Amending and Supplementing Certain Special Allowance Regimes for Civil Servants and Employees in the Health Sector
Decree No. 25/CP dated May 23, 1993 of the Government on the temporary regulations on salary regimes for civil servants, administrative and public service employees, and armed forces personnel;
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Amends and supplements certain special allowance regimes for civil servants and employees in the health sector as follows:
At the proposal of the Minister of Health, the Minister of Home Affairs, and the Minister of Finance,
DECISION:
Article 1. 1. The 24/24-hour on-call allowance regime:
a) The recipients of the allowance are civil servants, medical employees, and armed forces personnel performing 24-hour continuous professional on-call duty at hospitals, clinics, and communal health stations (referred to collectively as communal health stations).
b) The level of the on-call allowance in ordinary areas is calculated based on the average number of people per shift, with the following levels:
- VND 45,000/person/shift: applicable to Class I hospitals;
- VND 35,000/person/shift: applicable to Class II hospitals and Class I Traditional Medicine hospitals;
- VND 25,000/person/shift: applicable to Class III hospitals, Class II Traditional Medicine hospitals, and District Health Centers;
- VND 10,000/person/shift: applicable to on-call duty at communal health stations.
c) The on-call allowance level in emergency resuscitation and intensive care areas is 1.5 times the on-call allowance level in ordinary areas of hospitals of the same class.
d) The on-call allowance level on standard weekly rest days is 1.3 times the on-call allowance level on regular days; if on-call duty is performed on holidays or Tet, the allowance level is 1.8 times the regular day on-call allowance.
đ) The manpower quota for each 24/24-hour shift at hospitals and communal health stations is as follows:
- For Class II and III hospitals, Class I Traditional Medicine hospitals, and District Health Centers: 12 people/shift/100 beds;
- For Class I hospitals: 14 people/shift/100 beds;
- For communal health stations: 01 person/shift/station for plains communes with over 8,000 residents and mountain, border, and island communes with up to 3,000 residents; 02 people/shift/station for plains communes with more than 8,000 residents and mountain, border, and island communes with more than 3,000 residents.
e) Compensatory leave after a shift: civil servants and employees performing 24/24-hour continuous professional on-call duty on regular days or weekly rest days shall be granted one day off; if on-call duty is performed on holidays or Tet, they shall be granted two days off and shall receive full pay.
2. Epidemic control allowance regime:
a) Civil servants and employees directly participating in epidemic suppression shall receive an epidemic control allowance, which is calculated based on the actual number of days participated as follows:
- VND 60,000/day/person: applicable to highly dangerous epidemics;
- VND 30,000/day/person: applicable to other types of epidemics.
b) Civil servants and employees on 24/24-hour continuous duty in epidemic control at state-managed healthcare facilities in epidemic zones shall also receive an on-call allowance at a unified rate of VND 40,000/person/shift.
3. Surgical and procedural allowance regime:
Applies to civil servants and employees directly performing surgeries and procedures.
a) The allowance level for each type of surgery is specified as follows:

b) Cases where surgery was previously required but now converted to a procedure shall receive an allowance equal to one-third of the surgery allowance for the same type. |

The funding for implementing the special allowances for civil servants and employees in the health sector shall be allocated from the annual state budget estimates assigned to ministries, central agencies, localities, and the revenue of the units.
Article 2. Specifically for the year 2003:
- Ministries and central agencies shall allocate within their assigned budget estimates to implement the special allowance regimes.
- Provinces and centrally-administered cities shall allocate funds within their assigned budget estimates to implement the epidemic control allowance and surgical/procedural allowance regimes.
As for the 24/24-hour on-call allowance: The Ministry of Finance will supplement from the central government's contingency fund for the year 2003 to localities to implement according to the principle:
+ Self-balancing to implement the regime for provinces with a high proportion of revenue transferred to the central government.
+ Central government support: 100% for provinces with extremely difficult socio-economic conditions, the Central Highlands provinces, and communes under Program 135; 80% for mountainous provinces, counties, and communes; and 60% for the remaining regions for the difference between the total funding required to implement the regime stipulated in this decision and the funding already allocated in the local budget.
The Minister of Health is responsible for specifying the list of highly dangerous epidemics; the list of surgeries and procedures eligible for allowances.
Article 3. This Decision shall take effect from July 1, 2003, replacing Decision No. 794/TTg dated December 5, 1995, and replacing Article 1 of Decision No. 97/2001/QĐ-TTg dated June 26, 2001 of the Prime Minister regarding certain special allowance regimes for civil servants and employees in the health sector.
Article 4. The Ministry of Health shall lead and coordinate with the Ministries of Home Affairs and Finance to guide the implementation of this Decision.
Article 5. The Ministry of Health shall take the lead and coordinate with the Ministries of Home Affairs and Finance to be responsible for guiding the implementation of this Decision.
Article 6. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
