Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 76/2004/QĐ-TTg dated May 6, 2004 of the Prime Minister approving the orientation for housing development until 2020;
Considering the proposal of the Minister of Education and Training at Report No. 2600/KHTV dated April 6, 2005 regarding the request to approve the Plan to address accommodation for university and college students until 2010,
DECISION:
Article 1. Approve the Plan to address accommodation for university and college students until 2010 (hereinafter referred to as student dormitories) with the following main contents:
1. The objectives of the plan: strive to ensure accommodation for about 60% of the total number of long-term concentrated students from universities and colleges who have the need to live on campus by the end of 2010, with an average living area of approximately 3 m2/1 student.
2. Management agency of the plan: Ministry of Education and Training.
3. Implementation agencies of the plan: Ministries, sectors, People's Committees of provinces and centrally-run cities having universities and colleges; universities and colleges.
4. Development orientation:
a) Construction of student dormitories must ensure all necessary conditions to meet the needs of living and studying of students.
The scale and location of construction of student dormitories must be consistent with the development planning of each school, with the network planning of universities and colleges, and in accordance with the approved urban planning and land use plans of provinces and centrally-run cities.
b) Investors in the construction and management of student dormitories include:
- Schools.
- Enterprises, private individuals.
Encourage investors from various economic sectors to participate in the construction and management of student dormitories.
c) State budget support mainly focuses on the construction of student dormitories for teacher training schools, schools in remote areas, and schools in regions with difficult socio-economic conditions (Central Highlands, Northern Mountains, Mekong Delta).
d) Planning for the construction of student dormitories must be comprehensive, including accommodation, study, sports, entertainment facilities to create a healthy educational cultural environment.
đ) Strengthen the management of student dormitories.
5. Scale of construction and sources of funding for the implementation of the plan:
a) Scale of construction: the total area of new student dormitories to be constructed is approximately 970,000 m2; the area of existing student dormitories to be renovated and upgraded is approximately 730,000 m2.
Total investment amount is approximately: 35,000 billion VND
Where:
- Renovation and upgrading funds for existing student dormitories: 6,400 billion VND
- Construction funds for new student dormitories: 19,600 billion VND
- Welfare and service facilities such as cafeterias, clubs, infrastructure, etc.: 9,000 billion VND
b) Sources of investment include:
- State budget.
- Local investment.
- Loans from the Housing Development Fund.
- Investment by enterprises and private individuals.
- Operating and research funds from schools.
- Mobilization from organizations and individuals both domestically and internationally.
- Aid from countries and international organizations.
- Other legitimate sources of capital.
6. Mechanism for balancing state budget funds to implement the Plan:
- The state budget (including program target funding and centralized basic construction investment funding) guarantees between 40% and 50%, which will be allocated to the Plan in the annual national plan.
- The central government allocates investment or supports projects belonging to universities and colleges managed by central ministries and sectors.
- Local budgets allocate investment funds for projects belonging to universities and colleges managed by localities.
7. Implementation period: from 2005 to 2010.
- From 2005 to 2007: prioritize investment in constructing student dormitories for key universities, regional universities, teacher training schools; universities and colleges in regions with difficult socio-economic conditions (Northern Mountains, Central Highlands, Mekong Delta).
- From 2008 to 2010: continue to construct student dormitories for remaining universities and colleges in the Plan.
8. Implementation method of the plan: implemented according to the Law on Construction and current regulations of the State on investment management and construction.
Article 2. Preferential policies and mechanisms.
The Plan to address accommodation for university and college students shall enjoy the following preferential policies:
1. For land to build student dormitories: no land use fee shall be charged; tax exemption on land use; assistance in compensation costs when transferring land.
2. Mobilize capital from the central and local housing development funds and credit institutions to construct student dormitories in accordance with regulations.
3. Consideration for inclusion in the list of credit investment projects of the State according to regulations.
4. Investment and construction activities for student dormitories shall be subject to the highest tax incentives as stipulated by tax laws.
Article 3. Implementing organization.
1. The Ministry of Education and Training shall establish a Steering Committee to implement the plan, take the lead in coordinating with relevant ministries, sectors, provincial and municipal people's committees to organize the implementation and report periodically to the Prime Minister on the progress of implementing the Plan; coordinate with the Ministry of Construction to unify the issuance of some design models for student dormitories to be applied in universities and colleges; take the lead in coordinating with the Ministry of Home Affairs, the Ministry of Public Security, the Communist Youth Union Central Committee, and provincial and municipal people's committees to study and issue management mechanisms for student dormitories and preferential provisions for accommodation for students in difficult circumstances.
2. The Ministry of Planning and Investment:
a) Take the lead in coordinating with the Ministry of Education and Training and related agencies to submit to the Government before September 30, 2005, proposals to supplement investment projects for renovation and new construction of student dormitories into the List of industries and professions under the fields entitled to investment incentives issued together with Decree No. 35/2002/NĐ-CP dated March 29, 2002 amending and supplementing Appendix A, B, C issued together with Decree No. 51/1999/NĐ-CP dated July 8, 1999 of the Government detailing the implementation of the Law on Encouraging Domestic Investment.
b) Chair and coordinate with the Ministry of Finance and the Ministry of Education and Training to compile the annual investment plan for building student dormitories of ministries, sectors, and localities; propose capital allocation appropriate to the budget's ability to invest according to the Program; submit to the competent authority for approval in accordance with current regulations.
3. The Ministry of Finance shall chair:
a) Coordinate with the Ministry of Education and Training and relevant agencies to submit to the Government before September 30, 2005, the inclusion of projects for renovation and new construction of student dormitories into:
- The list of industries and fields eligible for investment incentives issued together with Decree No. 164/2003/NĐ-CP dated December 22, 2003, of the Government detailing the implementation of the Law on Corporate Income Tax.
- The list of projects and programs for loan investment issued together with Decree No. 106/2004/NĐ-CP dated April 1, 2004, of the Government on state investment credit for development.
b) Guide tax incentives for investment in building student dormitories.
4. The Ministry of Construction shall chair and coordinate with the Ministry of Education and Training to issue some model designs for student dormitory areas, including housing models suitable for different types of schools, customs, traditions, and socio-economic conditions of each locality.
5. Provincial People's Committees (local People's Committees) shall be responsible for:
a) Planning and allocating land funds to meet the needs for constructing student dormitories for universities and colleges located within their jurisdictions.
b) Creating favorable conditions and ensuring sufficient capital requirements to implement the student dormitory construction program for universities and colleges under their management and carrying out state administration in accordance with applicable regulations.
c) Establishing mechanisms that are appropriate for projects under their jurisdiction to mobilize legitimate sources of funding for student dormitory construction.
d) Coordinating with universities and colleges and related agencies to manage resident students in student dormitories and those living in rented accommodation.
6. Universities and colleges (schools) shall be responsible for developing plans for student accommodation; preparing projects managed by the school, submitting them to the competent authority for approval, and implementing them according to the plan and the current State regulations on investment and construction management.
7. Provincial People's Committees and schools with approved projects for renovation, upgrading, and new construction of student dormitories shall be responsible for publicly announcing the construction planning; at the same time, concretizing state incentive policies, specific local or school conditions tied to each project to facilitate investment by all economic sectors in building student dormitories.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees, and related agencies shall be responsible for implementing this Decision.
