OF THE MINISTRY OF LABOR NUMBER 15/LD-TT ON AUGUST 10, 1961
GUIDELINES FOR THE CONSTRUCTION AND COMBINATION OF PLANS TO SUPPLEMENT WORKING PERSONNEL AND RECRUITMENT TRAINING PLANS

The planned and balanced economic development in the northern region requires an increasing number of human resources; at the same time, social labor is increasingly organized and managed strictly; to fully meet the demand for workers and implement and exceed state plans, workforce coordination must be planned.
Therefore, on January 7, 1961, the Prime Minister issued Directive No. 041-CN agreeing to the Ministry of Labor issuing forms for supplementing workforce planning, and on April 17, 1961, the Prime Minister issued Directive No. 149-TTG supplementing Directive No. 440-TTG dated January 9, 1959 regarding the planning of worker training and the combination of workforce supplementation plans.
Now, the Ministry of Labor issues this circular to explain and provide detailed guidance on implementation.
I. CONTENT OF THE WORKFORCE SUPPLEMENTATION PLAN
The workforce supplementation plan consists of three parts: the plan to supplement workers for construction work, the plan to supplement workers in factories, agricultural and forestry farms, and the recruitment training plan for workers.
Annually, sectors and localities base on the plan, the number of staff working in the planning year, and the current number of workers to determine the surplus or shortage and balance the source of supplementary workforce, including: adjusting from surplus areas to shortage areas, distributing vocational students from schools and recruiting new people from outside (form AI, AIV).
Based on the annual supplementation plan, a quarterly recruitment plan is established (form AII, AV). This plan may be less but not exceed the annual plan. The number of supplementary staff each quarter must align with production plans and should have a harmonious distribution among quarters, avoiding concentrating recruitment at once; meanwhile, it should not exceed the average staffing quota of the planning year.
Balancing the source of supplementary workforce and establishing a quarterly recruitment plan is done once a year. Each quarter, ministries, sectors, and localities base on production or construction tasks, actual current workforce conditions... to establish a quarterly supplementary workforce plan (form AIII, AV) to report to the Ministry of Labor and administrative committees of regions, provinces, and cities to prepare for the distribution of recruited workforce.
In addition to recruiting workers to supplement production or basic construction, sectors and localities annually also base on the national targets assigned to recruit additional people to train them into skilled workers in schools, classes, or directly in enterprises, construction sites. Therefore, to know how many need to be recruited each year to prepare sources of student and youth supply, the Ministry of Labor issues two additional forms a1/DT and a2/DT about the annual and quarterly plans for recruiting and training technical workers accompanying this circular.
Ministries, sectors, and localities if they need to recruit and train technical workers should base on the above forms to establish plans. Alongside these planning tables according to the above forms, clear explanations about measures to implement the supplementary workforce plan, especially measures to increase labor productivity and rationally utilize all available labor potential, must be provided; at the same time, clearly state recruitment standards, etc. The requirements for establishing the supplementary workforce plan must be accurate, specific, timely, and consistent with the content of the forms already approved by the Prime Minister; aiming to help sectors and localities combine plans, and based on this, proceed with balancing excess and shortage forces within sectors and localities; simultaneously, the Ministry of Labor and administrative committees of regions, provinces, and cities can establish workforce coordination plans and assign tasks to provide workforce to districts, towns, villages, cooperatives to implement.
The method of calculating the supplementary workforce plan is shown in the appendix attached to this Circular.
II. SCOPE OF RESPONSIBILITY AND PROCEDURES FOR CONSTRUCTION
COMBINATION AND DISTRIBUTION OF THE WORKFORCE SUPPLEMENTATION PLAN
The Prime Minister's Directive No. 149-TTG dated April 17, 1961 has clearly defined responsibilities and procedures for establishing the workforce supplementation plan: The Ministry of Labor provides further clarification on some detailed points:
1. The directive stipulates: "Ministries, central sectors, and localities recruiting workers for production, basic construction, transportation, commerce, and public institutions, who need to recruit new personnel, must establish annual and quarterly workforce supplementation plans"; specifically, sectors needing to recruit various types of workers and general laborers, including students in cities and rural areas, to work or learn trades in factories, industrial, agricultural, and forestry farms, state-owned or cooperative stores, power substations, warehouses, hospitals, technical worker training schools, or training personnel such as accountants, supply staff... administrative agencies, etc., must establish workforce supplementation plans; regardless of material production areas or non-material production areas; regardless of direct production workers or administrative staff, janitors:
For mechanical workers currently outside, there are not many left, mainly requiring training, so before establishing the workforce supplementation plan, prior consultation with the labor sector is necessary.
For joint-stock enterprises that need to recruit new personnel, the managing sectors such as Industry, Commerce, etc., must also establish workforce supplementation plans as stipulated by the Ministry of Labor in Circular No. 21 dated November 17, 1959.
2. Enterprises, industrial, agricultural, and forestry farms, commercial stores, hospitals, schools, etc., if under the management of Ministries or General Departments (equivalent to Ministries), then the Ministries or General Departments have the responsibility to guide the construction and consolidation of plans to send to the Ministry of Labor; if under localities, then the departments, bureaus, companies, etc., guide the construction and consolidation of plans to send to the local labor departments.
If a Ministry or General Department entrusts Departments, Bureaus, etc., to develop and approve additional workforce plans for facilities, they must inform the Ministry of Labor.
The Ministry of Labor and Administrative Committees of regions, provinces, and cities shall allocate workers to enterprises, public works, agricultural, forestry, and fishery farms, etc., only when there is an official approval document regarding the staffing quotas of Ministries and sectors (if under central management) or of the Administrative Committee of the region, province, or city (if under local management).
Administrative Committees of regions, provinces, and cities may allocate workers to facilities under central management only upon receipt of an official approval document from the supervising Ministry and the allocation plan of the Ministry of Labor.
3. The Directive stipulates: "The Ministry of Labor and labor agencies of regions, provinces, and cities are responsible for compiling additional workforce plans and training worker plans..." specifically as follows:
- The Ministry of Labor compiles and distributes additional workforce plans and training enrollment plans for workers of Ministries, Ministries at the level of Ministries, and of regions, provinces, and cities.
- Departments, Bureaus, and Labor Offices compile and distribute additional workforce plans and training enrollment plans for workers of sectors under local management and of counties, districts, and towns. Additionally, Departments, Bureaus, and Labor Offices compile draft additional workforce plans for enterprises under central management located within their jurisdiction to understand the usage and demand for workers in these enterprises, and propose solutions to the Party Committee, Administrative Committee, and the Ministry of Labor.
4. In the directive, it states "... During the process of developing additional workforce plans and training worker plans... Ministries, sectors, especially the State Planning Commission, General Statistics Office, and Local Planning Commissions have the responsibility to closely coordinate with the Labor sector to exchange necessary materials to assist the Ministry of Labor in fulfilling its consolidation tasks..."; specifically providing the Labor sector with:
- Tasks: production, business, training, basic construction, etc., for the year (or quarter) plan;
- Implementation status of the labor wage plan for the year (or quarter) report and the labor wage plan for the year (or quarter) plan, including: labor time usage; number of employees; labor productivity; potential capacity in sectors to rationally and economically utilize labor force; overall surplus and shortage of workers in sectors and localities compared to the plan, direction, and sources of workers needed to supplement enterprises, etc...
5. Point 2 in the directive: "... The Ministry of Labor and labor agencies of regions, provinces, and cities need to review data and provide comments on measures to implement additional workforce plans and training worker plans... Then compile additional workforce plans... and establish distribution projects for localities...", the Ministry of Labor explains as follows:
- Ministries, sectors, and localities must ensure the recruitment of additional workers according to production requirements, national labor productivity plans, in accordance with the direction for additional workforce supplementation, and not exceed the quota of employees.
In cases where sectors or localities need to recruit additional workers exceeding the assigned employee quota due to some reason: the recruitment criteria and target groups cannot follow the government's direction for additional workforce supplementation, or sometimes fail to meet the training enrollment targets for technical workers, they must report specifically to the Prime Minister's Office and the Ministry of Labor (if under the central plan) or the Administrative Committee of the region, province, or city (if under the local plan) to seek solutions.
- The Ministry of Labor and local labor agencies will participate in discussions with sectors and facilities on appropriate recruitment directions and standards for each sector, profession, locality, and type of worker; provide organizational, management, and rational utilization of labor force assistance; help mobilize workers to participate in implementing state plans, etc.
- Based on the needs for additional workforce supplementation and training worker enrollment of sectors and localities, the Ministry of Labor will coordinate with Administrative Committees of regions, provinces, and cities; Administrative Committees of regions, cities, and provinces will coordinate with counties, districts, towns, etc., to unify the distribution plan for supplying workers to each locality. When there is a distribution plan for workers, regions, provinces, and cities, counties, districts, towns, villages, cooperatives must fully implement it; if encountering difficulties, they should strive to find all possible solutions to meet the actual demand for workers to complete and exceed the state plan.
6. The directive also stipulates: "Ministries, sectors, and localities have the responsibility to report the implementation status of additional workforce supplementation plans and training worker plans monthly, quarterly, and annually to the Ministry of Labor." The Ministry of Labor provides further clarification:
After each adjustment or recruitment of workers at a unit or locality, the user sector and the unit or locality with workers will establish a handover record or sign a contract. These documents must be sent to the labor agency where the workers are from and where they work, and additionally sent to the Ministry of Labor if the requests were directly distributed by the Ministry of Labor.
Annually and quarterly, Ministries, sectors, and facilities must report the implementation status of additional workforce supplementation plans, clearly stating the number of recruited workers and students according to the labor sector's distribution, evaluating the labor sector's management and coordination of workers, etc., to the Ministry of Labor (if under the central plan) and to the Administrative Committee and labor agency of the region, province, or city (if under the local plan).
Each Department of Labor must regularly and thoroughly report monthly, quarterly, and annually to the Ministry on the coordination and provision of labor, recruitment situations, worker training... During the process of coordinating labor, if encountering any difficulties that prevent the provision of sufficient workers for various sectors, they must promptly report to the Ministry for timely resolution.
III. TIME FOR REPORTING THE SUPPLEMENTARY LABOR FORCE PLAN
FOR THE LABOR SECTOR
According to the regulations of the State Planning Commission, each year at the beginning of the fourth quarter, all Ministries, sectors, and localities must complete draft production plans and labor wage plans to send to the State Planning Commission for timely consolidation and submission to the Council of Ministers for approval.
Therefore, while drafting the labor wage plan, all Ministries, sectors, and localities must also draft supplementary labor force plans and recruitment and worker training plans to send to the Labor sector no later than the end of November of the reporting year, in accordance with the Prime Minister's Directive.
After the plan has been approved by the Government, all sectors and localities must promptly adjust the supplementary labor force plan if there are changes in the production plan or labor wage plan, and then send it to the Labor sector within no more than one month from the date of Government approval.
IV. IMPLEMENTATION PLAN
At the end of Directive No. 149 of the Prime Minister, it is stipulated: "All Ministries, the State Planning Commission, and administrative committees at all levels must carefully study this directive and strictly implement the provisions made therein." The Ministry of Labor provides specific guidance as follows:
- ATCentral bodies, Ministries, and sectors instruct their planning, statistics, labor wage, or human resources research departments to thoroughly understand the contents of Articles in the Prime Minister's Directive No. 440 dated April 17, 1961, No. 49 dated April 17, 1931, and No. 04 dated January 7, 1961, and the Circulars guiding the explanation of the Ministry of Labor regarding the construction and consolidation of supplementary labor force plans and worker training plans; thereafter, they should formulate implementation plans and measures.
Meanwhile, Ministries and sectors need to issue guidelines to forestry farms, factories, stores, subordinate units, etc., to ensure they fully understand the requirements, responsibilities, and methods for calculating and filling out planning forms; simultaneously, they should combine these guidelines with discussions during meetings on building the 1962 plan. If there are no conditions to provide guidance to subordinate units, Ministries and sectors can request assistance from administrative committees at local levels to guide units within their jurisdiction, thereby helping these units to effectively implement the aforementioned plans.
- AT Localities, provincial, municipal administrative committees instruct their planning, statistics, and labor departments to jointly study and discuss and formulate implementation plans for this matter. Administrative committees and provincial, municipal planning committees need to combine guidance with discussions among sectors and facilities during meetings on building the 1962 plan. Local labor agencies have the responsibility to organize guidance and support for factories, forestry, agricultural, and timber farms, stores, etc., on calculation methods and planning forms; especially supporting facilities that frequently employ many workers, those facing difficulties in planning such as Architecture, Transportation, Commerce, etc., and new facilities.
During the implementation process, if any issues arise or any problems are unclear, Ministries, sectors, and localities must promptly report to the Ministry of Labor for clarification or additional guidance.

Column 1.- Types of workers arranged by industry and profession such as: mechanical, architecture, transportation, surveying, geology, etc...
Column 2.- This quota has been approved by the State Planning Commission and ratified by the Government Council.
Column 3.- The training period for each type of worker varies; if necessary, clearly specify the training duration for each type of worker in months or years.
Column 4.- Within the total number of adjustments in the industry, clearly specify which forces are being adjusted: the number at construction sites, the number of military personnel transferring to other industries, overseas Vietnamese, Southern Vietnamese, the number outside the establishment, the number of ethnic minorities, etc...
