Decision No. 158/2004/QĐ-TTg On continuing to implement the pilot scheme of allocating personnel quotas and operating funds for the General Department of Customs under the Ministry of Finance in 2004

DECISION

Regarding the continued implementation of the pilot scheme for allocating personnel quotas and operating funds for the General Department of Customs under the Ministry of Finance in 2004

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Overall Program on Administrative Reform of the State for the period 2001 - 2010 issued together with Decision No. 136/2001/QĐ-TTg dated September 17, 2001 of the Prime Minister;

Pursuant to Decree No. 96/2002/NĐ-CP dated November 19, 2002 of the Government on the functions, tasks, powers of the General Department of Customs;

Pursuant to Resolution No. 17/2003/QH11 of the National Assembly on the state budget estimate for 2004;

At the proposal of the Minister of Finance,

Article 1. Continue to implement the pilot scheme for allocating personnel quotas and operating funds for the General Department of Customs in 2004 in accordance with the provisions set out in Decision No. 159/2003/QĐ-TTg dated August 4, 2003 of the Prime Minister.

Article 2. Repeal, amend, and supplement some provisions stipulated in Decision No. 159/2003/QĐ-TTg as follows:

1. Repeal the provision at Clause 2, Article 4.

2. Amend Clause 4, Article 7 as follows:

"4. Adjust the minimum wage level for officers and civil servants of the General Department of Customs not exceeding 2.5 times the national minimum wage level from January 1, 2004 to June 30, 2004, and not exceeding 1.8 times the national minimum wage level from July 1, 2004 to December 31, 2004."

1. The Provincial People's Committee shall complete the confirmation of the Certificate of Tariff Quota within three (03) working days from the date of receipt of a complete set of documents.

"Article 9. The Minister of Finance shall be responsible for:
1. Taking the lead in organizing a mid-term review and evaluation to draw lessons from the implementation of the pilot scheme for allocating personnel quotas and operating funds for the General Department of Customs over the two-year period 2003-2004; coordinating with relevant agencies to resolve any arising issues and report

Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Minister of Finance shall take the lead and coordinate with relevant agencies to be responsible for guiding the implementation of this Decision.

Article 4. The Ministers of Finance, Planning and Investment, Labor, Invalids and Social Affairs, Justice, and the heads of relevant agencies shall be responsible for implementing this Decision./.
