GUIDELINES FOR AMENDING AND SUPPLEMENTING CERTAIN POINTS OF CIRCULAR 07/LDTBXH DATED MAY 12, 1993

OF THE MINISTRY OF LABOR - SOCIAL AFFAIRS AND WAR INVALIDS

ON SUBSIDIES FOR HOUSEHOLDS GOING TO DEVELOP NEW ECONOMIC ZONES.

 

- Implementing Decision 327/CT dated September 15, 1992 of the Chairman of the Council of Ministers and Decision 773/TTg dated December 21, 1994 of the Prime Minister;

- Pursuant to Decree 96/CP dated December 7, 1993 of the Government.

After reaching consensus with the State Planning Commission and the Ministry of Finance on certain points of Circular 07/LDTBXH dated May 12, 1993 of the Ministry of Labor - Social Affairs and War Invalids which are no longer suitable for current reality after two years of implementation, the Ministry of Labor - Social Affairs and War Invalids issues guidelines for amending and supplementing certain points regarding subsidies for households going to develop new economic zones as follows:

I. Recipients of Subsidies:

The recipients of subsidies are households voluntarily going to build new economic zones in order to green barren hills, exploit coastal and river beaches, and surface waters to develop the economy and society, including:

1. Households going to build new economic zones that have been approved by competent authorities and included in annual investment plans according to the economic and social development programs of sectors and localities;

2. Households with the need to go to project areas through interlaced or self-arranged methods, agreed upon by the People's Committee of the district of departure and arrival, and granted residential land and production land by competent authorities;

3. Households within the area of land clearance for large construction projects such as water reservoirs, airports, industrial zones, ports, special economic zones, and coastal and river areas prone to landslides, who volunteer to migrate to new project areas;

4. Migration to stabilize border regions; building military villages and social villages;

5. Households consisting of forestry and plantation staff who voluntarily migrate to new project areas, settle down, receive production land, and live long-term according to the planning of forestry and plantation units;

6. Youth volunteers, soldiers, and defense workers who complete their service obligations and voluntarily establish themselves long-term in new project areas;

All of the above subjects must be within the annual migration plan assigned by the state.

Households moving to new project areas on islands shall enjoy subsidies according to Circular 04/LDTBXH-DD dated February 11, 1995 of the Ministry of Labor - Social Affairs and War Invalids on subsidies for households migrating to islands, and shall not enjoy the subsidy levels stipulated in this circular.

II. Subsidy System and Levels:

Each household with two or more laborers voluntarily going to build new economic zones according to the annual plan shall enjoy the following subsidy system:

1. Level of subsidy for households migrating:

1.1. From Northern to Southern region: General level is 5,200,000 VND per household

Where:

a) Departure location: 4,000,000 VND per household

b) Arrival location: 1,200,000 VND per household

1.2. Within the same region: General level: 3,400,000 VND per household

Where:

a) Departure location: 2,200,000 VND per household

b) Arrival location: 1,200,000 VND per household

1.3. Within the same province: General level: 2,700,000 VND per household

Where:

a) Departure location: 1,500,000 VND per household

b) Arrival location: 1,200,000 VND per household

1.4. Resettlement of residents within new economic zone areas (also known as population dispersal) with a relocation distance of 3 km or more involving land reclamation for expanded production or receiving forest planting land or protected forest land: General level is 800,000 VND per household

* The subsidy at the departure location as specified in points 1.1, 1.2, and 1.3 above shall be used for the following purposes:

Transportation costs for people and luggage, medical supplies for travel, travel expenses, purchase of production tools, support for house construction, and living water supply.

* The subsidy at the arrival location as specified in points 1.1, 1.2, and 1.3 above shall be used to support the purchase of food (400 kg of rice per household) for land reclamation and production in the first six months. The price of rice each year will be unified by the Ministry of Labor - Social Affairs and War Invalids and the Ministry of Finance for nationwide application (The price of rice in 1995 is calculated at 3,000 VND per kg).

2. Other provisions:

a. Households migrating to highland areas as currently defined by the state shall receive an additional 400,000 VND per household to cover additional relocation costs.

b. Households migrating to highland areas as currently defined by the state shall receive an additional 400,000 VND per household to cover additional relocation costs.

c. Households belonging to the category of "spontaneous migrants" who have settled outside the project area and now move into the project area shall be considered for a subsidy of 800,000 VND per household to reclaim and expand production areas within the project area.

d. Households that self-arrange under the interlaced method mentioned in point 2 of Section I, approved by the People's Committee of the district of departure and arrival, and granted residential and production land by competent authorities, shall only receive transportation subsidy:

Within the province: 500,000 VND per household

Within the region: 800,000 VND per household

North-South: 2,000,000 VND per household

3. Common expenses allocated to the implementing agencies:

- Internal regional migration, internal provincial migration: 150,000 VND per household

- North-South migration: 200,000 VND per household

- Common expenses for migration to islands shall be twice the corresponding levels in this circular.

The amount of common expenses shall be deducted from the migration affairs fund of programs 327, 773, and other migration programs to provide for the management and organizing agencies to use for the following purposes: Publicity and mobilization expenses; printing and distribution of forms and related documents for migration; inspection expenses; and road risk expenses.

This circular takes effect from July 1, 1995. Any difficulties encountered during implementation should be reported to the Ministry of Labor - Social Affairs and War Invalids for study and resolution./.
