DECREE-LAW

OF THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

NO. 158/SL DATED November 17, 1950

THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

Pursuant to Decree-Law No. 13-SL dated January 24, 1946 and subsequent decrees organizing courts and judicial ranks;

Pursuant to Decree-Law No. 76-SL dated May 20, 1950 promulgating the regulations for civil servants of Vietnam;

At the proposal of the Minister of Justice and the Minister of Interior Affairs;

In accordance with the resolution of the Council of Ministers after consultation with the Standing Committee of the National Assembly;

ISSUES THE FOLLOWING DECREE-LAW:

Article 1: Peasant and worker cadres with proven experience may be appointed to an appropriate judicial rank upon recommendation by a Selection Board.

Article 2: Judges of the People's Courts at district level, if competent and dedicated, may be promoted to the judicial rank of judges of the People's Courts at provincial level upon recommendation by a Selection Board.

Article 3: The Selection Board referred to in Article 1 consists of:

- The Minister of Justice or his representative: Chairman.

- A representative from the Ministry of Interior Affairs: Member.

- A judge designated by the Minister of Justice: Member.

- Two representatives nominated by peasant and worker organizations: Members.

Article 4: The Minister of Justice shall issue a decree to provide detailed implementation of this Decree-Law.

Article 5: Any provisions contrary to this Decree-Law are hereby abolished.

Article 6: The Ministers of Justice and Interior Affairs shall implement this Decree-Law accordingly.
