Issued by the Issuance and Treasury Department

GOVERNOR OF THE STATE BANK OF VIETNAM

Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam No. 10/2003/QH11 dated June 17, 2003;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;

Pursuant to Decree No. 52/2003/ND-CP dated May 19, 2003, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Issuance and Treasury Department and the Head of the Cadre and Civil Servant Affairs Department;

After reaching agreement with the Minister of Internal Affairs,

DECISION:

Article 1. Issuing with this Decision the "Regulation on the Organization and Operation of the Issuance and Treasury Department".

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. The Decision number 380/1998/QĐ-NHNN dated November 14, 1998 issued by the Governor of the State Bank of Vietnam regarding the issuance of the Regulation on the Organization and Operation of the Issuance and Treasury Department and other previous regulations contrary to this Decision are hereby repealed.

Article 3. The Heads of the Office, the Cadre and Civil Servant Affairs Department, the Issuance and Treasury Department, and the Heads of relevant units under the State Bank of Vietnam are responsible for implementing this Decision./.

REGULATIONS

Organization and operation of the Issuance and Treasury Department

(Issued together with Decision No. 1536/2004/QĐ-NHNN

dated December 2, 2004 of the Governor of the State Bank of Vietnam)

PART I

GENERAL PROVISIONS

Article 1. The Issuance and Treasury Department is a unit within the organizational structure of the State Bank of Vietnam, assisting the Governor in performing state management functions and central bank functions in the field of issuance and treasury.

Article 2. The Issuance and Treasury Department has its own account and seal and is allocated operational funds according to the provisions of the law.

Article 3. The head of the Issuance and Treasury Department is the Director, who is assisted by several Deputy Directors; the Director and Deputy Directors are appointed by the Governor. The organization and operation of the Department are carried out according to the principle of democratic centralism and the chief executive system.

Chapter II

DUTIES AND POWERS OF

THE ISSUANCE AND TREASURY DEPARTMENT

Article 4. The Issuance and Treasury Department has the following duties and powers:

1. Drafting and submitting to the Governor draft regulatory documents within the scope of specialized management of the Department.

2. Organizing, directing, guiding, and implementing regulatory documents related to the fields of printing, minting, preserving, transporting money, issuance operations, recall, replacement, and destruction of money; issuing guidance documents for professional tasks within the scope of specialized management according to authority.

3. Monitoring, inspecting, compiling, evaluating, and reporting on the implementation of related documents; requesting relevant units to provide necessary materials, data, and information for the performance of their duties.

4. Drafting and submitting to the Governor projects and proposals for printing and minting new types of money not yet in circulation to supplement and replace money in circulation.

5. Advising and assisting the Governor in assessing samples of money and valuable securities proposed to be issued by the State Bank.

6. Drafting and submitting to the Governor annual and long-term plans for printing and minting money and commemorative money; coordinating with relevant units to implement after approval by the Governor.

7. Studying and proposing to the Governor for submission to the Prime Minister on:

a) The structure and denominations of new types of money to be issued;

b) The time of announcement for issuance, form of issuance, recall, and replacement of types of money discontinued from circulation.

8. Taking the lead and coordinating with relevant units to organize announcements through mass media on the policy of circulating new money and recalling money discontinued from circulation.

9. Organizing propaganda and guidance for agencies, economic and social organizations, and the public to use and protect Vietnamese currency.

10. Safeguarding the security of money not yet in circulation, money currently in circulation (including money not meeting circulation standards), sample money, commemorative money, discontinued money, gold, precious metals, gemstones, foreign currencies, valuable assets, and valuable securities stored at Central Treasury belonging to the management and preservation of the State Bank.

11. Organizing the circulation of cash to meet the demand for cash transactions in the economy.

12. Organizing the sale of sample money, commemorative money, and discontinued money according to the Governor's regulations.

13. Drafting plans for destroying torn, damaged, non-circulating standard money, discontinued money, counterfeit money, and destroyed money, submitting them to the Governor for approval and coordinating with relevant units to implement.

14. Taking the lead and coordinating with the Ministry of Public Security to protect the Central Treasury; organizing safe and secret transportation of money, valuable assets, and valuable securities from printing and minting factories, airports, ports, railway stations to treasuries under the State Bank system and vice versa; between treasuries under the State Bank system.

15. Coordinating with relevant sectors to promptly detect and handle according to the law acts of counterfeiting money; transporting, storing, circulating, buying, and selling counterfeit money; damaging currency or refusing to accept and circulate currency issued by the State Bank.

16. Organizing the authentication of counterfeit and suspected counterfeit money according to the law.

17. Drafting and submitting to the Governor plans for new construction, repair, renovation, and upgrading of Central Treasuries; coordinating with the Accounting and Finance Department and relevant units to implement after approval by the Governor.

Taking the lead and coordinating with the Accounting and Finance Department to assess technical proposals for new construction, repair, renovation, and upgrading of branch treasuries of provinces and centrally-administered cities submitted to the Governor for decision.

18. Implementing the recording of accounting and statistical books for various types of cash, gold, precious metals, gemstones, foreign currencies, and other assets stored at Central Treasuries.

19. Preparing financial plans for printing and minting money, destroying money, issuance management costs, and other related costs of the Issuance and Treasury Department and organizing their implementation upon approval by the Governor.

20. Performing state management functions in the field of import and export of goods under the specialized management of the State Bank according to the provisions of the law.

21. Managing finance, assets, and other resources assigned according to the provisions of the law.

22. Performing other tasks assigned by the Governor.

Chapter III

ORGANIZATIONAL STRUCTURE AND MANAGEMENT

Article 5. The organizational structure of the Issuance and Treasury Department includes:

1. Departments and equivalent units:

- General Department;

- Issuance Operations Department;

- Accounting and Financial Affairs and Cash Flow Adjustment Department;

- Treasury Management Department;

- Central Treasury in Hanoi (Treasury I);

- Vehicle Team;

- Money Destruction Unit.

Treasury I has its own seal for transactions.

The specific duties and powers of the units mentioned above shall be stipulated by the Director.

2. Subordinate units: Ho Chi Minh City Distribution and Treasury Branch (referred to as the Distribution and Treasury Branch).

The Distribution and Treasury Branch shall have its own account and seal for transactions.

The organizational structure of the Distribution and Treasury Branch includes:

- Administrative Department;

- Accounting and Financial Affairs Department;

- Central Cash Vault No. II in Ho Chi Minh City;

- Money Destruction Unit.

The management of the Distribution and Treasury Branch shall be carried out by the Branch Director who concurrently serves as the Head of the Cash Vault; the Deputy Branch Directors assist the Branch Director; the Branch Director and Deputy Branch Directors shall be appointed by the Governor. The specific duties and powers of the Branch shall be stipulated by the Director.

Article 6. Duties and Powers of the Director

1. Organize the implementation of functions and tasks as prescribed in Article 4 of this Regulation; bear responsibility before the Governor and the law for all aspects of the activities of the Bureau.

2. Decide on the work program and plan of the Bureau and apply necessary measures within his authority to fulfill assigned tasks.

3. Implement personnel management and utilization according to the classification and delegation of the Governor.

4. Sign administrative documents on behalf of the Governor within his authority.

5. Be authorized to sign and affix the Bureau's seal on directive and guidance documents related to the Bureau's functions and tasks.

6. Be authorized to sign printing and minting contracts, production and consumption contracts of commemorative currency of the State Bank.

Article 7. Duties and Powers of the Deputy Director

1. Assist the Director in organizing the implementation of the Bureau's functions and tasks; directly direct and manage certain aspects of work as assigned by the Director and bear responsibility before the Director and the law for the tasks assigned.

2. Be authorized to sign on behalf of the Director on administrative documents and directive and guidance documents of the Bureau as delegated by the Director.

3. When the Director is absent, a Deputy Director shall be authorized to manage and resolve the Bureau's affairs and bear responsibility for the matters resolved and must report back when the Director is present.

4. Carry out other tasks assigned by the Director.

Chapter IV

IMPLEMENTING PROVISIONS

Article 8. Amendments and supplements to the provisions of this Regulation shall be decided by the Governor of the State Bank. /.
