Decree No. 157/2024/NĐ-CP amends and supplements some articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance.

DECREE

Amending and supplementing certain Articles of Decree No. 105/2015/NĐ-CPdated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance

Pursuant to the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration Organization dated November 22, 2019;

Pursuant to the Environmental Police Ordinance dated December 23, 2014;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government promulgates this Decree amending and supplementing certain Articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance.

Article 1. Amending and supplementing certain Articles of Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance

1. Amending and supplementing Clause 3 of Article 6 as follows:

"3. Authority to request provision of information, documents, objects; to request explanation regarding acts suspected of criminal offenses or administrative violations:

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) County-level Public Security Chief."

2. Amending and supplementing Clause 2 Article 7 as follows:

"2. Authority to issue inspection decisions:"

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) County-level Public Security Chief."

3. Amending and supplementing Clause 2 of Article 8 as follows:

"2. Authority to issue inspection decisions:"

a) Director of the Environmental Crime Prevention and Control Police Bureau;

b) Provincial Public Security Director;

c) Head of the Provincial Public Security Department's Anti-Corruption, Economic, Smuggling, and Environmental Crime Investigation Division;

d) County-level Public Security Chief."

4. Amending Clause 1 of Article 10 as follows:

"1. The authorities specified in Clause 3 of Article 6; Clause 2 of Article 7; and Clause 2 of Article 8 of this Decree may delegate their authority to their deputies."

Article 2. Replacing and abolishing certain terms, phrases, clauses, and articles in Decree No. 105/2015/NĐ-CP dated October 20, 2015 of the Government detailing the implementation of certain provisions of the Environmental Police Ordinance

1. Replace certain phrases as follows:

a) Replacing the phrase "Environmental Police force" with the phrase "Environmental Crime Prevention and Control Police force" in Article 1; Clauses 3 and 4 of Article 12; Point b of Clause 1 of Article 14; Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 14; Point b of Clause 9 of Article 14; Point c of Clause 10 of Article 14; Clause 1 of Article 15; Clauses 1 and 3 of Article 16; Clause 2 of Article 18.

b) Replacing the term "Environmental Police" with the phrase "Environmental Crime Prevention and Control Police force" in Article 2; Title Chapter II; Article 4; Article 5; Clause 1 of Article 6; Clause 1 of Article 7; Clause 1 of Article 8; Clause 1 of Article 9; Clause 1 of Article 11; Clause 10 of Article 13; Point a of Clause 2 of Article 14; Title Chapter IV; Clauses 1 and 2 of Article 15; Title Article 16; Clause 2 of Article 16; Clauses 1 and 2 of Article 17; Title Article 18; Points a and c of Clause 1 of Article 18; Clause 2 of Article 18.

2. Abolishing Clause 2 of Article 9.

This Decree takes effect from December 20, 2024.
