Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology, and Environment;

Pursuant to Decision No. 1167/QD-MTg dated July 3, 1995 of the Minister of Science, Technology, and Environment approving the design and budget estimate for the project to enhance environmental monitoring and analysis equipment for 53 provinces and cities;

At the proposal of the Heads of the Environment Department, the Director of the Planning and Finance Department of the Ministry of Science, Technology, and Environment, and the Directors of the Science, Technology, and Environment Departments of the provinces and cities,

Article 1. The Regulations on Management and Use of Environmental Monitoring and Analysis Equipment of the Environment Department located in Localities are hereby adopted.

Article 2. The Directors of the Science, Technology, and Environment Departments are assigned to develop specific internal regulations regarding the preservation and use of environmental monitoring and analysis equipment at the local level.

Article 3. The Heads of the Environment Department, the Director of the Planning and Finance Department of the Ministry of Science, Technology, and Environment, and the Directors of the Science, Technology, and Environment Departments of the provinces and cities are responsible for implementing this Decision.

REGULATIONS

MANAGEMENT AND USE OF ENVIRONMENTAL MONITORING AND ANALYSIS EQUIPMENT OF THE ENVIRONMENT DEPARTMENT LOCATED IN LOCALITIES

(Adopted along with Decision No. 1545-QD/MTg dated September 7, 1995)
4. The organizations and individuals proposed for selection are those with the highest ranked application files, but the average score must reach at least 70 out of 100 points, including a minimum average score of 50 out of 70 points for scientific and practical value.

These Regulations apply to equipment invested by the State for the Environment Department of the Ministry of Science, Technology, and Environment placed at the Science, Technology, and Environment Departments of the provinces and cities to serve state management of the environment and support local environmental management tasks.

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

Article 1. The equipment referred to herein is State property invested for the Environment Department and placed in localities.

Article 2. The equipment is used to conduct environmental monitoring and analysis of environmental components, providing information on quality indicators and the current status of the local environment according to the requirements of the Environment Department as well as local environmental management requirements.

Chapter II. METHODS OF USING EQUIPMENT

Article 1. Environmental monitoring and analysis equipment is used to perform tasks according to plans (regular and urgent) requested by the Environment Department of the Ministry of Science, Technology, and Environment and the local Science, Technology, and Environment Departments through the following methods:

- Regular environmental monitoring and analysis plans (monthly, quarterly, annually) assigned by the Environment Department.

- Contracts for urgent environmental monitoring and analysis tasks proposed by environmental protection management agencies and assigned by the Environment Department.

- Local environmental management tasks directed by provincial People's Committees, Science, Technology, and Environment Departments, and agreed upon by the Environment Department of the Ministry of Science, Technology, and Environment.

Article 2. Annually, the Science, Technology, and Environment Departments must prepare regular budgets to ensure that environmental monitoring and analysis equipment operates continuously. Depending on the research science budget capacity, the Environment Department will plan annual support and supplements.

Article 3. Local Science, Technology, and Environment Departments are permitted to use the equipment mentioned herein, while also having the obligation to mobilize additional equipment from the locality to implement environmental protection tasks assigned by provincial People's Committees and tasks delegated by the Ministry of Science, Technology, and Environment.

   Chapter III. MECHANISMS FOR USING AND MANAGING EQUIPMENT

Article 1. The Ministry of Science, Technology, and Environment assigns the right to manage and use these pieces of equipment to the Science, Technology, and Environment Departments.

Article 2. Central environmental monitoring and analysis equipment placed in localities can only be used for environmental protection tasks. Any changes in usage objectives, transfers, or liquidations must be carried out in accordance with current State asset management regulations and approved by the Ministry of Science, Technology, and Environment with the agreement of the locality.

Article 3. Local Science, Technology, and Environment Departments are responsible for preserving, maintaining, and periodically inspecting the condition of the aforementioned equipment and reporting to the Environment Department as required. In case of damage or loss, the Department must report to the Ministry of Science, Technology, and Environment to establish an appraisal board, evaluate, and assign responsibility according to current procedures.

Article 4. The Environment Department is responsible for coordinating with relevant agencies to organize periodic inspections of the condition and usage of the equipment to develop repair, maintenance, and supplementation plans to ensure effective operation of environmental monitoring and analysis equipment; coordinating with the Departments to conduct asset inventory according to the national plan.

Article 5. The Science, Technology, and Environment Departments are responsible for developing usage regulations and assigning staff with sufficient qualifications to operate and maintain the equipment, while planning to improve the skills of this team to continuously enhance the effectiveness of using the equipment.

 IV. IMPLEMENTATION PROVISIONS

These Regulations take effect from the date of issuance of the Decision.

The Heads of the Environment Department of the Ministry of Science, Technology, and Environment, and the Directors of the Science, Technology, and Environment Departments of the provinces are responsible for strictly implementing the provisions of these Regulations.
