/2022/TT-BYT.
4. During the period when this Circular is effective, if the provisions on authority and responsibilities for state management in this Circular differ from those in other Circulars issued by the Minister of Health before July 1, 2025, then the provisions in this Circular shall apply.
In the course of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should report to the Ministry of Health (Traditional Medicine and Pharmacy Management Department) for consideration and resolution./.

Procedures and Formalities for Issuing Certificates for Traditional Medical Practitioners
(Attached to Circular No. 15/2025/TT-BYT dated June 14, 2025 of the Minister of Health)
Part 1. Procedures for Issuing a Traditional Medicine Practitioner Certificate to Individuals Required to Take an Examination
1. An individual shall submit one set of application documents in accordance with Article 5 or Article 6 of Circular No. 02/2024/TT-BYT to the specialized health administration agency under the People's Committee of the province (hereinafter referred to as the receiving agency) via postal service, directly, or through the National Public Service Portal.
2. Upon receipt of the application documents, the document receiving department shall issue a Receipt Form according to Model No. 02 of Appendix I promulgated together with Circular No. 02/2024/TT-BYT.
In case the application documents are not valid, within five working days from the date recorded on the Receipt Form, the receiving agency must notify the applicant in writing to request additional information.
3. Within ten working days from the date of receiving valid application documents, the Secretariat of the Examination Oversight Board shall review the application documents:
a) If the conditions are met, the Secretariat shall prepare a list to be submitted to the Board.
b) If the conditions are not met, the Secretariat shall report to the receiving agency to notify the applicant in writing and specify the reasons.
4. Within ten working days from the date of receiving the list from the Secretariat, the Examination Oversight Board shall convene a meeting to address the matter:
a) If the conditions for taking the examination are met, the receiving agency shall develop a plan, organize the examination, and score it.
b) If the conditions for issuing a Traditional Medicine Practitioner Certificate or for taking the examination are not met, the receiving agency shall notify the applicant in writing and specify the reasons.
5. Within fifteen days after the examination:
a) If the examination results are satisfactory, the Secretariat shall present the matter to the head of the receiving agency to issue a Traditional Medicine Practitioner Certificate.
b) If the examination results are unsatisfactory, a written notification of the examination results shall be issued to each applicant.
Part 2. Procedures for Reissuing a Traditional Medicine Practitioner Certificate in Case of Loss or Damage
1. An individual shall submit one set of application documents in accordance with Article 10 of Circular No. 02/2024/TT-BYT to the receiving agency via postal service, directly, or through the National Public Service Portal.
2. Upon receipt of valid application documents, the document receiving department shall issue a Receipt Form according to Model No. 02 of Appendix I promulgated together with Circular No. 02/2024/TT-BYT.
3. Within seven working days from the date of receiving valid application documents, the receiving agency shall reissue the Traditional Medicine Practitioner Certificate to the applicant in accordance with the regulations.
