CIRCULAR
Guidelines for managing and using training and capacity-building funds for state officials and civil servants.

Pursuant to Point 4, Article 4 of Decision 874/TTg dated November 20, 1996 of the Government Chairman on the training and capacity-building of state officials and civil servants.
To manage and use the state budget funds allocated for the training and capacity-building of state officials and civil servants for their intended purposes and effectively; following the comments from the Government Organizational and Cadre Board in Circular No. 36/TCCP-ĐT dated September 28, 1998, the Ministry of Finance hereby provides guidance as follows:
1/ General Provisions:
- Expenditures for the training and capacity-building of state officials and civil servants shall be included annually in the budget plans of ministries, sectors, provinces, and centrally-administered cities.
- Training and capacity-building funds for state officials and civil servants shall be used exclusively for direct training and capacity-building activities for those assigned to attend training according to the annual targets announced by the Government Organizational and Cadre Board. These funds shall not be used for administrative management costs of units. For ministries and sectors authorized by the Government to establish training centers responsible for training and capacity-building, the operational expenses shall be covered by the training funds of these ministries and localities.
2/ Content and Levels of Expenditure:
a/ Expenditures for the training and capacity-building of state officials and civil servants include:
+ Payment for lecturers' services (lecturers teaching additional hours, part-time lecturers from outside the school invited to teach), payment for foreign experts if approved by competent authorities.
The levels of expenditure are specified as follows:
- For lecturers who are Ministers, Deputy Ministers (and equivalent positions): 100,000 VND per session.
Professors, Doctors, Associate Doctors of centrally-managed schools: 80,000 VND per session.
- For lecturers from provincial-level schools and other categories: 60,000 VND per session.
+ Expenditures for trainees:
Subsidies for food and accommodation expenses at a rate of 10,000 VND per person per day for trainees residing in dormitories and whose distance from their workplace to the training location is 10 kilometers or more in mountainous areas, border regions, islands, and 20 kilometers or more in other regions.
Trainees attending training classes organized by their agencies shall be reimbursed for travel expenses (round trip) from their workplace to the training location according to current travel allowances; food expenses during training shall be borne by the trainees themselves (during concentrated training periods, trainees shall not receive lodging subsidies).
+ Expenditures for organizing training and capacity-building classes (ensuring accommodation, living facilities, arranging conference halls and classrooms for trainees, transportation expenses for lecturers, examination marking expenses).
+ Expenditures for purchasing textbooks and materials, preparing lecture notes directly serving the training program.
b) The organization of training and capacity-building for grassroots cadres at commune and ward levels, as stipulated in Point 3, Article 5 of Decision 874/TTg dated November 20, 1997, shall be undertaken by the Political Schools of provinces and centrally-administered cities.
The content of expenditures for cadre training classes at the commune and ward levels shall be applied similarly to the regulations for state officials and civil servants.
c) Expenditures for state officials and civil servants sent abroad for short-term study within the annual training and capacity-building plan approved by the Government; in the immediate term, due to limited budgetary resources, it is necessary to focus on providing basic knowledge training for state officials and civil servants at domestic institutions. If there is a need for overseas training, the cost of training state officials abroad shall be arranged by the agencies and units within the annual budget allocated to ministries, sectors, and localities.
3/ Budget Preparation, Execution, and Settlement of Training and Capacity-Building Funds for State Civil Servants:
- Annually, based on the planning and training programs for state officials and civil servants of ministries, sectors, central agencies, and localities, and the state budget balance capacity; the Government Organizational and Cadre Board shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance to allocate training and capacity-building targets for state officials and civil servants to ministries, central agencies, and localities. The preparation, execution, and settlement of training and capacity-building funds for state officials and civil servants shall be carried out in accordance with Circular 103/1998/TT-BTC dated July 18, 1998, issued by the Ministry of Finance on the guidelines for the decentralization, preparation, execution, and settlement of the state budget.
- The training and capacity-building funds for state officials and civil servants shall be detailedly recorded under Item 14 of the current state budget classification.
4/ Implementation:
- This Circular replaces Joint Circular No. 37/TT-LB dated April 24, 1994 of the Government Organizational and Cadre Board and the Ministry of Finance, and shall take effect 15 days after its issuance date.
- Ministers of ministries, ministerial-level agencies, central mass organizations, Chairmen of People's Committees of provinces, and centrally-administered cities shall be responsible for directing relevant functional agencies to manage and use these funds effectively.
- Agencies and units organizing training classes must ensure that expenditures are within the approved plan. The Government Organizational and Cadre Board shall coordinate with the Ministry of Planning and Investment to inspect the implementation of training and capacity-building plans and targets by units, and shall coordinate with the Ministry of Finance and Provincial Departments of Finance and Prices to inspect the expenditures for training and capacity-building of state officials and civil servants by units to ensure they are used for their intended purposes, in accordance with regulations, and effectively.
Any issues arising during implementation should be promptly reported to the Ministry of Finance for consideration and resolution./.
