OF THE PRIME MINISTER
Guidelines for implementing the decision regulating certain special allowances for civil servants and employees in the health sector
Implementation of Decision No. 794/TTg dated February 5, 1995 of the Prime Minister on certain special allowances for civil servants and employees in the Health Sector.
The Government's Organizational and Civil Service Department, the Ministry of Finance, and the Ministry of Health provide guidelines for implementing special allowances for civil servants and employees in the health sector as follows:
1. Surgical Allowance:
I. OBJECTS AND ALLOWANCE LEVELS:
Applies to civil servants and employees in the medical field directly engaged in surgical work.

- Anesthesiologists and primary anesthetists receive the same allowance as the main surgeon, while secondary anesthetists receive the same allowance as the assisting surgeon. |
- The temporary classification of surgical procedures shall be implemented according to Circular No. 21/BYT-TT dated July 28, 1981 of the Ministry of Health. The duration for Level I surgery is 3 hours, Level II is 2 hours, and Level III is 1 hour; For complex and difficult surgeries requiring highly specialized technical skills, each additional hour is counted as a Level I surgery.
2. On-call Allowance:
Applies to civil servants and employees in the medical field who must be on call outside regular working hours 24/7 (after completing the standard working day, they must be on call for the next 16 hours outside the standard working hours).
ALevels of allowance:
- 2.1.1. The allowance level of 7,000 VND per on-call shift applies to:
- Civil servants and employees in the health sector working at hospitals and institutes with Category 1 beds, tuberculosis hospitals, leprosy hospitals, mental hospitals.
- Civil servants and employees in the health sector working in departments such as surgery, obstetrics, pediatrics, infectious diseases, psychiatry, pathology, emergency care, (including the emergency care section in other departments) at hospitals and institutes with remaining beds and district and county health centers.
- Civil servants and employees in the health sector working at state-managed maternity homes.
- Civil servants and employees in the health sector who must be on duty to combat epidemics at healthcare facilities managed by the state during epidemic periods.
2.1.2. The allowance level of 5,000 VND per on-call shift applies to civil servants and employees in the health sector working at units not specified in point 2.1.1 above of hospitals, district and county health centers, institutes with beds, rehabilitation institutes, and regional multi-specialty clinics.
2.1.3. The allowance level of 3,000 VND applies to medical professionals working at grassroots health stations.
2.2. After an on-call shift, civil servants and employees in the health sector are entitled to a compensatory rest day and receive wages as stipulated in Clause 1 and Clause 2 of Article 61 of the Labor Code.
3. Epidemic Control Allowance:
Applies to civil servants and employees in the health sector directly involved in extinguishing disease outbreaks (including direct involvement and support in disease detection, treatment, environmental sanitation, food hygiene, containment, and implementation of measures to extinguish disease outbreaks).
- A- The allowance level of 12,000 VND applies to one day's actual work (8 hours) in extinguishing disease outbreaks.
II. SOURCES OF FUNDS AND METHODS OF PAYING ALLOWANCES:
1. The sources of funds for paying the allowances mentioned above shall be implemented according to the current budget management hierarchy.
- For surgical and on-call allowances, payment is made monthly.
Continuous duty, surgery, and procedure subsidies shall be paid monthly with each salary period.
- For epidemic control allowances, payment is made immediately after the outbreak is controlled.
1. Each year, healthcare facilities prepare plans to estimate the funds required for these allowances and report and aggregate them according to the annual budget planning process of the health sector.
III. IMPLEMENTATION:
2. Provincial and municipal government organizational bodies, provincial and municipal health departments, and provincial and municipal finance and price departments shall guide and inspect the implementation of this circular and report the results to the Joint Ministries.
This circular takes effect from January 1, 1996. All provisions contrary to this circular are abolished.
Any difficulties encountered during implementation should be reported to the Joint Ministries for study and resolution.
