PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Post and Telecommunications Ordinance dated May 25, 2002;
Pursuant to the Pricing Ordinance dated April 26, 2002;
Pursuant to Decree No. 170/2003/NĐ-CP dated December 25, 2003 of the Government detailing certain provisions of the Pricing Ordinance; and Decree No. 75/2008/NĐ-CP dated June 9, 2008 of the Government amending and supplementing certain provisions of Decree No. 170/2003/NĐ-CP dated December 25, 2003 of the Government detailing certain provisions of the Pricing Ordinance;
Considering the proposal of the Minister of Information and Communications.
DECISION:
Article 1. Approves the plan to adjust the rates for fixed-line local call services with the following main contents:
I. PERIOD 2009 - 2010:
1. Basic package:
a) Scope of application: Fixed-line local call services at subscribers' premises (irrespective of technology and payment method) provided by all enterprises providing fixed-line local call services.
b) Implementation time: From January 1, 2009.
c) Local call rate area: Administrative boundaries of provinces and centrally governed cities.
d) Local call rate:
Monthly subscription fee: 20,000 VND/month or 635 VND/day.
Connection charge: 200 VND/minute.
The above rates do not include value-added tax.
e) Billing method: 1 minute + 1 minute
f) Management form: The Ministry of Information and Communications issues a decision on the basic package of fixed-line local call services.
2. Other packages:
a) Scope of application: Fixed-line local call services at public transaction points; fixed-line local call services for large customers, enterprises, resellers, and other fixed-line local call services as prescribed by the Ministry of Information and Communications.
b) Implementation time: From January 1, 2009.
c) Local call rate area: Administrative boundaries of provinces and centrally governed cities.
d) Local call rate: determined by enterprises but shall not differ more than 50% from the basic package.
e) Billing method: determined by enterprises
f) Management form: enterprises register their rates with the Ministry of Information and Communications as prescribed.
II. PERIOD AFTER 2010:
1. Basic package:
a) Scope of application: Fixed-line local call services at subscribers' premises (irrespective of technology and payment method) provided by all enterprises providing fixed-line local call services.
b) Implementation time: From January 1, 2011.
c) Local call rate area: Administrative boundaries of provinces and centrally governed cities.
d) Local call rate: determined by enterprises based on the price range or ceiling price index (CPI) set by the Ministry of Information and Communications.
e) Billing method: determined by enterprises.
f) Management form: enterprises register their rates with the Ministry of Information and Communications as prescribed.
2. Other packages:
a) Scope of application: Fixed-line local call services at public transaction points; fixed-line local call services for large customers, enterprises, resellers, and other fixed-line local call services as prescribed by the Ministry of Information and Communications.
b) Implementation time: From January 1, 2011.
c) Local call rate area: Administrative boundaries of provinces and centrally governed cities.
d) Local call rate: determined by enterprises but shall not differ more than 50% from the basic package.
f) Billing method: determined by enterprises.
f) Management form: enterprises notify their rates to the Ministry of Information and Communications as prescribed.
Article 2. The Ministry of Information and Communications directs and guides the implementation of this Decision; establishes specific criteria for types of fixed-line local call services within the scope of application; builds, issues, and guides the management of rates according to the price range or ceiling price index (CPI).
Article 3. This Decision takes effect 15 days after its publication in the Official Gazette. Decree No. 809/2000/QĐ-TCBĐ dated September 15, 2000 of the General Post Office on the issuance of fixed-line telephone subscription fees and local call connection charges at subscribers' premises and other regulations contrary to this Decision are hereby abolished.
Article 4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Councils, Chairmen of management boards, General Directors, Directors of enterprises providing fixed-line local call services, and Heads of related agencies are responsible for implementing this Decision./.
