Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Considering the proposal of the Organization and Cadre Affairs Department Director and the Complaint Resolution, Prosecution, and Inspection Region 3 Bureau Director,

DECISION:

Article 1. This Decision promulgates the "Regulations on the functions, tasks, powers, organization, and activities of the Agency for Handling Complaints and Prosecutions and Inspection Region 3" attached hereto.

Article 2. This Decision takes effect from the date of signing and replaces Decision No. 699/QĐ-TTCP dated April 10, 2007 of the General Inspector promulgating temporary regulations on the functions, tasks, powers, and organizational structure of Department V (now the Region 3 Bureau).

Article 3. The Office Director, Organization and Cadre Affairs Department Director, Complaint Resolution, Prosecution, and Inspection Region 3 Bureau Director (Region 3 Bureau), Heads of units under the Government Inspectorate shall be responsible for implementing this Decision./.

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE COMPLAINT RESOLUTION, PROSECUTION, AND INSPECTION REGION 3 BUREAU
(Issued together with Decision No.: 1575/2008/QĐ-TTCP dated August 6, 2008 of the General Inspector)

Chapter I.

FUNCTIONS, TASKS, POWERS, AND PRINCIPLES OF OPERATION

Article 1. Position and Functions

The Complaint Resolution, Prosecution, and Inspection Region 3 Bureau (hereinafter referred to as Region 3 Bureau) is an entity under the Government Inspectorate, assisting the General Inspector in managing state administration regarding complaint resolution, prosecution, and inspection work in Region 3, comprising 20 provinces and centrally governed cities: Binh Thuan, Dong Nai, Binh Phuoc, Tay Ninh, Binh Duong, Ba Ria-Vung Tau, Ho Chi Minh City, Long An, Tien Giang, Ben Tre, Dong Thap, An Giang, Vinh Long, Tra Vinh, Can Tho, Hau Giang, Soc Trang, Kien Giang, Bac Lieu, Ca Mau; it has the responsibility to carry out complaint resolution, prosecution, and inspection tasks within its jurisdiction; it leads coordination in receiving citizens and manages and directs operational activities at the Central Party and State Citizen Reception Office in Ho Chi Minh City; ensuring and serving the leadership of the Government Inspectorate and inspection teams of the Government Inspectorate when working in the southern region.

The Region 3 Bureau has its headquarters in Ho Chi Minh City, having separate bank accounts and seals for transactions in accordance with the law.

Article 2. Tasks and Authorities

1. Implementing state management functions:

a) Leading or participating in building proposals, strategies, programs, annual plans, and other programs and plans concerning inspection, complaint resolution, prosecution, and anti-corruption work of the Government Inspectorate;

b) Cooperating with other Bureaus, Departments, and units under the Government Inspectorate to draft legal documents on inspection, complaint resolution, prosecution, and citizen reception for submission to the General Inspector;

c) Assisting the General Inspector in guiding the provinces and centrally governed cities in Region 3 to build and implement inspection programs and plans; directing and guiding professional and technical work in inspection, complaint resolution, prosecution, and citizen reception for provincial inspectors assigned by the Government Inspectorate;

d) Assisting the General Inspector in urging the Chairpersons of People's Committees of provinces and centrally governed cities in Region 3 to conduct inspections of matters within their administrative responsibilities; resolving issues that have not been agreed upon between the Inspectors of provinces and centrally governed cities in Region 3 and the Chairpersons of People's Committees at the same level regarding inspection, complaint resolution, and prosecution work;

đ) Advising the General Inspector to examine and recommend the Prime Minister to suspend or revoke regulations issued by People's Committees and their Chairpersons in Region 3 that contravene national laws and regulations and those of the General Inspector on inspection, complaint resolution, prosecution, and citizen reception;

e) Assisting the General Inspector in conducting inspections and audits of the responsibilities of the Chairpersons of People's Committees of provinces and centrally governed cities in Region 3 in implementing laws and regulations on inspection, complaint resolution, prosecution, and citizen reception;

f) Cooperating with provincial inspectors in Region 3 to monitor the situation of inspections, complaint resolution, and prosecution, and promptly proposing solutions to the General Inspector when there are signs of complex issues arising;

g) Cooperating with the Legal Affairs Department to provide opinions on draft laws initiated by the Government Inspectorate or other ministries and sectors;

h) Summarizing practical experience; participating in theoretical and professional research, and proposing amendments and supplements to improve mechanisms, policies, and laws on inspection, complaint resolution, prosecution, and citizen reception.

2. Directly inspecting and resolving complaints and prosecutions:

a) Implementing the annual inspection and complaint resolution plan after approval by the General Inspector; directly conducting inspections of the implementation of policies, laws, and tasks of the Chairpersons of People's Committees of provinces and centrally governed cities in Region 3 according to the plan or other inspections assigned by the General Inspector;

b) Assisting the General Inspector in verifying and resolving complaints and prosecutions arising in Region 3 in accordance with the law;

c) Organizing, monitoring, and inspecting the activities of inspection and complaint resolution teams led by the Bureau or its staff;

d) Monitoring, urging, and inspecting the implementation of conclusions, recommendations, and decisions on inspections, complaint resolutions, and prosecutions issued by the Government Inspectorate and the Prime Minister in the assigned area.

3. Regarding citizen reception:

a) Leading coordination with relevant agencies in receiving citizens who come to complain, prosecute, propose, and reflect issues at the Central Party and State Citizen Reception Office in Ho Chi Minh City; preparing necessary conditions and contents and arranging schedules for citizen reception when requested by the leadership of the Government Inspectorate; performing the responsibilities stipulated in Article 10 of the Regulation on Citizen Reception issued together with Decree 89/CP dated August 7, 1997 of the Government.

b) Cooperate closely with the leaders of provinces and centrally governed cities to receive citizens when necessary at the Central Party and State Citizen Reception Office in Ho Chi Minh City;

c) Receive citizens who come to lodge complaints, file accusations, reflect opinions, or make suggestions; guide citizens on exercising their rights and fulfilling their obligations in lodging complaints and filing accusations according to the provisions of the law; propose solutions to the General Inspector for complex issues arising during citizen reception for complaints and accusations; coordinate with the Government Inspectorate's Office to handle letters within the jurisdiction of the General Inspector;

d) Monitor, compile statistics, and report to the General Inspector the results of citizen reception;

đ) During the process of receiving citizens at the Central Party and State Citizen Reception Office in Ho Chi Minh City, the Bureau may use the seal of the Citizen Reception Office to guide citizens on exercising their rights and fulfilling their obligations in lodging complaints and filing accusations according to the provisions of the law.

4. Carry out administrative reform tasks, international cooperation, and scientific research as assigned by the General Inspector;

5. Summarize and report to the General Inspector the results of inspection work, complaint resolution, accusation handling, and other tasks within its assigned functions and responsibilities as stipulated by the Government Inspectorate;

6. Ensure material resources, means, and other necessary conditions to serve conferences, seminars, and to support the leadership of the Government Inspectorate and inspection teams of the Government Inspectorate in southern provinces;

7. Manage cadres, civil servants, files, documents, seals, assets, and funds allocated according to the law and regulations set by the General Inspector;

8. Perform other tasks assigned by the General Inspector;

Article 3. Principles of Operation

1. The Bureau III operates under the head system, ensuring democratic centralism, transparency, and openness as prescribed by law; emphasizing individual responsibility and discipline, promoting the capabilities, strengths, initiative, and creativity of all cadres and civil servants, and enhancing the effectiveness of the Bureau's activities;

2. Cadres and civil servants of the Bureau must also comply with the "Regulations on Organization and Operation of Inspection Teams" issued by the General Inspector when participating in inspection teams, complaint resolution, and accusation handling;

Chapter II.

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 4. Organizational Structure and Staffing

1. The organizational structure of Bureau III includes:

a) Bureau leadership consists of a Director and Deputy Directors;

b) Units directly under the Bureau include:

+ Administrative and Consolidation Department;

+ Citizen Reception Department;

+ Complaint and Accusation Resolution and Inspection 1 Department;

+ Complaint and Accusation Resolution and Inspection 2 Department;

+ Complaint and Accusation Resolution and Inspection 3 Department;

2. The duties and powers of each department are defined by the Director of Bureau III;

3. The staffing of the Bureau is determined by the General Inspector based on the proposal of the Personnel Department Head and the Director of Bureau III;

Article 5. Responsibilities and Scope of Work of the Bureau Director

1. Lead, direct, and organize the implementation of the Bureau's tasks as stipulated in Article 2 of this Regulation and other tasks assigned by the Government Inspectorate leadership; bear legal responsibility before the law and the General Inspector for the results of the assigned tasks;

2. Assign and supervise the performance of tasks by Deputy Directors, heads of subordinate units, and cadres and civil servants within the Bureau;

3. Direct the drafting of inspection plans, complaint and accusation resolution programs; coordinate with the Personnel Department Head to arrange personnel for inspection teams and complaint and accusation resolution teams organized by the Bureau; personally lead large-scale inspections with complex contents when assigned by the General Inspector;

4. Monitor, urge, and inspect the activities of inspection teams assigned to the Bureau to ensure compliance with approved plans and schedules; participate in the review and comment on reports and inspection conclusions of teams led by the Bureau or by Bureau staff before submitting them to the General Inspector;

5. Be responsible for managing the Central Party and State Citizen Reception Office in Ho Chi Minh City as assigned by the General Inspector;

6. Coordinate with the heads of other units under the Government Inspectorate to handle issues related to the Bureau's functions and tasks and to perform common agency tasks as prescribed in the Government Inspectorate's Working Regulations;

7. Manage cadres and civil servants under the Bureau according to the law and the General Inspector's delegation; maintain work discipline, manage, evaluate, and implement commendation and reward policies for Bureau cadres and civil servants; develop and implement cadre planning and training programs for Bureau cadres and civil servants;

8. Serve as the Bureau's account holder; be responsible for managing and using the Bureau's seal and the Central Party and State Citizen Reception Office's seal in Ho Chi Minh City; manage and use assets effectively;

9. Carry out tasks delegated by the General Inspector to resolve; sign delegated orders for certain documents within the General Inspector's authority as stipulated in the Government Inspectorate's Working Regulations. Sign documents: introducing and appointing survey teams to grasp situations in localities in region 3, relevant agencies and organizations to serve the construction of inspection programs and plans; urging the implementation of inspection conclusions; exchanging professional knowledge with local inspectors in region 3; internal management and operation documents of the Bureau;

10. Implement information and reporting systems as prescribed by the Government Inspectorate. Report promptly to the Government Inspectorate leadership on the results of tasks and work, and propose issues that need to be resolved, mechanisms, programs, and plans that require modification and supplementation to meet the requirements of the Government Inspectorate's tasks;

11. Perform other tasks assigned by the General Inspector.

Article 6. Responsibilities and Scope of Work for Deputy Director

1. Assist the Director in managing and directing the work of the Bureau; directly manage and oversee certain localities and areas of work as assigned by the Director. When necessary, a Deputy Director may be authorized by the Director to direct the activities of the Bureau.

2. Perform duties and exercise powers within the scope assigned and delegated by the Director. Report to the Director on the situation and results of the assigned tasks.

3. Assist the Director in monitoring, urging, and inspecting the activities of inspection and complaint resolution teams when assigned by the Director. Directly serve as the Head of Inspection Team when appointed by the Chief Inspector General.

4. Personally bear responsibility before the Director, before the leadership of the Government Inspectorate, and before the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

5. Sign on behalf of the Director for documents assigned and delegated by the Director.

Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department

1. The Department Head is responsible for leading, directing, managing, and operating the Department's activities and bears responsibility before the Director and the law for all activities of the Department and the fulfillment of assigned tasks.

2. The Deputy Department Head assists the Department Head and bears responsibility before the Department Head, Bureau leadership, and the law for the assigned area of work; performs other tasks directly assigned by Bureau leadership. When necessary, the Department Head may authorize the Deputy Department Head to direct the Department's activities.

3. Specific duties and powers of the Department Heads and Deputy Department Heads under Bureau III shall be stipulated by the Director.

Article 8. Responsibilities and Scope of Work for Staff Members of Bureau III

1. Adhere to labor discipline, regulations of the Government Inspectorate, and Bureau rules.

2. Proactively study and advise on the specialized field assigned; handle assigned tasks according to prescribed procedures, formalities, and deadlines. Timely report to the immediate supervisor when encountering difficulties or new issues during task execution.

3. Adhere to speaking discipline, Code of Conduct for Inspectors, Working Regulations, Office Culture Rules of the Government Inspectorate, and other regulations concerning staff members; implement reporting systems and file management as stipulated by the Government Inspectorate. Personally bear responsibility before the Department Head, Director, and the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

4. Staff members of the Bureau assigned to lead inspection and verification teams have the responsibility to direct, monitor, urge, and inspect the activities of team members; report to the Director on the progress and results of inspections and verifications; regularly inform the Department Head about the management of staff participating in inspection and verification teams.

Chapter III.

WORK RELATIONSHIPS

Article 9. Implementing the directives of the Government Inspectorate's leadership

The Bureau is subject to the leadership and direction of the Chief Inspector General and Deputy Chief Inspector Generals; has the responsibility to strictly fulfill assigned tasks, promptly report to the Government Inspectorate leadership on the results of task implementation as required; when necessary, propose recommendations to the Government Inspectorate leadership on issues needing resolution during task implementation.

Article 10. Relations with units under the Government Inspectorate

1. The relations between Bureau III and other Bureaus, Departments, and units under the Government Inspectorate are cooperative, exchange, and mutual support relations to fulfill tasks.

2. Cooperation with Departments, Bureaus, and other units during the performance of tasks shall be carried out in accordance with the Working Regulations of the Government Inspectorate issued by the Chief Inspector.

Article 11. Work relations with provincial inspectors under Region 3

1. Regularly inspect, urge, guide, and grasp the implementation of work programs of provincial inspectors directly under the central government in Region 3; periodically every quarter, proactively work with inspection agencies within the jurisdictional area to thoroughly understand general activities and specific inspection, complaint, and denunciation resolution activities; in case of emergencies, specific documents must be prepared to request meetings.

2. Timely report and reflect to the Chief Inspector or Deputy Chief Inspector in charge about requests and recommendations from provincial inspectors directly under the central government in Region 3 for the leadership of the Government Inspectorate to consider and resolve.

Article 12. Relations between Bureau leadership and Party committees and leadership of mass organizations within the Bureau

1. Bureau leadership creates conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; cooperate with the Party committee and leadership of mass organizations to create conditions for Party members, officials, and civil servants in the Bureau to study and improve political and professional qualifications; ensure democratic regulations in the operation of the agency, build office culture, administrative discipline.

2. Bureau leadership has the responsibility to provide full and timely information on the Bureau's operational activities and the rights of officials and civil servants to the Party committee and leadership of mass organizations; seek opinions from the Party committee and leadership of mass organizations before deciding issues related to leadership coordination measures, political education, internal protection, strengthening unity, caring for the lives of officials and civil servants in the Bureau; organizational cadre work in the Bureau.

Chapter IV.

IMPLEMENTATION

Article 13. Responsibility for Implementation

1. The Director, Deputy Directors, Heads, Deputy Heads of all officers and civil servants of Bureau III are responsible for implementing this Regulation.

2. Other contents related to the functions, tasks, powers, and operational activities of the Bureau that are not reflected in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws and regulations on inspections, complaints, and denunciations.

3. Based on current regulations and this Regulation, the Director of Bureau III is responsible for drafting and issuing the Working Regulations of his unit to implement assigned functions and tasks.

Article 14. Amendment and supplementation of this Regulation

During the implementation of this Regulation, if any difficulties arise, the Director of Bureau III will coordinate with the Department Head of the Organization and Cadre Department to promptly propose amendments and supplements to the Chief Inspector to ensure that this Regulation meets the requirements of Bureau III and the Government Inspectorate's operations./.
