Pursuant to the Law on Organization of the Government dated September 30, 1992;
Pursuant to Decree No. 61/HĐBT dated June 16, 1983 of the Council of Ministers (now the Government) on the establishment of the Commendation and Reward Councils at all levels;
Pursuant to Decree No. 223/HĐBT dated December 8, 1987 of the Council of Ministers (now the Government) on the amendment of the organization responsible for commendation and reward work and changing the name of the Commendation and Reward Councils at all levels to the Commendation and Reward Council;
Implementing Directive No. 35-CT/TW dated June 3, 1998 of the Politburo on renewing the commendation and reward work in the new period;
At the proposal of the Director of the National Commendation and Reward Institute;
With the agreement of the Party committees and people's mass organizations,
DECISION:
Article 1. The National Commendation and Reward Council is now the Central Commendation and Reward Council; amending and supplementing the tasks and members of the Commendation and Reward Councils from central to grassroots levels to assist the Prime Minister, heads of sectors, and People's Committees at all levels in commendation and reward work.
Article 2. The Central Commendation and Reward Council has the following tasks:
1. - Implement coordination between state agencies and people's mass organizations in organizing patriotic emulation movements, ensuring that the movement develops strongly, widely, correctly, effectively according to the guidelines set by the Party and State for each period.
Summarize and analyze the practical situation of the movement, thereby proposing to the Government plans for organization, guidance, construction, and expansion of exemplary models.
2. - Propose to the State regarding the issuance or improvement, amendment, supplementation of policies, forms, and reward systems.
3. - Select individuals and collectives with outstanding achievements through the patriotic emulation movement for the Prime Minister to decide or for the Prime Minister to propose to the President to decide on awarding commendation titles: National Labor Hero, National Defense Hero, and other national honors.
Article 3. The composition of the Central Commendation and Reward Council includes:
- The Chairman of the Council is concurrently held by the Prime Minister.
- The Vice Chairmen of the Council include:
+ Deputy State President
+ Chairman of the Central Committee of the Vietnam Fatherland Front.
+ Chairman of the Vietnam General Confederation of Labor.
- The members of the Council include:
+ Director of the Office of the State President.
+ Director of the Office of the Government.
+ Deputy Head of the Central Committee for Ideology and Culture.
+ Deputy Head of the Central Committee for Mass Mobilization.
+ Deputy Chairman of the Vietnam Farmers' Union.
+ Secretary of the Central Youth League of Ho Chi Minh Communist Youth Union.
+ Deputy Chairman of the Vietnam Women's Union.
+ Director of the General Political Department of the Vietnam People's Army.
+ Director of the General Administration for Force Building of the Vietnam People's Public Security.
+ Director of the National Commendation and Reward Institute - serving as Secretary of the Council.
Depending on the content of each session of the Council, the Chairman of the Council will invite representatives with authority from other agencies and mass organizations at the central level to attend.
Article 4. The permanent office of the Central Commendation and Reward Council is the National Commendation and Reward Institute.
Article 5. The Council operates under a collective system and according to the operational regulations approved by the Council.
Members of the Council use their own machinery to perform the tasks assigned by the Council.
Article 6. The Commendation and Reward Councils of provinces and centrally-administered cities are chaired by the Chairman of the People's Committee of the province or city.
Based on specific circumstances and characteristics, the province or centrally-administered city decides other members of the Council and working regulations based on applying the structure and working regulations of the Central Commendation and Reward Council.
Article 7. The Commendation and Reward Councils of Ministries, ministerial-level agencies, and government-affiliated agencies are chaired by the Minister or head of those agencies.
The Chairman of the Trade Union of the sector (if any) or the Chairman of the Trade Union of the Ministry, ministerial-level agency, or government-affiliated agency serves as Vice Chairman, and members include heads of specialized units (organization and personnel, office, planning, labor and wages...) and other mass organizations (youth, women...).
The Head of the Department of Commendation and Reward of the Ministry, ministerial-level agency, or government-affiliated agency serves as a member - Secretary of the Council.
The Minister of National Defense and the Minister of Public Security shall take the lead in coordinating with the Director of the National Commendation and Reward Institute to unify the regulations on the composition of the Commendation and Reward Councils in accordance with the practical needs and specific requirements of the two Ministries.
Article 8. Ministers, heads of ministerial-level agencies, and government-affiliated agencies, Chairmen of the People's Committees of provinces and centrally-administered cities shall guide subordinate agencies and grassroots units to consolidate and improve the Commendation and Reward Councils to ensure their activities are truly effective, in accordance with the spirit of Directive No. 35-CT/TW of the Politburo on renewing the commendation and reward work in the new period.
Article 9. This Decision takes effect 15 days from the date of signature. All previous regulations contrary to this Decision are abolished.
Article 10. Ministers, heads of ministerial-level agencies, and government-affiliated agencies; Chairmen of the People's Committees of provinces and centrally-administered cities; Director of the National Commendation and Reward Institute are responsible for implementing this Decision. It is requested that central agencies of mass organizations appoint representatives to participate in the Council and guide subordinates to implement this Decision./.
