PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital;
Considering the proposal of the People's Committee of Ba Ria-Vung Tau Province,
DECISION:
Article 1. Approves the Plan for Restructuring and Modernizing State-Owned Enterprises with 100% State Capital under the People's Committee of Ba Ria-Vung Tau Province for the period 2007-2010 as follows:
1. Convert into Limited Liability Companies with One Member (in 2009):
- Lottery Construction Company;
- Urban Drainage Company.
2. Implement shareholding reform:
a) In 2007:
- Urban Development and Construction Company;
- International Tourism Company;
- Trade and Service Company;
- Water Supply Limited Liability Company with One Member.
b) In 2008:
- Marine Transport Services Company;
- Transportation Infrastructure Company;
- Greenery Company;
- Tan Thanh District Urban Infrastructure Company;
- Xuyen Moc District Urban Infrastructure Company.
c) In 2009:
- Ba Ria City Urban Infrastructure Company;
- Vung Tau City Urban Infrastructure Company;
- Long Dien District Urban Infrastructure Company;
- Chau Duc District Urban Infrastructure Company.
Article 2
1. The Chairman of the People's Committee of Ba Ria-Vung Tau Province shall be responsible for:
a) Directing the implementation of the restructuring and modernization of state-owned enterprises directly under its jurisdiction in accordance with the approved content and schedule;
b) Deciding the proportion of shares held by the State when implementing shareholding reforms of the companies listed in Article 1 of this Decision based on the criteria and classification list for state-owned enterprises with 100% state capital issued together with Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister;
c) Developing a pilot shareholding reform plan for the Forestry Limited Liability Company with One Member, reporting it to the Ministry of Agriculture and Rural Development for review, and submitting it to the Prime Minister for approval.
2. The Ministries of Finance, Planning and Investment, Home Affairs, Labor, Invalids and Social Affairs, and related agencies shall be responsible for coordinating with the People's Committee of Ba Ria-Vung Tau Province in the implementation of this Decision.
3. The Steering Committee for Enterprise Reform and Development shall be responsible for directing, urging, guiding, and monitoring the implementation.
Article 3. This Decision takes effect from the date of issuance.
