DECREE

Regarding the establishment of the Central Steering Committee for Commendation and Awards

THE GOVERNMENT

 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Competition and Rewards dated November 26, 2003;

Pursuant to Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of government agencies;

At the proposal of the Minister of Home Affairs and the Chairman of the Government Office,

DECREE:

Article 1. Establish the Central Steering Committee for Commendation and Awards

1. Establish the Central Steering Committee for Commendation and Awards, which is a government agency assisting the Government in managing state affairs on commendation and awards nationwide; implementing certain state management tasks and organizing commendation and award activities according to the provisions of the law; managing public services within the scope and domain of the Committee's management according to the provisions of the law.

2. The Central Steering Committee for Commendation and Awards has legal personality, bears a seal with the national emblem, its operational budget is funded from the state budget, it has a separate account, and its headquarters is located in Hanoi.

Article 2. Tasks and powers of the Central Steering Committee for Commendation and Awards

The Central Steering Committee for Commendation and Awards is responsible for performing the tasks and powers of a government agency managing state affairs in the industry and field according to the provisions of Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of government agencies, and the following specific tasks and powers:

1. Serving as the permanent body of the Central Steering Committee for Commendation and Awards;

2. Taking the lead or participating in drafting draft laws, ordinances, and regulatory legal documents on commendation and awards according to the division of labor assigned by the Government; Prime Minister;

3. Submitting to the Government, Prime Minister programs and plans for long-term, five-year, and annual work on commendation and awards; organizing their implementation after approval; compiling and reporting periodically on the status of commendation and award work;

4. Submitting to the Government, Prime Minister regulations on the criteria, procedures, timeframes for considering commendation titles and award forms; simplified award forms and procedures;

5. Submitting to the Government, Prime Minister regulations on models of award items under state management;

6. Submitting to the Minister designated by the Prime Minister to issue regulatory legal documents within the scope of the Committee's state management;

7. Organizing the implementation of commendation campaigns and implementing the Party and State's award policies; guiding specialized business operations on commendation and awards for sectors and levels;

8. Compiling and reviewing files for commendation proposals from agencies and organizations to submit to the Government, Prime Minister for decision-making on commendations or for the Prime Minister to propose to the President for decision-making on commendations;

9. Organizing the production, preservation, distribution of award items; preparing items accompanying award forms of the President, Government, Prime Minister; organizing the recovery, exchange of award items according to decisions of the Prime Minister, President;

10. Organizing training and capacity building for cadres and civil servants working on commendation and awards at all levels and sectors;

11. Directing the implementation of the administrative reform program of the Committee according to the goals and contents of the State administrative reform program already approved by the Prime Minister;

12. Managing and archiving commendation files within the authority to decide of the Prime Minister, President;

13. Mobilizing financial support and managing and using the central commendation and award fund; directing and inspecting the management and use of commendation and award funds at all levels and sectors;

14. Implementing international cooperation on commendation and awards according to the provisions of the law;

15. Inspecting, auditing, and recommending to competent authorities to handle violations in the implementation of policies, systems, laws, rules, and professional procedures on commendation and awards. Organizing citizen reception, handling complaints and denunciations regarding commendation and award work according to the provisions of the law;

16. Managing the organizational structure, staffing, and finance and assets of the Committee according to the provisions of the law. Implementing policies for cadres, civil servants, and officials within the scope of the Committee's state management.

Article 3. Leadership of the Central Steering Committee for Commendation and Awards

The Central Steering Committee for Commendation and Awards has a Director and Deputy Directors.

The Director of the Central Steering Committee for Commendation and Awards is appointed by the Prime Minister and is accountable to the Prime Minister for all activities of the Committee.

Deputy Directors are appointed by the Prime Minister upon the recommendation of the Director and are accountable to the Director for the areas of work assigned to them.

Article 4. Organizational structure of the Central Steering Committee for Commendation and Awards

1. Organizations assisting the Director in performing state management functions:

a) Research and Synthesis Department (called Department I);

b) Department of Commendation and Awards for Ministries, Agencies, and Mass Organizations at the Central Level (called Department II);

c) Department of Commendation and Awards for Provinces and Cities Under Central Administration (called Department III);

d) Organization Department;

đ) Inspectorate;

e) Office (with a permanent presence in Ho Chi Minh City).

2. Affiliated organizations of the Committee:

a) Information Technology and Archive Center;

b) Journal of Commendation and Awards.

The Director of the Central Steering Committee for Commendation and Awards shall specify the tasks and staffing of each unit within the total number of staff allocated by the state.

Article 5. Effectiveness

This Decree takes effect fifteen days after its publication in the Official Gazette. Decree No. 57/HĐBT dated April 5, 1988 of the Council of Ministers on the functions, tasks, powers, and organizational structure of the National Institute for Commendation and Awards and previous regulations contrary to this Decree are hereby abolished.

Article 6. Responsibility for Implementation

The Director of the Central Steering Committee for Commendation and Awards, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, and Chairmen of People's Committees of Provinces and Cities Under Central Administration are responsible for enforcing this Decree./.
