Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Land Law dated November 26, 2003;
Considering the proposal of the Ministry of National Defense, the Ministry of Foreign Affairs, the People's Committee of Ho Chi Minh City, and the People's Committee of Binh Duong Province.

Article 1. Agree to change the purpose of using 58 hectares of land in the Bình An Cemetery area, Dĩ An District, Binh Duong Province, managed by Military Region 7 under the Ministry of National Defense, for civilian use to develop the economy and society of Binh Duong Province.
Article 2. Entrust the Chairman of the People's Committee of Binh Duong Province:
1. To issue a decision to reclaim the land (in December 2006) and manage and use the land area specified in Article 1 of this Decision in accordance with the provisions of the law.
2. To direct the management of the Bình An Cemetery in the usual manner as other cemeteries according to the provisions of the law.
Article 3. Entrust the People's Committee of Ho Chi Minh City to take the lead in coordinating with the Ministry of National Defense regarding the location, area of land, and decision on allocating land to military units stationed in the Bình An Cemetery area, Dĩ An District, Binh Duong Province (under Military Region 7 of the Ministry of National Defense) for construction of barracks and defense works at new locations.
Article 4. The Ministry of National Defense (Military Region 7) shall implement the relocation of military units currently stationed in the Bình An Cemetery area, Dĩ An District, Binh Duong Province, to new locations to hand over the entire land area specified in Article 1 of this Decision to Binh Duong Province and accompanying documents. This will be completed by July 2007.
Article 5. The Ministry of National Defense, the People's Committee of Ho Chi Minh City, and the People's Committee of Binh Duong Province shall adjust the land use planning within their jurisdiction, and submit it to the Government for approval.
Article 6. Entrust the Ministry of Finance to propose financial support for the Ministry of National Defense to implement the contents specified in Articles 3 and 4 of this Decision, and submit it to the Prime Minister for consideration and decision.
Article 7. Request relevant Ministries, the People's Committee of Ho Chi Minh City, and the People's Committee of Binh Duong Province to urgently and closely cooperate to implement the contents of this Decision. Report the results of implementation to the Prime Minister before July 30, 2007.
Article 8. This Decision shall take effect from the date of signing.
The Ministers of the Ministries of National Defense, Finance, Natural Resources and Environment, the Chairman of the People's Committee of Ho Chi Minh City, the Chairman of the People's Committee of Binh Duong Province, and heads of related agencies are responsible for enforcing this Decision./.
